Pursusant Lo C.R.S. (1973) Section 30-28-101 (10) (a) (d) as
amended, and the Subdivision Regulabions of Garfield County, Colorado,

of County Commissioners of Garfield County, Colorado, to exempt by

description of the property, dirnension and area of all lobs or
separate interests to be created, access to a public
r ight-of-way, and any proposed easements for drainage,
irrigation, access or utilities;B. Vicinit.y map at a minimum scale of 1'-2000' showing the getreral
topographic and geographic relation of the proposed exemption tothe surrounding area wibhin two 12) miles, for which a copy of
U.S.G.S. quadrangle map may be used.Copy of the deed showing orrnership by the applicant, or a letber
from the properby owner(s) if other than the applicant; andes and addresses of owners of record of land immediately
adjoining and within 2O0 feet of the proposed exempbion, mineral
owners and lessees of mineral owners of record of the property t.obe exempted, and tenants of any structure proposed for
conversion; and
Evidence of the soil types and characteristics of each type; and
Proof of 1egal and adequate source of domest.ic water for each 1otcreated, method of sewage disposal, and letter of approval offire protection plan from appropriate fire disbrict; andIf connect.ion to a community or municipal waber or sevrer systemis proposedl o letter from the governing body stating awillingness to serve; andNarrative explaining why exemption is being requested; andIt shal1 be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presenbly is one ofnot more than three parcels created from a larger parcel as itexisted on January 1, L973.

EXEMPTION
APPLICABILITY
The Board of County Commissioners l-ras the discretionary power to exempt a
division of Ian<i from the definition of subdivision and thereby from the
lioceaure in these Regulations, provided bhe Board determines thab such
exemption vriIl not irnpair or defeat the stated purpose of the Subdivision
neguiatj-ons nor be aetrimental to the general bu5lic welfare. The Board
shall make exemption decisions in accorclance with the requirements of
these regulations. Following a review of the individual facts of each
applicabion in light of th; requireme.nts of these Regulations, the Board
may approve, conditionally appro;e or deny an exemptiog. An application
foi exemption must satilfyl at a miniIflum, all of the review criteria
I isbed below. compl iance with the review cr iter ia I however , does not
ensure exemption. The Board also may consider adclitonal factors listed in
Section B:60 of the Subdivision Regulations'
A. No more than a total of four (4) lotsr Pdrcels, interests or dwelling
units wi1l be created from any parcel, ai thab parcel was described in
the records of the GarfiefO County Clerl< and Recorder's Office on

(4) 1ot, parcel, interest or dwelling unib limitation obherwise
aPPlicable;B. Aii Garfield County zoning requirements will be met; and
C. A1I lots createcl wiff frive iegal access to a public right-of-way and
any necessary access easements have been obt.ained or are in the
process of being obtained; and
D. irovision has been made for an a<lequate source of water in terms of
bot-h the 1ega1 apd ptrysical quality, quantity and dependability, and a
suitable typ" of sewage disposal to serve each proposed lot; and
E. A11 state in<] local environmental health and safety requirements have
been met or are in the process of being met; and
F . provision has been macle f or any r eguir ed r oad or storm drainage
impr ov.ements; and
c. niie protection has been approvecl by the appropriate fire disLrict.
H. Any necessary <lrainage , - 1, rigation or utility easements have been
oblained or aie in the process of being obtaiped; and
I. School fees, taxes and special assessments have been paid..
(The School Impact Fee is $200.00 for each new lot created).
PROCEDURES
A. A request for exemption shall be submit.ted to the Board on forms
provi<je,l by t.he Garlield County Departmenb of Development/Planning-oivision. Two (2) copies of the appl ication, maps and supplemental
information sha11 be submitted.
B. The planning Division sha11 review the exemption request for
completeness within eight (B) <1ays of submitbal. If iucomplete, the
appiication sha1l be witf,Orawn from consideration and the applicant
notif ieci of the add j tional inf ormabion neecled. If the appl ication is
complete, the applicanb shal1 be nobified in writing of bhe time and
plate oi the Board of County Commissioners meeting at. which the
iequest shal1 be considered. In either caser Dotification shall occur
within f if teen ( 15 ) tiays of submittal.

receipt requested, to owners or record of rana immecliately adjoining

mailing at the meeting.
At or within fifteen (15) <1ays of the meeting, the Board shall
approve, conditionally approve or cleny the exemption request' The
r'elsons for denial or any tonditions of ipp.oval shall be set forth in
the minutes of the meeti-ng or in a written resolution. An applicant
denied exemption shall fo1low the subdivision procedure in these
Regula t ions .

The above enti.tled matter having been referre<I to the undersigned
as Water Referee for Water flivision No. 5, State of Co1ora6o, by the Water
Judqe of said Court on the lst day of July, Lg7L, in accordance with
Article 2L of Chapter l4g, Colorado Revised Statutes 1963, as amended
(Chapter 373 s.L. CoIo. 1969), known as The water Rights Determination and
Administration Act of 1969, and agaln by order of the water Judqe on the IBth
day of May, L972.
And the undersigned Referee havinq made such investigations as are
necessary to determine whether or not the statements in the application and
statements of o1'rposition are true and having become fully advised with
respect to the subject matter of the application and statements of opposition
does hereby make the following determination and ruling as the Referee in
this matter, to-wit:

3. The name of craimant and addiess is: Danier w. strook,Carbondale, Colorado.
4' The source of water is a werr having a depth of 350 feet.
5. The tegal description of the.location of the well is: Itre weIIis located at a point whence the Southwest Corner of Section 22,T. 7s., R- BBW. of tr:e 6th p.M. bears s. 30057'28,' w. a distanceof 2030.21 feet.
6. The proposed use of the water .is domestic, irriqation, stockwaterinq and other beneficial uses.
7. The date of iniLiation of appropriation is Aprir 9, 1969.
B. The amount of water claimecl in cubic feet per second of time is. 0 .O2-2 cri>ic foot per second of time.
9' Permit t'lo- 37353 was issued by the office of the state Enqineeron April 9, 1969.
10' The wator is used to irriqate 1o Acres of lantl in said Section 22.
