PROJECT INFORMATION AND STAFF COMMENTS
REQUEST: An exemption from the definition of
subdivision.
APPLICANT: John and JoAnne White
LOCATION: A parcel of land situated in Lot 4 of
Section 4, Township 6 South, Range
91 West of the 6th P.M.; located on
C.R. 214 approximately 1/2 mile of
the intersection with west of
Highway 6 and 24.
SITE DATA: 13.75 acres.
WATER: Existing and proposed wells.
SEWER: Existing and proposed I.S.D.S.
ACCESS: Private driveway off C.R. 214.
EXISTING AND ADJACENT ZONING: A/R/RD
I. RELATIONSHIP TO THE COMPREHENSIVE PLAN
The site is located in District C - Rural Areas with Minor Environmental Constraints
as designated on the Garfield County Comprehensive Plan Management Districts map.
II. DESCRIPTION OF THE PROPOSAL
A. Site Description: The site slopes from north to south from the hogback towards
C.R. 214. The front portion of the property is irrigated pasture land. The rear,
or north two-thirds of the property contains the improvements and is separated
from the front portion by an irrigation. Improvements on the property include
a single family residence and a garage.
B. Project Description: The applicants are requesting an exemption to split the
13.75 acre subject property into two (2) parcels of 9.15 and 4.62 acres
respectively (see photoreduction of plat on page 1 ).
III. MAJOR ISSUES AND CONCERNS
1. The proposed split will occur along a natural division, namely the center line of
the irrigation ditch.

2. The applicants intend to retain the 9± acre parcel. They "no longer wish to
expand the effort to irrigate, cultivate, lease and otherwise manage the lower lot
and wish to be able to sell it."
3. Access to the existing residence is via an existing driveway, with a dedicated
easement, which extends northward from the County road. Staff would
recommend that access to the proposed lower lot be restricted to the existing
driveway and that a new driveway directly exiting onto the County road be
prohibited.
4. There is currently a well servicing the existing residence on the subject property.
The applicants are proposing to convert the existing well permit into two (2)
household permits. In verbal comments, the Division of Water Resources has
indicated that they will not recommend approval of this request because a
previous owner has never amended the original decree. With an amended
decree, the Division of Water Resources has indicated that they would convert
the existing exempt well to two (2) household -only wells.
5. The soils report does not indicate any conditions that would preclude the use of
septic systems.
IV. ,SI JGGESTED FINDINGS
1. That proper posting and public notice was provided as required for the meeting
before the Board of County Commissioners.
2. That the meeting before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
3. That for the above stated and other reasons, the proposed exemption is in the
best interest of the health, safety, morals, convenience, order, prosperity and
welfare of the citizens of Garfield County.
V. RECOMMENDATION
APPROVAL, subject to the following conditions:
1. That all representations of the applicant, either within the application or stated
at the meeting before the Board of County Commissioners, shall be considered
conditions of approval.
2. That the applicant shall have 120 days to present a plat to the Commissioners
for signature. Extensions of time may be granted if requested prior to the
expiration date.
3. That the applicant shall provide well permit(s) providing water for in-house
consumption for both of the parcels.
4. That access to the 4± acre parcel shall be obtained exclusively from the existing
driveway/easement.
5. That the following plat notes be included on the Exemption Plat:

1. All residential construction shall conform to Colorado State Forestry
Wildfire Prevention guidelines.
6. That the applicant submit $200 in School Impact Fees for the creation of the
new lot.
