Re: Van Every Exemption
Dear Mr. Baldwin:
We have reviewed the above referenced application for exemption.
The wells proposed as the water supply would intercept ground water which
is tributary to Divide Creek, an over-appropriated stream. Since new wells
would increase the injury to senior vested water rights, well permits cannot
be issued by this office and we cannot recommend approval of the Van Every
Exemption as proposed.
