Commissioners for Garfield County, Colorado, held at the
Commissioners' Meeting Room at the Garfield County Courthouse in
Glenwood Springs on the 1'1th day of May A.D. 1990 ,

when the following proceedings, among others were had and done,
to -wit:
RESOLUTION NO. 90-017
A RESOLUTION CONCERNED WITH GRANTING AN AMENDMENT TO AN EXEMPTION
FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR MATTHEW AND
VONNIE VAN HOOSE BY RESOLUTION NO. 85-197.
WHEREAS, Matthew and Vonnie Van Hoose petitioned the Board of.
County Commissioners of Garfield County, Colorado, for an exemption
from the definition of the terms "subdivision" and "subdivided
land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted
April 23, 1984, Section 8:00 through 8:60 and for the division of
a 39.32 acre tract as described in Book 626, Page 96 and 97, as
filed in the Office of the Clerk and Recorder of Garfield County,
Colorado into two tracts of approximately 19.663 acres each, more
or less, and
WHEREAS, the Petitioners demonstrated to the satisfaction of
the Board of County Commissioners of Garfield County, Colorado,
that the proposed division does not fall within the purposes of
Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as
amended, for the reason that the division did not warrant further
subdivision review, and
WHEREAS, the Petitioners have requested that the proposed be
modified to create two tracts as they are more particularly
described as follows:
TRACT A - See attached legal description for Parcel A.
TRACT B - See attached legal description for Parcel B.
(in the State of Colorado and County of Garfield); and
NOW THEREFORE, BE IT RESOLVED by the Commissioners of Garfield
County, Colorado that the division of the above described tracts
"A" and "B" from the above described 39.32 acre tract is hereby
exempted from such definitions and said tract may be divided into
said tracts "A" and "B" and may be conveyed in the form of such
tracts "A" and "B" all as is more fully described above; however,
this exemption is granted on the condition and with the expressed
understanding and agreement of the petitioner that no further
exemption be allowed on said tracts "A" and "B" and that a copy of
the instrument or instruments of conveyance when recorded shall be
filed with this Resolution.

A parcel of land situate in the N 1/2 SE 1/4 and the SE 1/4 SE 1/4,

Township 5 South, Range 90 West of the Sixth Principal Meridian all in
the County of Garfield, State of Colorado, lying easterly' of the
easterly right-of-way line of a County Road as constructed and in place
and westerly of the easterly line of said Lot 4 moreparticularly
