Dear Mr. Walter,
Per your request dated October 31, 1991 I'm enclosing the following:
1) A copy of Permit No. 71073. Since our Division 5 Office only has the front page of the
permit, I contacted our Denver office and requested a complete copy of Permit No. 71073.
It should be noted that Permit No.71073 has been CANCELED by Permit No. 19330-F.
2) A copy of Permit No. 19330-F. It should be noted in Item No. (1) under Conditions Of
Approval a decree was to be obtained in Division 5 Water Court. It appears that a new
decree was never entered.
3) A copy of Water Court Case No. W-2134. This decree limits the use of the Johnson Well
No. 1 to DOMESTIC under Permit No. 71073. As noted before, Permit No. 71073 was Canceled
by Permit No. 19330-F.
4) A copy of COMMENTS from the State Engineers Office to Garfield County, regarding the
White Exemption. As noted by Judy Sappington in Engineering, a new decree most be
obtained for Permit No. 19330-F (Non -Exempt) ,or a new permit must be obtained for the
decreed uses in W-2134 (Exempt) and cancel Permit No.19330-F.
1 hope this information is helpful. In review of these documents, I feel you need to determine
the INTENDED USES OF THE EXISTING JOHNSON WELL NO. 1 and then choose the appropriate action.

We have reviewed the above referenced proposal to subdivide a 13.735 acre parcel into two
parcels of 9.15 and 4.26 acres. The property is located on Lot 4 of Section 4. The applicants wish
to sell the second lot with the assumption of using a new well for water service. There is an
existing domestic well, Permit No. 19330-F, serving a residential dwelling on the 9.15 acre tract.
A condition of approval for Permit No. 19330-F was that the applicant obtain a decree for
the expanded use of the well from exempt uses to non-exempt uses. According to records in this
office, this decree was not obtained. Prior to this office granting approval of water service for this
exemption, Permit No. 19330-F must be brought into compliance either by obtaining the necessary
decree or by obtaining a permit for the decreed exempt uses.
Based on this, we cannot recommend approval of this exemption until the aforementioned
issue has been satisfied. Should you have further questions or comments, please contact this office.

possible, copies of the following documents:

2. Well Permit 19330-F; and

ABSOLUTE DECREE FOR
UNDER GROUND WATER RIGHTS
TRIBUTARY INVOLVED:
IN GARFIELD COUNTY
And the Referee having made the investigations required
by Article 21 of Chapter 148, C.R.S. 1963, as amended does hereby
make the following ruling, to wit:
This application was referred to the Water Referee of
Water Division No. 5 on the 27th day of December , 197 3.

at a point whence the West Quarter Corner of said
Section 4 bears S. 17°37147" W. 2344.58 feet.
4. The depth of the well is 215 feet.
5. The date of initiation of appropriation is November 5, 1973.
6. The amount of water claimed is 0.033 cubic foot per second
of time as allowed by drilling permit.
7. The use of the water is domestic.
8. The State Engineer's number is 71073.
9. The Priority date is November 5, 1973.
10. The date of the application was December 3, 1973.
It is the ruling of the Referee that the statements in the
application are true and that the above described water right is
approved and granted the indicated priority; subject, however, to
all earlier priority rights of others.
It is accordingly ordered that this ruling shall become
effective upon filing with the Water Clerk, subject to Judicial review
as provided by law.
Done at the City of Glenwood Springs, Colorado this
