PETITION FOR A},IENDMENT TO E)GMPTION
Pursuant to C.R.S. (L973) Section 30-28-f01 (10) (a) - (d)
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September l, L972, and amended April L4, L975,
Sections L.O2.l7 (d) and 3 .02,OL, the undersigned Adriana
Van Leeuwen respectfully petitioned the Board of County
Commissioners of Garfield County, Colorado, which granted to
exempt by its resolution three (3) parcels, oo less than two
(2) acres each. The petitioner is presently requesting that
the board consider the following amendment to that exemption
Resolution No. 78-L25 recorded Dec 13, L979, Doc 1f300184 Bk540
pages 6(l l, dod, 6oy, ancl o/u.
A. Please allow parcel rrcrr or lot (2) survey attached hereto
for four acres to be acceptable rather than two acres as called
for under the previous resolution B. Please allow Parcel "D"
or lot (3) survey attached hereto to become part of the 131
acres or parcel trArr and a1low petitioner to survey out approximately
two acres west of parcel 'rBrr along county road 226. for the
reasons stated be,trow:
A. Purchaser is requesting four acres rather than the two.
B. This property has been purchased by Witliam Mahoney and he
forsees possible problems in irregation due to being higher than
the canal. Furthermore, Elmer Roberts wishes to obtain approximately
52 acres of the 131 acres and wants the high hill to commence his
irregation. Thus, seeing that the parcel is beneficial to agri-
culture and Mr. Mahoney would be more satisfied with land which
would include an easment for the cana1, I respectfully request
your consideration.

It is understood that no parcel shall contain less than two (2)
acres.
STATEMENT AS TO METHOD OF' SEWAGE DISPOSAL
Individual septic systems shal1 have to be installed by the indi-

in the area are favorable and adjacent property owners have indi-

WHEREAS, Adniana Vanleeuwen has petitioned the Boand of
County Commissionens of C,anfiel-d County, Colonado, fon an
exemption fncm the definition of the terms "subdivisiontt and
I'subdivided landt' as unden C.R.S. 1973, 30-28-101 (I0) (a)-(d)
as amended, and the Subdivision Regulations of Gar:fie1d County,
Colonado, adopted Septemben L, L972 and amended Apnil 14' 1975,
Sections 1.02.17 (d) and 3.02.01 fon the division of a L37
acre tract into one tract of app:roxinately 131 acres (hereinaften
tract tttrtt) and three (3) tracts of approximately 2.0 acnes each
(heneinafter tractsItBrr,ttCrr, and itDtt), more or less, and said

of the Board of County Commissioners of Garfield County, Colorado,

WHEREAS, the Petitioner has demonstrated to the satisfaction of
the Board of County Conrmissioners of Ganfield County, Coloradorthat
there is a reasonable probability of locating donrestic water on each
of said tracts, that there is adequate ingress and egress to said
tracts, ttEt the lbcation of septic tanks wiLl be penmitted by the
Colorado Depa:'tment of Healtho that the reguested division is in
accordance with the general- punposes and intent of the Subdivision
Regulations of the State of CoLonado and the County of C,arfield, and
should, thenefone, be exempted from the definition of the telrns
"subdivision" and "subdivided landrr as set forth in C.R.S. 1973,
Boort 54O PAcE86830-28-101 (10) (a)-(d) as amended;
NOW, THEREFORE, upon the nrotion of Flaven J. Cenise, seconded
by Richard C. Jolley, and car"ried, said 137 acre tract of l-and is
hereby exempted from such definitions and said tract may be divided
into one (l) tnact of 131 acres and three (3) tracts of 2.b ,"o."
each, more or less, al-l as is mo::e fully described above, and said
divided tnact may be conveyed in the forrn of such smalle:: tracts
without fu::then compliance with the aforesaid subdivision statutes
and negulations; pnovided, howeven, that said exemption is conditioned
on the Petitioner obtaining a proper 1egal descr"iption of said traets
