Dear Mr. Szymanski:
The County Commissioners have requested that I respond to your
letters to them regarding the granting of Senate Bill Exemptions in
your area and try to answer at least some of your questions.
With regards to the exemption granted on a twenty (20) acre tract
for George Whipple, that particular twenty (20) acre tract had never
been the product of a previous exemption. At the time the exemption
was considered, there was a good deal of discussion concerning whether
or not the area should be allowed another exemption, in light of the
existing road and the substantial number of Senate Bill Exemptions
which were granted previously. The ultimate decision of the Board was
to grant the exemption. I think a major factor in their decision was
the fact that the tract in question had never been exempted before.
As to your concerns over not being notified of the action prior
to its hearing I fully sympathize with you. However, there is no
procedure for notification in an exemption action. The Senate Bill
Exemption is a request to be relieved of the notification and hearing
requirements of the subdivision regulations themselves, hence unless
the applicant is required to proceed through a full subdivision procedure
there are no means except informal ones, that exist for surrounding land-
owners to be notified in advance of the exemption action.
Regarding the existence of covenants in the area, it is my under-
standing that they exist in the form of deed restrictions against further
subdivision, applying to those lots which were created by previous exemptions
of forty (40) acre tracts, and were applied on a lot -by -lot basis along with
the exemptions. While the Board of County Commissioners has no responsibility
towards their enforcement, I'm sure their existence would weigh heavily in
any decisions on affected lots in the future. As to the Whipple exemption
such restrictions against subdivision did not exist to my knowledge, since
this lot did not go through the exemption procedure prior to this.

I can state I was in opposition to the Whipple request for an
exemption, and would also probably recommend denial of any requests
to further exempt the parcels which have already been created by
prior exemptions in that area. There is no way the County can require
notification of adjacent property owners if such a request is made,
however I would make every effort to contact you myself if such a
request were made in the future.
