HomeMy WebLinkAbout7.0 Extension Request 12.07.2000• • Memo To: Board of County Commissioners From: Garfield County Planning Department Subject: Van Hoose/Timber Gulch Subdivision Exemption Date: December 7, 2000 Matthew and Bonnie Van Hoose are requesting a one year extension of the last extension, approved by the Board in June. The last extension took the application to 12/13/00. This takes the application to one year, which has been the limit in the past. Staff believes that the Board has, under unusual extenuating circumstances approved extensions beyond one year. This is a discretionary decision, since the regulatory requirement of 120 days in Section 8:33 of the Subdivision Regulations are extended fairly regularly. I am submitting to you herewith a copy of a letter from legal counsel for West Divide Water Conservancy District confirming that it is anticipated that augmentation water will be available in late calendar year 2001. In light of this information, my clients Donald Van Hoose and Matthew Van Hoose request an extension of twelve months, continuing the date for final exemption plat approval to December 5, 2001. Would you please present this request to the County Commissioners at your earliest convenience and advise whether or not it is necessary for my client or me to be present when the request is considered? West Divide is currently in the process of creating and obtaining approval for a Substitute Water Supply Plan. We expect an application for Substitute Supply Plan will be submitted to the State Engineer's Office within the next two months and hope to have approval of the Substitute Supply Plan no later than Summer or Fall of 2001. Once the Substitute Supply Plan is in place, West Divide will be in a position to contract for augmentation water from Alsbury Reservoir.
