DIRECTOR DETERMINATION - Briston Peterson - Aspen Glen Filing No. 1 - Amended
Final Plat Lots A-8 and A-9 (File No. FPAA-09-18-8684)
Dear Mr. Peterson
This letter is provided to you, as the applicant for Garfield County File No. FPAA-09-18-
8684, pertaining to Lots A-8 and A-9 of Aspen Glen Subdivision Filing No. 1. This letter
is notification that your request to merge lots A-8 and A-9 as well as amending the Building
Envelopes on said lots, has been reviewed by the Community Development Department
and the Director hereby issues a determination conditionally approving the request. The
conditions of approval are as follows:
1. That all representations of the Applicant contained in the Application submittals
shall be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. Final review by the County Surveyor's Office shall be required and all edits and
corrections based on that review shall be completed prior to submittal of the plat for
signature by the Board of County Commissioners.
3. The Plat shall be subject to final review and approval by the County prior to
submittal of the plat for final execution. All required plat certificates and signature blocks
shall be included on the final plat. The following edits shall be made to the Plat prior to
submittal to the County for final review (additional changes or updates may be required
as part of the final review):
a. Remove Garfield County Setback Lines.
b. The plat shall be in black and white.
c. Remove "To Be" references from the plat, including but not limited to, Area
to be Added to Building Envelope, Building Envelope Line to Be
Abandoned, Area to be removed from lot A9 Building Envelope, Lot A8

d. The Applicant shall update the plat to reference the newly submitted Title
Commitment and shall include language that all referenced easements are
shown on the plat.
e. A plat note shall be added referencing the original Plat and affirming that all
plat notes shown thereon shall remain in effect.
f. Names and Addresses of any Mineral Owners shall be shown on the plat.
g. The plat shall reference the covenants on the subject property.
h. The plat shall show the utility and drainage easement that is being removed
between lots A8 and A9. lt shall also include a reference that the easement
is being abandoned.i. A plat note shall be included indicating a FEMA mapped floodplain is
located on the property and any development may be subject to applicable
floodplain reg ulations.j The plat shall reference the lot line that is being removed.
k. The plat shall show the name of the merged lot.
4. The plat amendment is limited to adjusting the Building Envelopes and merging
the identified lots.
5. Prior to the Board's signature on the plat, the applicant shall demonstrate that
there are no utilities located in the easement to be abandoned.
6. The Applicant has 90 days within which to satisfy conditions of approval and
provide the following documentation for BOCC signature and recordation:
a. A plat mylar with executed required Certificates;
b. Recording Fees.
Notice of this decision will be provided to the Board of County Commissioners who has
the ability to'call-up'the application for review at a public hearing. You will be notified of
the Board decision once it is received or upon expiration of the 10 day notice period.
Additionally, you have the ability to call the application up to the Board of County
Commissioners. Please notify Patrick Waller in writing if you wish to do so.
