NOTICE
Authority. This application for a Building Permit must be signed by the Owner of the property, described above,
or an authorized agent. If the signature below is not that of the Owner, a separate letter of authority, signed by
the Owner, must be provided with this Application.
Legal Access. A Building Permit cannot be issued without proof of legal and adequate access to the property for
purposes of inspections by the Building Division.
Other Permits. Multiple separate permits may be required: (1) State Electrical Permit, (2) County OWTS Permit,
(3) another permit required for use on the property identified above, e.g. State or County Highway/ Road Access
or a State Wastewater Discharge Permit.
Void Permit. A Building Permit becomes null and void if :In work authorized is not commenced within 180 days
of the date of issuance and it work is suspended or abandoned for a period of 180 days after commencement.
CERTIFICATION
I hereby certify that I have read this Application and that the information contained above is true and correct. I
understand that the Building Division accepts the Application, along with the plans and specifications and other
data submitted by me or on my behalf (submittals), based upon my certification as to accuracy. Assuming
completeness of the submittals and approval of this Application, a Building Permit will be issued granting
permission to me, as Owner, to construct the structure(s) and facilities detailed on the submittals reviewed by
the Building Division. In consideration of the issuance of the Building Permit, I agree that I and my agents will
comply with provisions of any federal, state or local law regulating the work and the Garfield County Building
Code, OWTS regulations and applicable land use regulations (County Regulatton(s)). 1 acknowledge that the
Building Permit may be suspended or revoked, upon notice from the County, if the location, construction or use

We have reviewed the plans & other information you have submitted for a building permit at the "recreational cabin"
which you would like to convert into your primary residence at 7315 County Road 312.
Unfortunately, we cannot issue a building permit for this residence until we receive a letter from an Engineer or Design
Professional certifying that this building complies with Garfield County's Building Requirements — including structural,
insulation and plumbing, etc. — items which are all now concealed from view and cannot be verified by our Building
Inspectors. As a result, we must rely on a report issued by a Colorado licensed Professional Engineer or Architect to
certify that your building meets our minimum requirements. Please refer to the attached one-page description of
"Obtaining a Building Permit for an Existing Structure" for more information.
For your edification, I have also attached a copy of Garfield County's Building Requirements, as well as the redlines on
your floor plans with numerical references to the attached "Residential Plan Review List". Between these documents
and the items redlined on your plans, you can get a good idea about the items your Engineer and/or Architect should
address in their report. From a Structural Engineering perspective, the report should address compliance with the
Engineered plans you have submitted to our office by Anderson Structural Engineering.
Since we do not review photographs for the purpose of providing "ex post facto" building inspections, you are welcome
to come pick up from our office the pictures you submitted along with your plans. These would perhaps be more
suitable for you to present to an Engineer or Architect who can then provide us with the certification report as described
above.
Also please note that our review & pending issuance of a building permit for this application only centers on the
recreational cabin and its conversion into your primary residence. Any forthcoming approval for this project in no way
should be interpreted as approval of either a Land Use Change Permit or Building Permit for the existing barn structure.
Until we receive the follow-up documentation described above we will place your project file in our "pending permits"

Obtaining a Building Permit for an Existing Structure
Because an existing building's structural and architectural elements were not inspected during the initial
construction, the following steps are required to obtain a building permit and subsequent Certificate of
Occupancy (CO) for the structure already built, or otherwise for an existing structure being moved into
Garfield County from another location:
1) Depending on the type and use of the building, a specific permit packet (application and
checklist) must be obtained from the building department. Please call the building department
to determine which packet applies. Building permit application packets are also available online
by visiting:

2) A Colorado licensed design professional (Architect or Engineer) must perform a site visit and
inspection to verify the structure meets the requirements for structural and non-structural
provisions of the adopted codes. As part of the building permit application process, the design
professional must certify with a sealed letter that the building meets adopted codes. This letter
must accompany the building permit application. Depending on the complexity of the structure,
building plans may also need to be drawn and submitted with the application.
3) Upon approval of the application, a permit will be issued and the final permit fees will be
collected. Typically there are one or two inspections performed by the county to finalize the
process and issue a CO if applicable.
4) Additional permits for septic, electrical or driveways may be required and must be submitted
and finalized prior to issuance of a CO if applicable.

It's good to hear that your Structural Engineer was present during construction to view structural elements of the cabin
as it was being built. That should make it easier for them to certify that it complies with Garfield County's minimum
building requirements. The purpose of taking photos during construction is to provide a record of construction progress
for a consulting Professional Engineer hired directly by you so that they can view key structural & plumbing elements of
that become concealed during the construction process. Our office can only review & inspect work as it's being
completed, which is why it's best to pull a building permit before construction begins.
After looking at your building permit application for the barn, I know that we are still awaiting Structural Engineering
certification of this existing steel building before we can go any further in issuing an "after the fact" building permit. The
barn is still being held in our "pending projects" file and I believe that Andy Schwaller contacted you recently about
whether or not you wanted to have us continue to hold the file or close it out.
I have also asked Glenn Hartmann to reach out to you for a status update and to assist you with any pending land use
change issues on your property.

Dave,
I will get my engineer to certify the building was built with Garfield County Building requirements. Landon
Anderson (my engineer) conducted a site visit during the construction phase when all structural components
were visible. I will also pass on the photos to him for further review if needed. The only reason 1 submitted
photos with my application to your office is because I was specifically told about a year ago at a meeting with
you present to "take lots of photos" concerning the "ex post facto" cabin topic. I guess 1 mis-understood what

that meant? Did policy change on this? Nevertheless, I can provide my engineer with whatever he needs to
complete his report.
Also, I am well aware that the permitting of the cabin as a primary residence has no bearing on the permitting or
land use change for the agricultural barn that is also on the property. I have been waiting for many weeks for a
pre -conference summary or follow up meeting concerning that topic from the community development office. 1
have taken steps to meet several of the requirements for permitting of the barn such as meeting with the Fire
Marshall (Orrin Moon) at the location, meeting with Road and Bridge representative at the location, providing
an engineer report for the structure, as well as having a water pump performance test conducted. At this point
we are not sure how to get additional movement on the process as we have left several messages trying to
schedule a follow up meeting to discuss the Pre -conference summary progress. I assume your office is busy.

Please see the attached engineer report and "redlines" response for the recreation cabin conversion to primary
residence. I have also contacted the County Road and Bridge to verify the driveway exemption. This occurred at
least a month ago and it was my understanding that they would contact you directly
to confirm this.
Please let me know if you need anything else to issue the final inspection.

Thanks for sending over this information. Unfortunately, I believe that you have been somewhat misled by this
manufacturer. Although their General Notes say that the structure has been designed to meet IRC and IBC building code
requirements, note #4 says rather directly: "Structures ... should not be used for human habitation." Clearly we can't
accept a building like this for residential purposes.
As we discussed the other day, any pre -built residential structures will be required to have the insignia of Colorado Dept.
of Housing (or CDOH) affixed to them as follows: (a) inside the structure indicating that design & construction are in
compliance, and (b) on the outside of the structure indicating that installation is in compliance with CDOH standards and
requirements. CDOH compliance is really one of the most important questions you need to ask of potential
manufacturers of modular structures for your home.
The good news is that there certainly aren't a lack of manufacturers out there who build pre -fab, modular and/or
manufactured housing units which comply with CDOH requirements. In fact, with the popularity of the "Tiny Homes"
movement, there are many options available. Maybe a good place to start is by taking a look at CDOH's website per the
following web -link:

permit. We were able to get general engineered plans sent to us by the manufacturer, which are attached, but I
wanted to run them by you before we commit to this building. The structure is designed and built using 2015
IRC and 2015 IBC, but the plans do note that they are classified as storage (Cat. 1). Is this because the interior
is not finished out? Would this cabin be compliant for our residence if we build the rest of the interior out
according to 2015 1RC and it was secured to a compliant stem wall? Also, our design would be 16x32 with a
bedroom, kitchen, bathroom with shower, two storage lofts and a living room.

This is certainly disappointing, but I understand. I hoped that the CDOH certification was only for "completed"
manufactured/pre-fab homes as opposed to just the finished shells which we would finish using the IRC code.
We will be looking into other options from the CDOH list or I guess a GC to build.

Thanks for sending over this information. Unfortunately, I believe that you have been somewhat misled by this
manufacturer. Although their General Notes say that the structure has been designed to meet IRC and IBC building
code requirements, note #4 says rather directly: "Structures ... should not be used for human habitation." Clearly we
can't accept a building like this for residential purposes.
As we discussed the other day, any pre -built residential structures will be required to have the insignia of Colorado
Dept. of Housing (or CDOH) affixed to them as follows: (a) inside the structure indicating that design & construction are
in compliance, and (b) on the outside of the structure indicating that installation is in compliance with CDOH standards
and requirements. CDOH compliance is really one of the most important questions you need to ask of potential
manufacturers of modular structures for your home.
The good news is that there certainly aren't a lack of manufacturers out there who build pre -fab, modular and/or
manufactured housing units which comply with CDOH requirements. In fact, with the popularity of the "Tiny Homes"
movement, there are many options available. Maybe a good place to start is by taking a look at CDOH's website per the
following web -link:
