WHEREAS, Va11ey Vierv Associates has pet"itioned the Board of County
Commissioners of Garfjeld County, Colorado, for an exemption from the
definition of the terms "subdivision" and "subdivided land" under C.R.S.
.1973, 30-28-l0t (.|0) (a)-(d) as amended, and the Subdiv'ision Regulations
of Garfi el d County. Col oraclq:, adopted Janu;;r'y ?, 1g7g, Section s 2.02.21
(d) and 3.02.0'| for r.hs ciivjsion of a 3.4 acre tract into two (2) tracts
of approximately 0..I7 acre and 3.23 acres more or less, which 0.'l7 acre
tract is more particularly descrfbed as follows:
A tract of land situate in Lot 4, section 5, Township 6 south,
Range 89 l^lest of the 6th Pgincipal t'leridian beins more parti-
cularly described as folIows:
Beginning at a point whence a brass cap for the Southeast corner
of Section 34, iovrnship 5 Soulh, Range 89 l'lest of the 6th
Principal Meridian bears N 08u 36', 27" W 794.37 feet with alI
bearings conta'ined herein being relative to a bearing oI ry 890
50' E 6n the South I ine of sa'id Section 34; thence S 850 37'
40" 1n1 71.71 feet; thence N 0lo 44' 00" E 109.00 feet; thence
s-ogo oz; 4.l" E 8g.52 feet; thence s 02o 06' 00" E 62.26 feet;
thence S 630 .I3, 34" W 18..l2 feet to the point of beginn'ing,
containing 7518 souare feet more or less, in the State of
Coiorado and County of Garfreld; and
I.IHEREAS, the Petitioner has demonstrated to the satisfaction of the
3oard of County Conrmissioners of Garfield County, Colorado, that there is
a reasonable probability of providing domestic water and sewer service to
each of said tracts, that there is adequate ingress and egress to said tracts,
that the requested division is in accordance with the general purposes and
intent of the Subdivis'!on Regulations of the State of Colorado and the
County of Garfieid, and should, therefore, be exempted from the definition
of the terms "subdivision" and "subdivided land" as set forth in C.R.S.
I973, 30-28-10l (l0) (a)-(d) as anended;
N0W, THEREF0RE, upon the motion e1 Larry Velasquez
seconded by Dick Jolley , and carried, said 3.4 acre tract
of land is herehy exempted from such definit'ions and said tract nray be
divided into two (2) tracts of 0.17 acre and 3.23 acres, more or lesso all
as is more fully described above, and said divided tract may be conveyed
in the form of such smaller tracts without further compliance with the
aforesaid subdivision statutes and regulations; provided, however, that
said exemption is conditioned on the Petitioner obtaining a proper legal
,
description of said tracts prior to any conveyance thereof. Further, this
exemption is granted on the condition and with the express understanding
and agreement of the Petitioner that no further exemptions be al'lowed on
said tracts and that an air space survey be recorded with the County prior
to the change of ownership of any condominium unit.
A copy pf the instrument or instruments of conveyance when recorded shajl
be filed with this Resolution.
