REOUEST: APPLICANT: LOEAT-IQN: SITE DATA: WATER: SEWER: ACCESS: EXJ_grrNG_zoN[-NG: ADJACEN_I ZONTNG: BOCC 3/LL/9I PROJECT INFORMATION AND STAFF COMMENTS Exemption from the Definition of Subdivision Andrew Schwaller/nichard Veit A tract of land situated in the SE L/4, Sec. 2L and the SW L/4 of Sec. 22, I7S, R88W of the 6th P.M.; located 1.5 miles north of Carbondale in the Red HilI area off County Road l'07 (Red Hill Rd.). REI,ATTQI{SHIP TO THE COMPREHENSIVE PLAN The subject, property is located in District E., Rural Areas with Severe Environmental Constraints as designated on the Comprehensive Plan Management District map. pEiscRr.uqIgN oF THE PROPOSAT A. Srt-g--Dggcriplfon: The site is located in a rural portion of the County with adjacent land uses primarily agricultural, residential and open space. The site isdivided in half between meadows and slopes treed withpinon-juniper. Improvements on the property include asingle family residence under construction and an existing metal barn. B. lroject Description: The applicant proposes to dividethe B0 acre parcel into two tracts of 70 and 10 acres insize. The proposed L0 acre tract will be located at the northeast corner of the parent parcel. The reason forthis request is to create a salable tract. C. Background: An exemption was approved for the subJectproperty in May l-991. The applicant failed to completethe conditions of approval within the 120 day period andconsequently the approval lapsed. Since the original exermption approval, the appli-cants have split a 35 acreparcel from the original L24 acre parcel leaving the B0acres in this application. IV. rrr. MAiIoR r"ssuEs ANp CoNCERNS 1. The proposed 10 acre tract is steeply sloped, with slopes ratnging from 25? to 308. These slopes are potentially urrstable and may be subJect to subsidence. Engineered foundations and wastewater systems should be required. 2. There are two options available to the applicant to pr:ovide water to the proposed parcels. There is an existl-ng permitted well on the 80 acre parcel. The perrmit would allow the well to be shared by both of the proposed parcels. The other alternative is that the Dl-vision of Water Resources has indicated that they would issue a separate in house well permit for the L0 acre parcel. 3. Access to the parcels is from an existing driveway off C.R. 106 which traverses both parcels. SUGGESII]E:D FINDINGS That proper posting and public notice was provided as rr:quired by law for the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissionerswils extensive and complete, that a1I pertinent facts, matters and issues were submitted and that all interestedparties were heard at that meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety,welfare, morals, convenience, order, prosperity and wr:Lfare of the citizens of Garfield County. B:E.eOMM.rrNpATrON APPROVAL, with following conditions: 1. That the following plat notes be included on the Exemption PIat; a. That engineered foundations and individual sewage disposal systems shall be required. b. The single family residence shall be constructed in conformance with USFS and Colorado State Foresterwildfire prevention guidelines. c. No further exemptions shall be allowed on eitherparcel. That aII representations of the applicant, either within thel application or stated at the meeting before the Board oE County Commissioners, shalI be considered conditions oE approval. That the applicants shall comply with all conditions clfapproval and submit an Exemption Plat within L20 days ofBoard of County Commissioners approval unless andextension of approval is granted by the Board of County Commi.ssioners prior to the expiration of the L20 day timelirnit.
