BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101(10)(a) - (d) as amended,
and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and
3.02.01, the undersigned Robert W. Veltus
respectfully petitions the Board of County Commissioners of Garfield
County, Colorado, to exempt by resolution 5 acres from the NEy4NW} of
Section 34, Tp. 6 s., R. 88 W., 6th P.M.
more fully hereinafter described, from the definitions of "subdivision"
and "subdivision land" as the terms are used and defined in C.R.S. (1973)
Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below:
My intentions are to re -locate a log home which I own in Glenwood Springs
onto this property. This will allow me to put my Glenwood Springs
property, which is zoned commercial, to it's highest and best use.
I have an excellent adjudicated water well on the NE31NW'A of Section 34.
It is my intention to serve the log residence, which I put on the five
acres, from this water well.

Dear Mr. Witkowski:
I request a Senate Bill 35 exemption for a five acre tract of land
which I own in the NE'/4NW36 of Section 34, Tp. 6 S., R. 88 W., 6th P.M.,
Garfield County. For your reference I have a Garfield County Map with
this area located in red.
My intentions are to re -locate a log home which I own in Glenwood
Springs onto this property. This will allow me to put my Glenwood
Springs property, which is zoned commercial ,to it's highest and
best use.
I have an excellent adjudicated water well on the NE/4NW/4 of Section 34.
It is my intentions to serve the log residence, which I put on this
five acres, from this water well.
I respectively request the approval of this matter.

And the Referee having made the investigations required by
Article 92 of Chapter 37, C.R.S. 1973, does hereby make the
following ruling, to -wit:
This application was referred to the Water Referee of
Water Division No. 5 on the 6th day of November , 197 4

2. The name of the structure is Veltus Well No. 1.
3. The Legal description of the structure is: The well is located
in the NE4NW4 of Section 34, T. 6 S., R. 88 W. of the 6th P.M. at
a point 831 feet South of the North line and 1720 feet East of
the West line of said Settion 34.
4. The depth of the well is 150 feet.
5. The date of the initiation of the appropriation is
May 23, 1973.
6. The amount of water claimed is 0.033 cubic foot per second
of time.
7. The use of the water is household purposes, fire protection,
livestock waterlawn and garden irrigation,
8. The State Engineer's number is 66856.
9. The priority date is May 23, 1973
10.The date of the application was October 22, 1974.
It is the ruling of the Referee that the statements in the
application are true and that the above described water right is
approved.
The above described underground water right meets the
criteria for an exempt domestic well pursuant to C.R.S. 1973,
37-92-602(1)(b) and 37-92-602(3)(b)III), so long as it is used
for the purposes set forth herein.
It is accordingly ORDERED that this ruling shall become
effective upon filing with the Water Clerk, subject to Judicial
review as provided by law.
