WHEREAS, Adriana Vanleeuwen has Petitioned the Board of
County Commissioners of Garfield County, Colorado, fon an
exemption fnom the definition of the terms "subdivisionu and
"subdivided land" as urder c.R.s. 1973, 30-28-101 (rO) (a)-(d)
as amended, and the Subdivision Regulations of Ganfield County,
colorado, adopted sepu;emben l, Lg72 and amended Apnil 14' 1975,
Sections L.O2.l7 (d) and 3.02.01 fon the division of a 137
acre tract into one tnact of approximately 131 acnes (hereinafter
tract,,A,,) and. three (3) tracts of appncxirnately 2.0 acnes each
(heneinafter tragts ttBrt, ttcrr, andttDtt), more oI1 leSS, and said
137 acre tract is npre particular:Iy descnibed as follows:

WHEREAS, the Petitionen has demonstnated to the satisfaction
of the Boand of County Commissioners of Garfield County, Colorado,
that she desires said exemption for the Purpose of resale of said
tnacts rrBrr, rrctr and ilD'r into single-family residential acreage, andl
WHEREAS, the Petitionen has demonstrated to the satisfaction of
the Boand of county conmissioners of Ganfield county, coloradorthat
there is a neasonable pnobability of locating domestic waten on each
of said tracts, that there is adequate ingTess and egress to said
tracts, that the lbcation of septic tanks will be penmitted by the
colo::ado Depar"tment of Health, that the :requested division is in
accordance with the genenai pr:rposes and intent of the Subdivision
Regulations of the state of colorado and the county of c,arfie)-d, and
should, therefone, be exempted froln the definition of the terms
trsubdivisionil and t'subdivided land'r as set forth in C'R'S' 1973'

NOI.I, THEREFORE, upon the motion of Flaven J. Ce::ise, seconded
by Richand C. Jo11ey, and cannied, said 137 acne tract of land is
heneby exempted frrcm such definitions and said t::act may be divided
into one (l) tnact of, 131.acnes and thnee (3) tracts of 2.0 acres
each, mone or less, a1l- as is rnone ttr, described above, and said
divided tract may be conveyed in the forrn of such smaller tracts
without fur"ther compliance with the afonesaid subdivision statutes
and negulations; pnovided, howeven, that said exemption is conditioned
on the Petitionen obtaining a propen legal descniption of said tnacts
pnion to any conveyance theneof. Fu::then, this exemption is granted
on the condition and with the express understanding and agreement of
the Petitionen that no furthen exemptions be allowed on said tnact
ttArr and all fi:rther subdivision of said tnact must be pursuant to the
Subdivision Regulations of Ganfield County. A copy of the insb:ument
o:: instnuments of conveyance when neconded shal1 be filed with this
Resolution.

and the Subdivision Regulations of Garfield County, Colorado, adopted
September 1,1972 and amended April 14,'1975, Sections I.02.17(d) and

County, ColoradO, to exempt by reSolution Three (3) parcels, no less than
two (2) acres each. r
