PROJECT INFORMATION AND STAFF COMMENTS
I. DESCRIPTION OF PROPOSAL - REQUEST
The Applicant is requesting an Amended Final Plat to merge the two identified lots and
adjust the Building Envelopes.
II. AUTHORITY . APPL¡CABLE REGULATIONS
The Amended Final Plat Application is being processed in accordance with Section 5-305,
Amended Final Plat and 4-103, Administrative Review of the Land Use and Development
Code. An excerpt from Section 5-305 (C) containing the Review Criteria for an Amended
Final Plat is provided below.
Amended Final Plat Criteria:
C. Review Criteria
An application for an Amended Final Plat shall meet the following criteria.
1. Does not increase the number of lots; and
Does not result in a maior relocation of a road or add any new
roads; or
Witt correct technical errors such as survcying or drafting errors.
Public notice for the Director's Decision is required in accordance with Sections 4-103,4-
101 and Table 5-103 and has been completed by the Applicant.

Public Notice as required by the County Land Use and Development Code was completed.
One public comment was received in support of the application (Exhibit 7). None were
received in opposition.
1. Garfield Gounty Designated Engineer (Exhibit 8): lndicated that the applicant
should verify that there are no existing utility lines on the easement between the
lots, that there is no drainage conveyances that occupy the easement that is to be
abandoned, and the proposed plat should show FEMA mapping.

2. Aspen Glen Design Review Gommittee (Exhibit 9): lndicated thatthe application
had already been approved by the DRC subject to conditions.
1. The Application complies with the Review Criteria contained in Section 5-305 (C)
noted as follows:
a. The Application will not result in an increase in the number of lots.
b. The Application will not result in the relocation of any major roads and does
not add any new roads.
c. No technical errors have been noted with the application.
2. The Plat for Aspen Glen indicates that there are drainage and utility easements
located on the side lot lines of each lot. A previous submittal by the applicant
indicated that this is the case with Lots A8 and A9. The County designated engineer
requested that the applicant verify that there are no drainage conveyances that
occupy that easement to be abandoned. Staff's site visit indicated that there are no
existing drainage conveyances in the drainage easement.
3. The County designated engineer indicated that the Applicant should verify that there
are no existing utility lines in the easement between lots A8 and 49.
4. The County designated engineer indicated that FEMA mapping should be shown on
the plat. Staff has included a suggested condition of approval that a plat note be
included indicating that floodplain is located on the site and development may be
subject to applicable floodplain regulations. The reason mapping is not shown on
the plat is floodplain mapping is subject to change. Changes could require future
amendments to the plat and the issue can be better addressed through a plat note.
5. Comments from the County Surveyor are anticipated and will be addressed by a
condition of approval requiring his final review/approval and completion of any
requested edits prior to execution of the amended plat.
6. The applicant is decreasing the total Building Envelope area between the two lots.
7 . The Applicant has provided title work on the property and a statement that indicated
no lienholder certificate is required.
8. The proposed building envelope complies with zoning in the To acre zone district of
the Aspen Glen PUD.
g. The proposal has been reviewed and approved by the Aspen Glen Design Review
Committee.

10. Final edits to the proposed plat shall be completed, reviewed and accepted by the
County Attorney's Office and Planning Staff including but not limited to:
Remove Garfield County Setback Lines
The plat shall be in black and white.
Remove "To Be" references from the plat, including but not limited to, Area to
be Added to Building Envelope, Building Envelope Line to Be Abandoned,
Area to be removed from lotA9 Building Envelope, LotAS Building Envelope
Line to be abandoned, and Building Envelope Line to be Created with this
plat.
The Applicant shall update the plat to reference the newly submitted Title
Commitment and shall include language that all referenced easements are
shown on the plat.
A plat note shall be added referencing the original Plat and affirming that all
plat notes shown thereon shall remain in effect.
Names and Addresses of any Mineral Owners shall be shown on the plat.
The plat shall reference the covenants on the subject property.
The plat shall show the utility and drainage easement that is being removed
between lots AB and A9. lt shall also include a reference that the easement
is being abandoned.
A plat note shall be included indicating a FEMA mapped floodplain is located
on the property and any development may be subjectto applicable floodplain

Staff supports a finding that the Applicant has completed all public notice requirements and
that subject to compliance with conditions of approval the Amended Final Plat of Lots A-8
and A-9 meet the requirements and standards of the Garfield County Land Use and
Development Code including the Amended Plat Review Criteria contained in Section 5-
305. The Application is recommended for Administrative Approval by the Director of the
Community Development Department subject to the following conditions of approval.
1 . That all representations of the Applicant contained in the Application submittals shall
be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. Final review by the County Surveyor's Office shall be required and all edits and
corrections based on that review shall be completed prior to submittal of the plat for
signature by the Board of County Commissioners.
3. The Plat shall be subject to final review and approval by the County prior to
submittal of the plat for final execution. All required plat certificates and signature blocks
shall be included on the final plat. The following edits shall be made to the Plat prior to

submittal to the County for final review (additional changes or updates may be required as
part of the final review):

the following documentation for BOCC signature and recordation:
a. A plat mylar with executed required Certificates;
b. Recording Fees.

Director, Gartield County, State of Colorado, to request an Amenclecl Final Plat in the Aspen Glen
Subdivision located in Section 29, Township 7 S, Range 88 W of the 6th P.M. County of Garfield,
State of Colorado; to-wit:
Leeal Description:Lots A-8 and A-9, Aspen Glen Filing No. l, according to the Plat
thereof filed April 6, 1995, at Reception No.476330 and according to
Plat thereof filed June 17,1997, at Reception No. 509682.
Practical Description:The parcels are located in the Aspen Glen Subdivision. The physical

Descri pJioE.of Request :The Applicant has submitted an application for an Amended Final
Plat affecting Lots A-8 and A-9 ofthe Aspen Glen Subdivision. The
Amended Final Plat proposes to merge the two lots and the two
building envelopes into one. The property is zoned PUD.
The Director's Determination has been scheduled for Tuesday, November 13, 2018
All persons affected by the proposed Amended Final Plat are invited to comment regarding the

Dear Patrick:
This offrce has performed a review of the documents provided fol the Arnended Final Plat
Application for Aspen Glen 48, LLC. The subrnittal was found to be thorough and well organized.
The review generated the following comments:
1. The Applicant should provide verification that there are no existing utility lines in the easement
between lots A8 and A9; or if there are existing utilities in this easement, the Applicant should
coordinate with the respective utility companies for relocation of the utilities into agreed upon
easements.
2. The Applicant should provide verification that there are no drainage conveyances that occupy
the easemerit that is to be abandoned between lots A8 and 49. The Applicant provicles a
statement fi'om an engineer that cliscusses overall drainage patterns, however it is silent on
whether or not the existing easement is cuuently being used for dlainage.
3. 'Ihe proposed plat cloes not show FEMA Floodplain mapping. The plat should show floodplain
delineation and elevation infbrmation to verify that the building envelope proposed is outside
ofand/ot above the base flood elevation.

Dear Patrick,
Thank you for the opportunity to comment on the referral request from Garfield County
regarding Lot Glen A-8 LLC, 417 and 375 Rivers Bend in Aspen Glen. The Aspen Glen
Design Review Committee (DRC) reviewed the proposed plat amendment to combine
Lots A-08 & A-09 (417 8L 375 River's Bend) into one lot at their September 5, 2018
regular meeting. The plat amendment eliminates the building envelope for A-09 and
adjusts the building envelope for Lot A-08. The application submitted to Garfield
County reflects the previous Aspen Glen DRC approval.
The DRC had the following conditions of approval:
l. A copy of the recorded amended plat shall be provided to the Aspen Glen DRC
2. It is the responsibility of the property owner to ensure that this lot merge does not
negatively affect the utility and drainage easement that are being eliminated
between the two properties.
3. The DRC has only approved the lot tie. Any further improvements to property
require DRC review and approval.
