Garfield County May 7, 2019 Martha Pickett 59 River's Bend Carbondale, CO 81623 DIRECTOR DETERMINATION — Aspen Glen Lots Filing No.1 Lots C-6 & C-7 Amended Final Plat (FPAA-03-19-8720) Dear Ms. Pickett, This letter is provided to you, as the authorized representative for Garfield County File FPAA-03- 19-8720 pertaining to an Amended Final Plat to merge lots C-6 and C-7 of the Aspen Glen Subdivision, amend the existing building envelope on Lot C-6 and vacate the building envelope on Lot C-7. This letter is notification that your request to amend the final plat has been reviewed by the Community Development Department and the Director hereby issues a determination conditionally approving the request. The conditions of approval are as follows: 1. All representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. The proposed plat shall be updated and edited as follows prior to submittal for final review by the County: a. Change plat title to "Amended Final Plat of Lots C-6 and C-7 Aspen Glen" b. Assign a new lot identifier (for example, "C -6A") to the newly merged lot. This should be shown in the title description, combined legal description and plat. c. Change combined legal description title to "Amended Lot C -6A (or lot identifier of choice) Described As". Indicate that this new description is for the lots formally known as C-6 and C-7. d. Change "Line to be vacated by this plat" to "Lot line vacated by this plat" and "Building envelope to be vacated" to "Building envelope vacated by this plat". 1 e. A plat note shall be added affirming that all plat notes from the original plat referenced shall remain in effect. 3. The Plat shall be subject to final review and approval by County Staff, including Garfield County Attorney's Office and Garfield County Surveyor, prior to submittal of the Mylar plat for final execution, BOCC signature and recording. 4. The Applicant has 90 days within which to satisfy conditions of approval and provide the following documentation for BOCC signature and recordation: a. A plat Mylar with signed Certificates that include Dedication, Ownership, Title, Taxes, Applicant's Surveyor, Lienholders and any mortgagees. b. Recording fees. Notice of this decision will be provided to the Board of County Commissioners who has the ability to 'call-up' the application for review at a public hearing. You will be notified of the Board decision once it is received or upon expiration of the 10 day notice period (May 17, 2019).
