The address is 363 County Road 251, Rifle, CO 81650 Subdivision of one parcel into lots of approximately 5.003 acres and 6.67 acres. WATER/SANITATION Onsite Well / Septic ZONING Rural COMPREHENSIVE PLAN Residential Medium High, 2-6 Acres per Dwelling Unit I. DESCRIPTION OF THE PROPOSAL The Applicant has submitted an Administrative application for a Minor Subdivision with a request to subdivide an existing 11.673 acre parcel into lots of 5.003 acres and 6.67 acres. The parcel is owned by William and Jayne Wilde. The representative is Michael Langhorne. Proposed Parcel C is currently improved with a single-family dwelling unit and accessory building. Proposed Parcel D is vacant and is currently used as an irrigated hayfield. The applicant has indicated that the two lots would be served by an existing, augmented shared well. Wastewater would be handled by separate Onsite Wastewater Treatment Systems. Access is from separate driveways on County Road 251. II. DESCRIPTION OF THE SITE The property is gently sloping, irrigated agricultural land situated in the broad valley floor of Rifle Creek drainage. WAIVER REQUESTS FROM STANDARDS The Applicant has not requested any waivers from the applicable Standards. IV. AUTHORITY — APPLICABLE REGULATIONS A. Section 5-301 of the Land Use and Development Code (LUDC), designates the division of land that creates no more than 3 parcels, is served by a private well or water supply entity and does not require the extension, construction, or improvement of a County right-of-way, as requiring Administrative Review. B. Section 4-103 of the LUDC sets forth the Administrative Review Procedures by which the current Application is being considered. C. Article 7 of the LUDC sets forth General approval standards in Division 1, General Resource Protection Standards in Division, 2 Site Planning and Development Standards in Division 3, and Subdivision Standards and Design Specifications in Division 4. Minor Subdivisions are also subject to Section 5-301(C) and 5-402(F). The standards are addressed in the Application submittals and in the Staff Analysis section of the Staff Report. V. PUBLIC AND REFERRAL COMMENTS The Applicant has provided documentation that all required notice mailings have been completed in accordance with the LUDC. No public comments were received as a result of the public notice. Referral Comments received on the Application are attached as Exhibits and summarized below: A. Colorado Department of Transportation (See Exhibit 7): The following comments were submitted. • No issues were identified with the application B. Colorado Geological Survey (See Exhibit 8): The following comments were submitted. • CGS has no objection to approval of the two -lot minor subdivision C. Mountain Cross Engineering (See Exhibit 9): The following comments were submitted. • There should be an easement that provides access to the well for both parcels • It is typical to have the Applicant verify that existing OWTS are functioning properly by having them inspected by a qualified professional. D. Colorado River Fire Rescue (CRFR) (See Exhibit 10): • Colorado River Fire Rescue has no issues with the proposed subdivision 4 E. Garfield County Vegetation Management (See Exhibit 12): • There are several Russian -olive trees located on the property. Staff requests that the applicant provide a management plan that will address the removal and treatment of these trees. F. Garfield County Road and Bridge (See Exhibit 11): • Driveway permit has been issued for Lot C and the applicant has received a permit for proposed Lot D G. West Divided Water Conservancy District (See Exhibit 13): • No issues identified H. Xcel Energy (See Exhibit 14): • Xcel Energy has no objection to the application Colorado Division of Water Resources (Exhibit 15) • The proposed water supply should be physically adequate and will not cause material injury to decreed water rights so long as the applicant operates the well in accordance with the terms of the augmentation plan and well permit. J. Garfield County Surveyor (Exhibit 16) • Identified no issues with the application K. Garfield County Environmental Health (Exhibit 19) • Noted that the property is located near Rifle Creek which has historically had water quality concerns. Asked that site occupants properly manage solid and hazardous waste and conduct regular maintenance of their septic systems. Comments have not been received from the following agencies and departments: City of Rifle, Colorado Parks and Wildlife VI. STAFF ANALYSIS Article 7, Division 1: General Standards 1. Section 7-101: Compliance with Zone District Use Regulations The proposed subdivision is in general conformance with the dimensional standards of the Rural zone district. The minimum lot size in that zone district is 2 acres. The smallest lot in the proposed subdivision is 5 acres. Based on the applicant's site plan submittal, structures on the site are compliant with building setback requirements. 2. Section 7-102: Conformance with Comprehensive Plan and compliance with IGAs The property is designated as Residential Medium High in the Comprehensive Plan. 5 This means that the suggested density is 2-6 acres per dwelling unit. The proposed subdivision achieves approximately 5.84 acres per dwelling unit. The proposal appears to be in general conformance with the comprehensive plan. LAND USE DESIGNATION DESCRIPTION Residential Medium High (RMH) Small farms, estates. and clustered residential subdivisions: density determined by degree of clustering and land preserved in open condition: 0% open land = 1 du per -6 acres 50% open land = 1 du per 4 acres 70% open land = 1 du per 2 acres COMPATIBLE ZONING Rural (R) Planned Unit Development (PUD) Density of residential uses: 1 du per 2 to <6 acres Example: 3. Section 7-103: Compatibility The proposed use is surrounded by agricultural areas and rural residences. It is surrounded entirely by Rural zoning. The proposed size of the subdivision is compatible with surrounding parcels. Proximate parcels range in size from 238 acres to 3.97. The smallest lot created by this subdivision would be approximately 5 acres. The applicant anticipates the undeveloped parcel would be built -out with a single-family home, a use that is compatible with surrounding land uses. 4. Section 7-104: Sufficient, Adequate, Legal and Physical Source of Water The Applicant has proposed to supply water to both proposed parcels using a permitted well (permit No. 80938-F). Historically this well had supplied water to an adjacent parcel (Parcel B of the Mangurian exemption), in addition to the subject Parcel (Parcel C of the Mangurian Exemption). A new exempt well has been drilled for Parcel B of the Mangurian Exemption and the existing well has been re -permitted and will be used only for the proposed subdivision. The newly permitted well for Parcel C is non-exempt and will be augmented with a West Divide Water Conservancy District contract. The new well permitted on Parcel B of the Mangurian exemption has received a permit from the Division of Water Resources (Permit No. 305596), that was applied for by the 6 property owners. Since the property is directly adjacent to the proposed subdivision, they were noticed as part of the public noticing requirement. No public comment has been received on the application at this time. The application was reviewed by the Colorado Division of Water Resources. The Division's referral comments concluded (Exhibit 15): Based on the above, it is our opinion, pursuant to CRS 30-28-136(1)(h)(I), that the proposed water supply should be physically adequate and will not cause material injury to decreed water rights so long as the applicant operates the well in accordance with the terms of the augmentation plan and well permit. Staff has included a suggested condition of approval that the applicant comply with any Division of Water Resources permit requirements. The application was sent to the West Divide Water Conservancy District, the agency responsible for the augmentation plan. No issues were identified (Exhibit 13). The applicant completed a pump test on the well that was reviewed by the applicant's engineer and the County designated engineer. Since no issues were raised as part of either review, staff has determined that the pump test is adequate. The applicant has completed water quality testing for the existing well. Those results were analyzed in the Amended Water Supply Plan, completed November 9, 2017, by Colorado River Engineering and submitted as part of the application. CRE's review indicated no issue with primary water quality standards. This report was reviewed by the Garfield County designated engineer who did not indicate any issues. It is staff's opinion that the applicant is compliant with County water quality standards. 5. Section 7-105: Adequate Central Water Distribution and Wastewater Systems The subject parcel is part of the Mangurian Exemption. A plat note on that exemption plat stated: The shared well system approved for this exemption requires either an individual water storage tank, minimum capacity of 1000 gallons, be installed on each lot or a central storage tank, sizing to be a minimum of 1000 gallons per lot created and served by the central water system to be installed. This action shall be done at time of building permit application at the expense of the building permit applicant. The applicant addressed compliance with this plat note by installing a 2,500 gallon tank in close proximity to the shared well on Parcel C. The new water distribution system includes a 2" water pipeline that has been extended to the property line of Proposed Parcel D. 7 The application indicates that both parcels will be served by separate Onsite Wastewater Treatment Systems. The developed single-family residence is already served by an OWTS issued by the County Building Department in 1997 (Permit No. 2775). The permit was issued for a single-family residence with three bedrooms and Garfield County Assessor records show that the residence still has three bedrooms. Because the system was originally permitted by the County and the current County records do not show an increase in the number of bedrooms, it is staff's opinion that the waste disposal system for the current lot is adequate. Per Garfield County Geologic Hazards mapping, the parcel is located in an area of High Groundwater. Generally, this requires an engineered septic system. However, the County has already permitted a non -engineered system for the existing parcel. The application was reviewed by the Garfield County designated engineer who did not indicate a need for an engineered system. It is staff's opinion that at the time of building permit on the undeveloped parcel, the applicant will need to obtain an OWTS permit. At this time Building Department staff will determine whether or not the system will need to be engineered. 6. Section 7-106: Adequate Public Utilities The applicant has stated that the current parcel is provided with electric utility service from Xcel Energy. The new parcel will also be served by Xcel Energy and the applicant has provided a will serve letter from Xcel Energy. The application was reviewed by Xcel Energy and no issues were identified. 7. Section 7-107: Access and Driveways The applicant has proposed two separate accesses for the two lots in the proposed subdivision. Both will access onto the County Road. The applicant has obtained a driveway permit from Garfield County Road and Bridge for proposed Parcel D, which is currently undeveloped (Permit No. GRB17-D-5). Garfield County Road and Bridge reviewed the application and indicated there were no issues provided the applicant abides by the conditions of the permit. Staff has included a suggested condition of approval that the applicant abide by the Conditions on the Road & Bridge driveway permit and the that the new driveway permit be built to the standards in Section 7-107 of the Land Use and Development Code. The applicant has an existing driveway permit for Parcel C, the portion of the property that is currently developed. Road and Bridge reviewed the application and indicated no issues with the existing driveway access. The applicant supplied an engineering report for the existing driveway. The driveway is partially shared by three other single-family residences. The engineering report states that the shared portion of the driveway would fall into the Semi Primitive Roadway Standard. The report also states that Colorado River Fire Rescue reviewed the application and indicated no issues with the driveway. This representation was 8 supported by Colorado River Fire Rescue's Referral Comments, which indicated no issues with the proposed subdivision (Exhibit 10). The one issue identified by the engineering report was a damaged culvert that the applicant stated has been repaired. The report concludes: Based on the information above it is my professional opinion that the existing driveway is adequate as a shared access to the three parcels in its current condition. The driveway meets or exceeds the intended design standards of Table 7-107 and the only modifications or improvements necessary are those associated with the existing culvert as stated above. The applicant has since indicated that the culvert was repaired. The report and the existing conditions plan was reviewed by the Garfield County designated engineer who indicated no issues with access. After review by staff and the County designated engineer, it appears that the applicant meets required driveway standards. 8. Section 7-108: Natural Hazards The applicant responded to this section stating: The site is gently -sloping irrigated agricultural land in a broad valley floor and has not been identified as subject to any Natural and Geologic Hazards. The site is situated above and outside of the mapped floodplain and floodway, reference is FEMA FIRM Panel 1060. Garfield County hazard mapping indicates that the property is located in a possible high groundwater area. This could impact future septic permitting and whether an engineered system will ultimately be required. This issue is discussed further in Item 5 of this staff report. Garfield County floodplain mapping does not show this parcel in a floodplain. The proposal has been reviewed by the Colorado Geological Survey who indicated no issues with the proposed subdivision (Exhibit 8). 9. Section 7-109: Fire Protection The Application was referred to Colorado River Fire Rescue. Orrin Moon responded that he had no concerns with the proposed property split. Article 7, Division 2: General Resource Protection Standards 10. Section 7-201 Agricultural Lands The proposed Subdivision should not impact adjacent existing agricultural lands. Once subdivided, the applicant will be able to build a single-family residence on the new lot, development that is compatible with surrounding properties. The division of the existing 9 11.673 acre parcel into two, should still allow some agricultural activities to occur on both properties. The site plan submitted by the applicant showed a 24" irrigation ditch on the property. The applicant has since clarified this designation by stating (Exhibit 20): The property is served by its private underground irrigation pipeline which derives its source of irrigation water from its Rifle Canon Ditch diversion head gate located approx. 4,200 ft. north of the property and provides a gravity -feed supply to the hand -set irrigation sprinkler system. This underground irrigation pipeline system was constructed in 2005 and replaced the prior surface lateral system. An undivided one-half interest (50%) in the irrigation water rights and appurtenances will be dedicated to Amended Parcels C & D respectively. There are no Rifle Canon Ditch Company ditches, improvements or easements on the property. There are no downstream irrigation water users once the irrigation water leaves the property. The applicant has indicated that the Rifle Canon Ditch Company does not have any improvements or easements on the property. The applicant has represented that there are no downstream irrigation water users once the irrigation water leaves the property. This indicates that any irrigation water on the property is used in a lateral as discussed in Exhibit 20 and that the applicant is the final user of water for this lateral system. Staff does not anticipate the proposed subdivision having an impact on the lateral on the applicant's property. 11. Section 7-202 Wildlife Habitat Areas The proposed subdivision is located in an agricultural area and the existing parcel is already developed with an existing single-family home. The application was referred to Colorado Parks and Wildlife who did not supply a comment. Staff anticipates only minimal impact on wildlife. 12. Section 7-203 Protection of Waterbodies The Applicant has indicated that no waterbodies are located on the site. Staff has not identified any water bodies and the Land Use and Development Code does not consider irrigation ditches water bodies. It is staff's opinion that the application meets this standard. 13. Section 7-204 Drainage and Erosion The application provided topographic information and soil studies for the proposed subdivision. Additionally, they indicated that future construction would be designed to facilitate positive drainage. The application was reviewed by the Garfield County designated engineer who did not identify any issues. 10 14. Sections 7-205 Environmental Quality No water or air quality issues are anticipated from the proposed project. 15. Section 7-206 Wildfire Hazards The subject property is identified as either Not Rated, Low, or Moderate in the Community Wildfire Protection Plan — Wildland Fire Susceptibility Index. The property is relatively flat and there are no known fire chimneys. The application has been reviewed by Colorado River Fire Rescue who did not identify any issues with the application. It is staff's opinion that the wildfire danger on the property is within manageable levels and is consistent with Code requirements. 16. Section 7-207 Natural and Geologic Hazards As noted in Section 8 of this Staff Report, only High Groundwater was indicated as a possible geologic hazard. This issue is discussed further in Section 5 of this Report. The application was reviewed by the Colorado Geological Survey who did not identify any issues. 17. Section 7-208 Reclamation No disturbance that would require reclamation is anticipated as a result of the creation of the proposed subdivision. The applicant has represented the following with regards to Reclamation: All future development disturbance on Amended Parcel D associated with Single -Unit Dwelling, Accessory Building, driveway and utility construction shall receive appropriate Reclamation treatment including preservation of topsoil, contouring, revegetation and weed management. The application was reviewed by the Garfield County Vegetation Manager who indicated that there are several Russian -olive trees located on the property. Vegetation Management requested that the applicant provide a management plan that will address the removal and treatment of the trees. After referral comments were sent to the applicant, they have met with Vegetation Management and created a management plan to address removal of weeds on the site (Exhibit 18). Article 7, Division 3, Site Planning and Development Standards 18. Section 7-301 Compatible Design: The proposed Tots and use are generally compatible with surrounding residential and agricultural land uses. 11 19. Section 7-302 Off- Street Parking and Loading Standards: The Applicant has demonstrated through site plans and a statement, that adequate parking exists or will exist on the site. 20. Sections 7-303 Landscaping Standards: The Code specifically exempts single family dwelling units from Section 7-303. 21. Section 7-304 Lighting: All exterior lighting will need to be downcast and comply with County standards. 22. Section 7-305 Snow Storage Standards: Adequate snow storage exists on the property. 23. Section 7-306 Trail and Walkway Standards: No recreational or community facility access areas are proposed and as such a pedestrian connection is not feasible. Article 7, Division 4, Subdivision Standards and Design Specifications 24. Section 7-401 General Subdivision Standards The applicant has provided a shared well easement around the well head and associated well infrastructure. No other common facilities are needed. 25. Section 7-402 Subdivision Lots No issues with lot configuration pursuant to this section have been noted. 26. Section 7-403 Survey Monuments Compliance with these requirements will be confirmed through referral of the final draft of the plat to the County Surveyor's Office. Compliance with any referral comments, corrections, and/or edits required by the County Surveyor should be included as Conditions of approval. 27. Section 7-404 School Land Dedication The application shows that there is already an existing single-family residence on site. The proposed new lot will create the potential for an additional single-family dwelling - unit. The property is located in the RE -2 School District. Per Section 7-404 of the Land Use and Development Code, Staff has included a suggested condition of approval that 12 the applicant pay $200 for school impact fees. 28. Section 7-405 Road Impact Fees Road Impact Fees will be required at the time of building permit. Article 5, Division 3, Minor Subdivision Review 29. Section 5-301(C)(1): It complies with the requirements of the applicable zone district and this Code. As proposed, the subdivision complies with the Rural Zone District. 30. Section 5-301(C)(2): It is in general conformance with the Comprehensive Plan. See Section 2, above. 31. Section 5-301(C)(3): Shows satisfactory evidence of a legal, physical, adequate, and dependable water supply for each lot. See Section 4, above. 32. Section 5-301(C)(4): Satisfactory evidence of adequate and legal access has been provided. See Section 7, above. 33. Section 5-301(C)(5): Any necessary easements including, but not limited to, drainage, irrigation, utility, road, and water service have been obtained. The proposed final plat includes an easement for the water line and the well head. Irrigation easements have been included on the final plat. The applicant's wording on the plat states that the access easement is being adjusted, it is staff's opinion that the access easement that is recorded as Reception No. 506021 cannot be adjusted with the plat. Instead, to demonstrate the existing driveway is part of an easement, the applicant should indicate on the plat that an easement is now created for access to the other parcels in the exemption. The recorded easement will still exist. Staff has included a suggested condition of approval that the applicant revise the plat to reflect those changes. 34. Section 5-301(C)(6): The proposed Subdivision has the ability to provide an adequate sewage disposal system. See Section 5, above. 13 35. Section 5-301(C)(7): Hazards identified on the property such as, but not limited to, fire, flood, steep slopes, rockfall and poor soils, shall be mitigated, to the extent practicable. See Sections 5, 8 and 15, above. 36. Section 5-301(C)(8): Information on the estimated probable construction costs and proposed method of financing for roads, water distribution systems, collection systems, storm drainage facilities and other such utilities have been provided. All required infrastructure is already in place. 37. Section 5-301(C)(9): All taxes applicable to the land have been paid, as certified by the County Treasurer's Office. The Applicant will need to obtain the signature of the County Treasurer on the final plat indicating that taxes have been paid. This must be accomplished prior to the BOCC signing the plat. 38. Section 5-301(C)(10): All fees, including road impact and school land dedication fees, shall be paid. All road impact fees shall be collected at the time of building permit. School Land Dedication fees are discussed in Section 27 of this staff report 39. Section 5-301(C)(11): The Final Plat meets the requirements per section 5- 402.F., Final Plat. Staff suggests that the following corrections be made to the plat as a condition of approval. The plat shall include the name and address of mineral owners of record - All color shall be removed from the plat - The lot names shall be changed from Parcel C to Parcel C1 and Parcel D to Parcel C2 - Remove Building Setback lines - Remove the 24" Irrigation Ditch and the fence lines - The applicant shall remove the note that states, "Portion of platted access easement to be adjusted." - The applicant shall include a note indicating that the new access easement is for access to the other exemption parcels. - Remove ranch access and the proposed new access on Lot C2 - The applicant shall add plat notes A, B, C, D, E, F, H, and L from Section 3-01 of the County Resource Guide - Include a reference to the Mangurian Exemption Plat notes on the Final Plat The County Commissioners' Certificate shall be updated to match current form 14 Surveyor's Certificate shall be updated to match current form The Title Certificate shall be updated to match current form The Title of the Subdivision should read, "Minor Subdivision of Parcel C of the Mangurian Exemption, Situate in the Southwest '/4 Section 19, Township 5 South, Range 92 West, 6th P.M. SUGGESTED FINDINGS AND RECOMMENDATION Staff recommends a finding that, with the recommended conditions, the proposed Minor Subdivision is in conformance with the Comprehensive Plan of 2030 as well as the Land Use and Development Code. Staff, therefore, recommends approval with conditions of Wilde Minor Subdivision. Suggested Findings 1. That proper public notice was provided as required for the Administrative Review Land Use Change Permit. 2. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 3. That with the adoption of conditions the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended. Suggested Conditions of Approval Conditions Prior to Signature of the Plat 1. The Applicant has 90 days within which to satisfy applicable conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, County Commissioners, County Surveyor, Clerk and Recorder, Title, Taxes, Surveyor, and any lienholders. b. The following amendments shall be made to the plat prior to obtaining signatures on the plat. This updated plat shall be provided to, reviewed and accepted by the Community Development Department and the County Attorney's Office prior to creating a Mylar copy of the plat and obtaining any signatures. Prior to the BOCC signature on the plat the Applicant shall pay applicable school land dedication fees. Other Conditions 4. All representations of the applicant within the application be considered conditions of approval unless otherwise modified by the Board of County Commissioners. 5. Property owners shall comply with the issued Colorado Division of Water Resources well permit. 6. The applicant shall comply with all requirements of Garfield County Road and Bridge driveway permits. 16 7. The applicant shall obtain an Onsite Wastewater Treatment System (OWTS) permit from Garfield County at the time of building permit for Parcel C2. 8. The project address is 363 County Road 251, Rifle, CO, 81650. The proposed water supply will be from a shared well operating under an augmentation contract with West Divide Water Conservancy District. Estimates of water requirements for the lots were not provided, though a single family dwelling currently exists on Parcel C and a new single family dwelling is proposed for Parcel D. From the copy of a proposed well sharing agreement, irrigation uses shall be limited to not more than 12,500 square feet of lawn and garden on each parcel. The applicant intends to treat wastewater through on-site wastewater treatment systems on each lot. This office has a record of an existing well located on the 11.67 acres, operating under Permit No. 80938-F. Well Permit No. 80938-F was issued in 2017 to use an existing well that was constructed in 2009. The permit was approved in part, under the condition that the well is operated in accordance with the West Divide Water Conservancy District Augmentation Plan, West Divide Contract # R170420WW(a). The use of the well is limited to ordinary household purposes inside two single family dwellings, the irrigation of not more than 25,000 square feet of home gardens and lawns and the watering of twenty head of large domestic animals. The maximum pumping rate of the well shall not exceed 15 gallons per minute and the annual withdrawal of groundwater is limited to of 2.44 acre-feet. Section 37-92-602(3)(b)(III), C.R.S., requires that the cumulative effect of all wells in a subdivision be considered when evaluating material injury to decreed water rights. The source of the proposed water supply would be from, or tributary to, the Colorado River. This area of the Colorado River is over -appropriated; therefore, an augmentation plan is required to offset depletions caused by the pumping of any wells. The applicant has shown that the current water well permit has a water allotment contract with West Divide Water Conservancy District. From the water supply report by Colorado River Engineering, dated November 9, 2017, a four hour test was conducted on the well on March 27, 2017. During the test, the well was pumped for four hours at twelve gallons per minute. The consultant in the report indicated as the well yielded twelve gallons per minute and is shared between the two dwellings, that six gallons per minute is more than sufficient to meet the daily demands of each residence. However, due to specific irrigation practices or water fixtures, instantaneous demands may require additional capacity; therefore a 2,500 storage tank was installed in close proximity to the shared well. Should the well continue to produce in a similar manner, it should be adequate to provide water for permitted household purposes in the two single family dwellings. Please note that the long term adequacy of any ground water source may be subject to fluctuation due to hydrological and climatic trends. Based on the above, it is our opinion, pursuant to CRS 30-28-136(1)(h)(I), that the proposed water supply should be physically adequate and will not cause material injury to decreed water rights so long as the applicant operates the well in accordance with the terms of the augmentation plan and well permit. As the trees are the primary source of shade for grazing livestock on the property, Mr. Wilde requested that the county consider a gradual removal of the approximately 15 trees on the parcel to allow for the replanting of replacement trees. The property is served by its private underground irrigation pipeline which derives its source of irrigation water from its Rifle Canon Ditch diversion headgate located approx. 4,200 ft. north of the property and provides a gravity - feed supply to the hand -set irrigation sprinkler system. This underground irrigation pipeline system was constructed in 2005 and replaced the prior surface lateral system. An undivided one-half interest (50%) in the irrigation water rights and appurtenances will be dedicated to Amended Parcels C 8v D respectively. There are no Rifle Canon Ditch Company ditches, improvements or easements on the property. There are no downstream irrigation water users once the irrigation water leaves the property.
