RESOLUTION CONCERED WITH GRANTING AN EXEMPTION
FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS
FOR ROBERT VELTUS
WHEREAS, Robert Veltus has petitioned the Board of County Commissioneers
of Garfield County, Colorado, for an exemption from the definition of the terms
"subdivision" and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d),
as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted
January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 32.86
acre tract described as follows:
Described in Book X6446, page 318 in the office of Clerk and
Recorder of Garfield County, Colorado.
into 3 tracts of approximately 14.02, 11.652, and 7.193 acres each, more or
less, which proposed divided tracts are more particularly described as follows:
Parcel 1, A tract of land situated in the NE 4 of the NE 4 of the
NW 4 of Section 34 and in the N1 of the SE4 of the NE4 of the NWT,
of Section 34, Both in Township 6 south, Range 88 West of the 6 P.M.
being more particularly described as follows:
Beginning at the North Quarter Corner of said Section 34, also being
the Northeast corner of said NE4 NE4 NW% of Section 34; thence N 89°
10'47"W. 659.94 feet along the North line of said NE' NE4 NW% of
Section 34 to the Northwest corner of said NE4 NE4 NW4 of Section 34,
thence S 00°48'27"E 612.67 feet along the West line of said NE1 NE4
NW4 of Section 34 to the Southwest corner of said NEA NE4 NW,: of
Section 34, also being the Northwest corner of said N SE ; NEA NW'

being more particularly described as follows:
Beginning at the Northwest Corner of said NW4 NE4 NW% of Section 34,
thence S 00°00'29"W 615.50 feet along the West line of said NW4 NE4
NW4 of Section 34 to the Southwest Corner of said NW% NE4 NW1; of
Section 34 also being the Northwest Corner of said SW4 NE' NW4 of
Section 34; thence S 00°00'29"W 150.50 feet along the West line of
said Std4 NE4 NW4 of Section 34; thence W 89°42'05"E 670.59 feet to
a point on the East line of said SW4 NE4 NW4 of Section 34: thence

NW4 of Section 34, Township 6 South, Range 88 West of
being more particularly described as follows:
Beginning at the Southeast corner of said SW4 NE4 NErk of Section 34;
thence N 89°42'05"W 677.21 feet along the South line of said SW4
NE 4 NWS of Section 34 to the Southwest Corner of said SWk NE k NWS
of Section 34; thence N 00°00'29"E 465.00 feet along the West Line of
said SW4 NE4 NW4 of Section 34; thence S 89042'05"E 670.59 feet to
a point on the East Line of said SW4 NE4 Nw4 of Section 34; thence S
00°48'27"E 465.08 feet along said East Line of the SW4 NE4 NW4 of Sec
tion 34 to the point of beginning, containing 7.193 acres more or
less. (in the State of Colorado and County of Garfield); and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
County Commissioners of Garfield County, Colorado, that the proposed
ivision does not fall within the purposes of Part 1, Article 28, Title 30,
olorado Revised Statutes 1973, as amended, for the reason that the impact
reated does not warrant a full subdivision review; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
oard of County Commissioners of Garfield County, Colorado, that there is a
easonable probability of locating domestic water on each of said tracts, that
here is adequate ingress and egress to said tracts, that the location of septic
anks will be permitted by the Colorado Department of Health, that the requested
ivision is not part of an existing or larger development and does not fall with
in the general purposes and intent of the subdivision regulations of the State
of Colorado and the County of Garfield, and should, therefore, be exempted from
definition of the terms "subdivision" and "subdivided land" as set forth in
C.R.S. 1973, 30-28-101 (10) (a) - (d), as amended;
NOW, THEREFORE, BE IT RESOLVED that the division of the above described
tracts "A", "B", and "C", from the above described 32.86 acre tract is hereby
exempted from such definitions and said tract may be divided into tracts "A",
"B" and "C", all as is more fully described above, and said divided tract may
be conveyed in the form of such smaller tracts without further compliance with
the aforsaid subdivision statutes and regulations; provided, however, that this
exemption is granted on the condition and with the express understanding and
agreement of the Petitioners that no further exemptions be allowed on said tracts
"A", "B" and "C", and that a copy of the instrument or instruments of convey-
ance when recorded shall be filed with this Resolution.
