WHEREAS, VALLEY FARMS, INC. has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30-28-
101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17
(d) and 3.02.01, for the division of a 1,487 acre tract of land into two tracts
of 2.25 and 1,484.75 acres, more or less, with said 2.25 acre tract more
particularly described as follows:
Parcel A
A parcel of land situated in Lots 7 and 8 of Section 12,
Township 6 South, Range 92 West of the Sixth Principal
Meridian, lying Easterly of the center of Divide Creek
and Westerly of the Westerly right-of-way fence of a
County Road as constructed and in place, said parcel of
land is described as follows:
Beginning at a point in said road right-of-way fence
whence the East Quarter Corner of Section 14 in said
township and range bears: S. 16° 25' 42" W. 4547.15
feet; thence N. 69° 31' 08" W. 62.77 feet along a fence
as constructed and in place; thence S. 49° 06' 08" W.
212.00 feet along said fenc� to a point in the center
of said creek; thence N. 00 53' 32" E. 275.80 feet along
the center of said creek; thence N. 23° 31' 02" W. 195.51
feet along the center of said creek; thence S. 750 58'
00" E. 206.30 feet to a point in said road right-of-way
fence; thence S. 170 49' 09" E. 302.70 feet along said
road right-of-way fence to the point of beginning.
The above described parcel of land contains 1.46 acres,
more or less.
Parcel B
A parcel of land situated in Lot 8 of Section 12,
Township 6 South, Range 92 West of the Sixth Principal
Meridian, lying Southerly and Westerly of a County Road
right-of-way fence and Easterly of the center of Divide
Creek, said parcel of land is described as follows:
Beginning at a point in said road right-of-way fence
whence the West Quarter Corner of Section 14 in said
township and range bears: S. 17° 49' 09" E. 302.70
feet and S. 16° 26' 42" W. 4547.15 feet; thence N. 75°
58' 00" W. 206.30 flet to a point in the center of said
creek; thence N. 23 31' 02" W. 230.94 feet along the
center of said creek to a point in said road right-of-
way fence; thence S. 76° 05' 13" E. 32.39 feet along
said road right-of-way fence; thence S. 620 11' 12" E.
243.99 feet along said road right-of-way fence; thence
S. 170 49' 09" E. 147.22 feet along said road right-
of-way fence to the point of beginning.
The above described parcel of land contains 0.79 acres,
more or less.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County that the said 2.25 acre tract currently
is developed with a single-family residence; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that said 2.25 acres receives
its domestic water from a spring on an adjoining tract of land for which
easements will be obtained, that there is adequate ingress and egress to said
tracts, that a septic tank and leach field has already been constructed on the
tract, that the requested division is in accordance with the general purposes
and intent of the Subdivision Regulations of the State of Colorado and the County
of Garfield and should, therefore, be exempted from the definition of the terms
"subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-
101 (10) (a) - (d) as amended; ,/
NOW THEREFORE, upon motion of Aar rc./ l/e/ \S9 Z seconded by
r/c4i.leAl C=eKL-,� and carried, said 1,487 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by division
into two tracts of 2.25 acres and 1,484.75 acres, more or less, all as is more
fully described above and further that this exemption is conditioned upon the
granting of easements for the purpose of supplying domestic water to the 2.25
acre tract from the neighboring tract of land. A copy of the instrument(s) of
conveyance when recorded shall be filed with this Resolution.
