Today, I visited with Jean Doremus, 8n attomey representing Mark Von Hagke, regarding Mr'
Von Hagke's sub-division proposal for his property located oll county road 112 in Missouri
Heights.-As I understand ii, the proposal calls for the existing 35 acres to be split into two
p*it. with a single family houie io be constructed on each parcel. The property does lie
within the boundaries of the Carbondale & Rural Fire Protection District and the District will
provide fire protectiOn and emergency medical services to the property.
Aooess to the prope4y is via county road ll2 and all future driveways should be constructed
according to the Garflreld County road specifications,
Water supply for frro proteotion will be provided by the water carried on the {ire trucks which
is approximately 70OO gallons, augmented by the fire departrnent's tanker truck shuttle
operetion for extended fife operations,
Response time to the property is approximatety l0-15 minutes with initial response coming
out of the new Missouri ileights fire station and back-up response coming out of the
Carbondde fire station.
The Colorado State Forest Service guidelines for fire protection in the rural areas should be
followed when developing the parcils. This pamphlet is available from the fire department or
the CSFS.

you have asked for my opinion as to the use of the Kelley WelI
for two single family residences to be located on a 40 acre parcel
which would subsegulntly be subdivided into two single family
parcels. The subjLct parcel is known as Parcel L of the Hardy
ilif f = Subdivision.- rhLre are also Parcels 2 and 3 which have
single family residential uses associated with them.
The KeIIey WeIl received WeII Permit No. L531-54, a copy 9fwhich is attaclred, which designated the well to be the only weII
located on Lot 1 of the Hardy HilIs Subdivisioni the uses
specificaffy aefineated in the permit are for ordinary household
pirrposes in-siae no more than three single family dwellings, the
irrigation of not more than L acre of home lawns and gardens al$
the iatering of domestic animals. The permitted yietd of the well
is l-5 gprn with an annual appropriation of 3 acre feet per yea-r.
The wefl permit is for a weII exempt from administration under the
provisionl of C.R.S. 37-92-602(1)(b). Nevertheless, Peter Kelley-obtained a water right in Case No. 88CW387 for the exempt we1I.
Again, within this -decree the allowed uses of the weII are for
three single family dwellings; and a priority date of September 27,
1988 $ras awarded tor the well pursuant to C.R.S. 37-92-602(4).
provided the well has been dritled within 2OO' of its perrnitted and
decreed location, Do further permitting would be reguired to
connect a second single family dwelling on to the well. If
however, the well is located further than 2OO' from its decreed and
perrnitted location and a subdivision of the property is undertaken,
one would have a situation in which they had a tract of land of
less than 35 acres and you would have to obtain a repermitting of
the weII with a combining of parcels, if they are under comnon
ownership this should not be a problem. However, we render our
opinions based upon the assumption that the welI j-s located within
}QO,, of its permitted and decreed location.
Finally, there was a concern with respect to the existence of
a pernit foi'tfre Hardy Hills WeIl. If that well had designated Lot

L as an area to be served then there would have been a rrdouble
countingtt of the acreage making the Kelley Well suspect. However,I have reviewed the permit for this well (Permit No. 28238) andfind no acreage being specified since the weII permit was on the
old forms utilized in the 1960's. Therefore, I do not see a
problem with the use of the Kelley Well for two single fanily
residences. The Hardy Hil1s WeIl was similarly decreed in Case No.
8OCW254 and the decree again does not mention specific acreage to
be served. Accordingly, Mr. and Mrs. von Hagke should be able toutilize the Kelley WelI for two single farnily residences to be
located on Lot l- as such may be resubdivided.

enc(trtntered in the profile horings consist of silty clay and sandy clay with varying gravel

was ctlcoulttcrcd in Boring -5. Grourtdwater was not encoutnercd in the borings at the tinre of

Dear Mark,
Today, I visited with Jean Doremus, an attorney representing Mark Von Hagke, regarding Mr.
Von Hagke's sub-division proposal for his property located on county road 112 in Missouri
Heights. As I understand it, the proposal calls for the existing 35 acres to be split into two
parcels with a single family house to be constructed on each parcel. The property does lie
within the boundaries of the Carbondale & Rural Fire Protection District and the District will
provide fire protection and emergency medical services to the property.
Access to the property is via county road I 12 and all future driveways should be constructed
according to the Garfield County road specifications.
Water supply for fire protection will be provided by the water carried on the fire trucks which
is approximately 7000 gallons, augmented by the fire department's tanker truck shuttle
operation for extended fire operations.
Response time to the property is approximately 10-15 minutes with initial response coming
out of the new Missouri Heights fire station and back-up response coming out of the
Carbondale fi re station.
The Colorado State Forest Service guidelines for fire protection in the rural areas should be
followed when developing the parcels. This pamphlet is available from the fire department or
the CSFS.

I wish to express my view on the proposed Hardy Hills subdivision
exempti on.
Following are some facts to be considered.
The only aecess to this property ix over an easement across the South
boundary of my property, [he variance wi]-L certainLy have an impact
on my land. First of all the inereased traffic on this easement will
be a noisy nuisance that w111 adversely effect the value of my pro-
perty.
At the time we agreed to the easement there was only one parceL ofproperty involved. Since then it has been divided into three parcels.
Now it is proposed to further subdiv6d this property. this wil-l mean
aceess to 4 homes.
The road over the easement invoLves driving up a very steep hiLl. I
have seen occasions, after heavy snow, vrhen this road is impassable
even by a snow p1ow. There is no parking area so the present residents
have to park, sometimes, on the County road. This wouLd be intolerablewith 4 homes. There could also be times when there would be no accessfor emergency vehicles.
Water js .always a serious eonsideration in our area. The t{issouri Heights D*{Ditch re thrbugh orelose to, much of the property involved. &iany of
our wells are augmented by seepage from this ditch. In tirnes of drought
and during winter months, when the ditch is dry, marginal wells are introuble.
fn the past year, 5 new wells, that I knolv of, have been drilIed withina *, of a mile of my wel1. Two of the five wel}s are within 200 yds. ofof my we1I. I am eonu*ed that al] of our wel]s are already impaired.
