HomeMy WebLinkAbout1.0 Application• • BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. 1973, 30-28-101(10)(a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, the undersigned, George S. Whipple, respectfully petitions the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division by him of the land hereinafter more particularly described into two parcels from the defi- nitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. 1973, Section 30-28-101(a) - (d) and the Garfield County Subdivision Regulations, both as amended and in support thereof states: 1. The land the subject hereof is described as follows: "All that part of Lot 10, Section 10, Township 7 South, Range 88 West of the 6th P.M., lying northerly of the Cattle Creek County Road", and is as depicted on attached plat thereof. 2. Petitioner seeks to divide the property into two parcels containing 5 and 21 acres each, respectively. The location of each parcel is as set forth on plat attached hereto. A legal description as to each parcel will be obtained upon final completion of a roadway as thereon depicted. 3. A residence is presently situate on the 5 acre parcel and will be conveyed to third parties as yet unknown. A residence will be constructed by Petitioner upon • • the 21 acre parcel. The residence to be constructed will be partially heated by solar energy, a more particular descrip- tion of which appears in attachment hereto. 4. A septic system is presently in use for the residence on the 5 acre parcel. A septic system will be constructed on the 21 acre parcel. Such construction will be allowed by County and State Regulations as appears in copy of letter from the Garfield County Department of Health and Environmental Protection. 5. Access to the 21 acre parcel will be as depicted on the attached plat and constructed in conformity with letter from Frank Bishop attached. 6. Water will be supplied from Whipple Springs No. 1 and 2 for which an absolute decree has been obtained for .02 cubic feet of water per second of time for domestic and irrigation purposes. The sufficiency and quality of this water is as set forth in attached copies of letters from Collins Drilling Company and the Garfield County Department of Health and Environmental Protection. 7. I have spent nine months working along with two other architects on a design that I hope will be 75io energy efficient and still remain within a low cost scale. Solar energy is a very new area of design and their are a ;great number of variables that effect the total performance of this type of residence. For this reason I have tried to be as care- ful and realistic as possible in assessing this proposal. I have tried to investigate all the contingencies that would ef- fect the use of the proposed site in the 21 acre parcel. I do believe that the site does meet all of the necessary con- ditions to make the project a success, and I have tried to divide the two parcels in a responsible manner with every intention of preserving the interity of the terrain. I am sure you will give this matter every consideration, and I thank you for your time.
