Dear Mr. Palmer:
This letter is provided to you, as the applicant for Garfield County File No. FPAA-11-18-
8697, pertaining to Lot S8 of Aspen Glen Subdivision Filing No. 8. This letter is notification
that your request to amend the Building Envelope on said lot, has been reviewed by the
Community Development Department and the Director hereby issues a determination
conditionally approving the request. The conditions of approval are as follows:
1. That all representations of the Applicant contained in the Application submittals
shall be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. Final review by the County Surveyor's Office shall be required and all edits and
corrections based on that review shall be completed prior to submittal of the plat for
signature by the Board of County Commissioners.
3. The Plat shall be subject to final review and approval by the County prior to
submittal of the plat for final execution. All required plat certificates and signature blocks
shall be included on the final plat. The following edits shall be made to the Plat prior to
submittal to the County for final review (additional changes or updates may be required
as part of the final review):
a. Adjust the text where it interferes with other text (The Title Certificate
heading and the new added envelope area of 377 square feet are on top of
each other).
b. Remove "To Be" references from the plat, including but not limited to,
Original Building Envelope = 3566 Sq. Ft. "To Be" Removed By This Plat,
Area "To Be" Removed/Added from the Original Building Envelope.

I. DESCRIPTION OF PROPOSAL - REQUEST
The Applicant is requesting an Amended Final Plat to adjust the Building Envelope to
better accommodate the plans for a new single-family residence.
I. AUTHORITY - APPLICABLE REGULATIONS
The Amended Final Plat Application is being processed in accordance with Section 5-305,
Amended Final Plat and 4-103, Administrative Review of the Land Use and Development
Code. An excerpt from Section 5-305 (C) containing the Review Criteria for an Amended
Final Plat is provided below.

An application for an Amended Final Plat shall meet the following criteria:
1. Does not increase the number of lots; and
2. Does not result in a major relocation of a road or add any new

III. PUBLIC & REFERRAL COMMENTS
Public Notice as required by the County Land Use and Development Code was completed.
One public comment was received in support of the application (Exhibit 7). None were
received in opposition.
1. Aspen Glen Design Review Committee (Exhibit 9): Indicated that the application
had already been approved by the DRC subject to conditions.
IV. STAFF ANALYSIS
1. The Application complies with the Review Criteria contained in Section 5-305 (C)
noted as follows:
a. The Application will not result in an increase in the number of lots.
b. The Application will not result in the relocation of any major roads and does
not add any new roads.

d. The Applicant shall update the plat to reference the newly submitted Title
Commitment and shall include language that all referenced easements are
shown on the plat.
e. If the updated Title Commitment shows that there is a lienholder, then the
plat should reflect that by adding a lienholders consent certificate.
f. A plat note shall be added referencing the original Plat and affirming that all
plat notes shown thereon shall remain in effect.
g. Names and Addresses of any Mineral Owners shall be shown on the plat.
h. The plat shall reference the covenants on the subject property.
i. The current year when signed shall be changed to 2019.
j. Correct the road name to read "Saddleback Road."
k. Adjust the graphic on the Vicinity Map with a clearer version.
4. The Applicant has 90 days within which to satisfy conditions of approval and
provide the following documentation for BOCC signature and recordation:
a. A plat mylar with executed required Certificates;
b. Recording Fees.

We are in the process of gaining approvals for a new single family residence at 649 Saddleback Road in Aspen Glen. As
part of the process, we have requested a modification of the building envelope, in order to better accommodate the new
single family residence.
We are required to issue a public notice to property owners within 200 -ft of our property, of the proposed change and the
determination date.
I am attaching the Public Notice, containing the Legal Description of the property, the Practical Description of the
property and the Description of the Request for your review and input. You are invited to comment regarding this
application.
The Director will issue a decision on this application on Thursday, December 27, 2018. Comments and input must be
received prior to that date, in order to be considered.

located at 108 8th Street, Suite 401, Garfield County Administration Building, Glenwood Springs,
