HomeMy WebLinkAboutAmended Floodplain PermitAMENDED FLOODPLAIN SPECIAL USE PERMIT for A Parcel of Land Owned by Rudd LLC and CCC -B LLLP containing approximately 63.1 acres located in Section 18, Township 7 South, Range 88 West of the 6th P. M., at 62 County Road 113, Carbondale CO, approximately 4 miles north of the Town of Carbondale and more fully described in Exhibit "A" (File No. SUAA-04-19-8725) (Assessor's Parcel Nos. 2393-181-00-358 and 2393-181-00-359) In accordance with and pursuant to provisions of the Garfield County Land Use and Development Code, the Special Use Permit originally approved by Resolution No. 99-14 is amended by Director's Decision, dated June 28, 2019 and hereby authorizes by an Amended Special Use Permit the following activity: Dredge and fill of an area in the regulated floodplain of Cattle Creek (with the clarification that the original Resolution No. 99-14 set forth conditions or requirements for new construction or substantial improvements that must be met to obtain a building permit in the fill area. Future building permits may be issued in accordance with the conditions of approval and the amended site plan attached as Exhibit `B'). The Amended Special Use Permit is issued subject to the conditions set forth in the above-mentioned resolution No. 99-14 and in Exhibit "C", and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Land Use and Development Code, as amended, Building Code, and other regulations of the Board of County Commissioners of Garfield County, Colorado. All previous conditions of approval contained in Resolution No. 99-14 shall remain in effect and the Applicant shall comply with the comments contained in the referral letter from the County's Consulting Engineer, Michael Erion, Resource Engineering dated June 27, 2019. 2. That the Applicant shall provide as -built elevation certificates for all existing and proposed structures to confirm compliance with the elevation requirements set forth in Resolution No. 99-14. 3. That all representation of the Applicant including those contained in the Application Submittals, Engineering Reports, and Supplements shall be conditions of approval unless modified herein, including the representation that the Applicant is in the process of initiating a Letter of Map Revision (LOMR) with FEMA for the property and will submit the LOMR Application no later than December 31, 2019 and shall complete the LOMR, subject to FEMA scheduling and timelines. 6
