WHEREAS,

WHEREAS, W. C. WHITCHURCH, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C. R. S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14,
1975, Sections 1.02.17 (d) and 3.02.01, for the division of a 1.7 acre tract
of land into two tracts of 1 and .7 acres, more or less, and said 1.7 acre
tract is more particularly described as follows:
A tract of land situated in the Northwest quarter of
the Southeast quarter,Section 5, Township 6 South,
Range 89 West of the 6th Principal Meridian, described
as follows:
Beginning at a point on the North line of said North-
west quarter of the Southeast quarter, whence the
South quarter corner of Section 35, Township 5 South,
Range 82 West of the 6th Principal Meridian bears
North 7 57' West, 1041.4 feet; thence North 86°
04' West 124.55 feet along North line of said NWQ
SE4; thence South 10° 43' West 182.9 feet, thence
South 38° 30' West, 127.75 feet to Easterly line of
County Road; thence 60° 7' East 410.0 feet along
Easterly line of County Road; thence North 40 36
feet East 380.0 feet to the point of beginning.
Containing 1.7 acres, more or less.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County, Colorado, that he desires
said exemption for the purpose of re -sale into single-family residential
acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the
Board that there is a reasonable probability of locating central domestic
water on each of said one acre and .7 acre tracts, that there is adequate
ingress and egress to said tracts, that there is reasonable probability of
locating central sewer service on said one and .7 acre tracts, that the
requested division is in accordance with the intent of the Subdivision
Regulations of the State of Colorado and the County of Garfield, and should,
therefore, be exempted from the definition of the terms "subdivision" and
"subdivided land" as set forth in C. R S. (1973) Section 30-28-101 (10) (a) -
(d) as amended;
WHEREAS, the Petitioner has demonstrated that there will be caused by this
exemption a single-family lot with two single-family residences on it and such
situation requires a variance from the Garfield County Zoning Regulation;
NOW THEREFORE, upon motion of -41C11,1 0_,eri3e seconded by

exempted from such definition and transfer of said tract may be made by
division into two tracts of 1 and .7 acres, more or less, all as is more
fully described above and further, that said exemption is conditioned upon
the Petitioner being granted a variance from the Garfield County Zoning Board
of Adjustment to the Garfield County Zoning Ordinance and the obtaining of
central water and sewer service from the appropriate service districts for
construction on the undeveloped parcel and further, that a proper legal
description be prepared for said tracts prior to their sale. A copy of the
instrument(s) of conveyance when recorded shall be filed with this Resolution.
