HomeMy WebLinkAbout2.0 CDPHE Recommendation of Approval Letter 03-25-19COLORADO Department of Public Health & Environment Dedicated to protecting and improving the health and environment of the people of Colorado March 25, 2019 Board of County Commissioners Garfield County 108 8th Street, Suite 101 Glenwood Springs, CO 81601 Re: Recommendation of Approval with Conditions Application for Certification of Designation Stericycle Infectious Waste Transfer Facility -Rifle SW /GAR/SWR 2.1 Members of the Board, On October 9, 2018, the Colorado Department of Public Health and Environment, Hazardous Materials and Waste Management Division (Division), received from Garfield County, Colorado, an official referral notification requesting the Division's review of an Application for a Certificate of Designation (CD) (Application) for a new Medical Waste Storage Facility (Facility) near Rifle, Colorado. As described in the Application, Stericycle, Inc. has requested a CD for a new facility which consolidates and stores medical waste for transfer to an appropriate treatment facility. All medical waste storage is done in secured trailers, which are located in a secured yard at 552 County Road 352, Rifle, Colorado 81650. Included in the Application is an Engineering Design and Operations Plan (EDOP) prepared by Golder Associates, and dated July 16, 2018. The Division reviewed the Application to determine its compliance with the requirements set forth in the Solid Waste Disposal Sites and Facilities Act, Title 30, Article 20, parts 1 and 10 (Solid Waste Act) of the Colorado Revised Statues (CRS), as amended, and with the regulations promulgated there under: the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2, Part 1 (Solid Waste Regulations). In accordance with the Solid Waste Statute, CRS 30-20-103 (2), a Completeness Review of the Application was performed within thirty (30) days of receipt. The Division issued written determination on October 23, 2018, that the Application was complete. It was not the intent or purpose of this Completeness Review to imply anything concerning the final approval of the Application. On February 7, 2019, the Division published a notice in the Citizen Telegram requesting written public comments on the proposed Stericycle Infectious Waste Transfer Facility - Rifle. The Division conducted a comprehensive technical evaluation, and on January 14, 2019, the Division provided technical review comments to the Facility. On February 12, 2019, the Division received a comment response letter and a revised EDOP (Revision 1) that incorporated the changes proposed in the comment response letter. It is the determination of the Division that the Stericycle Infectious Waste Transfer Facility - Rifle can comply with technical, environmental, and public health standards of the Solid Waste Act and the Solid Waste Regulations if the Facility is monitored and operated as stated in the CD Application and with the Division's conditions of recommendation as stated below in this letter. Based on our review and determination, the Division recommends, with conditions, that the Stericycle Infectious Waste Transfer Facility -Rifle may be approved by Garfield County based on these and any local criteria. The final revised Stericycle Infectious Waste Transfer Facility -Rifle Application including the final revised EDOP (Revision 1) and final resolution containing the CD must be placed in the Facility's operating record. In addition to the conditions listed below, please note that the Stericycle Infectious Waste Transfer Facility -Rifle must comply with the public health and environmental laws, standards, and regulations of the Department and all other applicable state, federal, and local rules, and ordinances. Our recommendation for approval of the Application including the final revised EDOP (Revision 1) has the following conditions that must be incorporated into the CD if issued by Garfield County: 1. In accordance with Section 4 of the Solid Waste Regulations, third party cost estimates for closure must be submitted to the Division within sixty (60) days of the issuance of the CD. Once the closure cost estimates have been approved by the Division, the Facility will have thirty (30) days to submit a financial assurance mechanism for review and approval. 2. Compliance with this CD requires the owner/operator comply with the attached EDOP and any future Department-approved EDOP conditions, including both Department- approved amendments to the EDOP and Department-approved stand-alone plans necessary to comply with the Solid Waste Act and Regulations. Violation of the EDOP as so amended constitutes a violation of this CD. This CD need not be amended upon EDOP amendment unless required by Garfield County. CDPHE reserves the right to make unilateral modifications to the EDOP language and conditions at any time during the life of the facility, including during the post closure care period. CDPHE will attempt to consult with the County prior to doing so.
