This well shall be used in such a way as to cause
no material injury to existing water rights. The
issuance of the permit does not assure the applicant
that no injury will occur to another vested water
right or preclude another owner of a vested water
right from seeking relief in a civil court action.

indicating whhe parcel of land on which the well will be locaLed
was established, or the date that the subdivision was approved by the
county commissioners. The required information may possibly be
determined from county documents approving this subdivision.
If the property has been exempted from the subdivision regulations, a
copy of the resolution granting this exemption, as well as a survey
plat showing the exempted tract and any other agreements executed with
the county, should be submitted with the permit application.

This is to acknowledge receipt of material pertaining to the above
referenced exemption application. In checking our records, we find that
Mr. Veltus, the owner, already has a domestic well on the property (regis-
tration no. 66856, adjudication no. W-2462). The well was permitted as
the only well on a tract of land of 35 acres or more and can legally serve
up to three single family dwellings and irrigate up to one acre of lawn or
garden.
Due to this, it is doubtful that any additional well permits could
be issued for this property. We suggest that the owner contact our Ground
Water Section concerning issuance of additional wells. Until this matter
is resolved, we cannot recommend approval of the Veltus Exemption.
