HomeMy WebLinkAbout19.0 Director's Determination 01.25.2018Garfield County January 25, 2018 Michael Langhorne 136 East 3rd Street Rifle, CO, 81650 Reference: Administrative Review Minor Subdivision — William and Jayne Wilde — Wilde Minor Subdivision - Garfield County File Number MISA-08-17-8572 Dear Mr. Langhorne; This letter is provided to you, as the authorized representative for Garfield County File MISA-08-17-8572, pertaining to a Minor Subdivision of a parcel owned by William and Jayne Wilde with a Parcel ID of 212719300264. This letter serves as a notification that your request for a Minor Subdivision has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the request. The conditions of approval are as follows: Conditions Prior to Signature of the Plat 1. The Applicant has 90 days within which to satisfy applicable conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat mylar with signed Certificates that include Dedication and Ownership, County Commissioners, County Surveyor, Clerk and Recorder, Title, Taxes, Surveyor, and any lienholders. b. The following amendments shall be made to the plat prior to obtaining signatures on the plat. This updated plat shall be provided to, reviewed and accepted by the Community Development Department and the County Attorney's Office prior to creating a Mylar copy of the plat and obtaining any signatures. Additional changes or modifications may be required by this additional review. 1 • The plat shall include the name and address of mineral owners of record • All color shall be removed from the plat • The lot names shall be changed from Parcel C to Parcel C1 and Parcel D to Parcel C2 • Remove Building Setback lines • Remove the 24" Irrigation Ditch and the fence lines ■ The applicant shall remove the note that states, "Portion of platted access easement to be adjusted." • The applicant shall include a note indicating that the new access easement is for access to the other exemption parcels. ■ Remove ranch access and the proposed new access on Lot C2 • The applicant shall add plat notes A, B, C, D, E, F, H, and L from Section 3-01 of the County Resource Guide ■ Include a reference to the Mangurian Exemption Plat notes on the Final Plat • The County Commissioners' Certificate shall be updated to match current form ■ Surveyor's Certificate shall be updated to match current form ■ The Title Certificate shall be updated to match current form • The Title of the Subdivision should read, "Minor Subdivision of Parcel C of the Mangurian Exemption, Situate in the Southwest 1/4 Section 19, Township 5 South, Range 92 West, 6th P.M. County of Garfield, State of Colorado and include a reference to the recorded plat number." c. Recording Fees. 2. Prior to the BOCC signature on the Plat, the Applicant shall update the well sharing agreement to reflect the updated information on the plat including, but not limited to the updated Lot names. Compliance with this condition shall be reviewed and accepted by the Garfield County Community Development Department and the County Attorney's Office. 3. Prior to the BOCC signature on the plat the Applicant shall pay applicable school land dedication fees. Other Conditions 4. All representations of the applicant within the application be considered conditions of approval unless otherwise modified by the Board of County Commissioners. 5. Property owners shall comply with the issued Colorado Division of Water Resources well permit. 2 6. The applicant shall comply with all requirements of Garfield County Road and Bridge driveway permits. 7. The applicant shall obtain an Onsite Wastewater Treatment System (OWTS) permit from Garfield County at the time of building permit for Parcel C2. 8. The driveway for Parcel C2 shall be built to, at a minimum, the standards described in Table 7-107 of the Land Use and Development Code. Notice of this decision will be provided to the Board of County Commissioners who have the ability to `call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period.
