COLORADO At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Commissioners' Annex in Glenwood Springs on Monday , the 16th day of July A.D. 1984 , there were present: Larry Velasquez Flaven J. Cerise Eugene "Jim" Drinkhouse Earl Rhodes Mildred Alsdorf , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board when the following proceedings, among others were had and done, to -wit: A RESOLUTION NO. 84-131 A RESOLUTION FOR THE APPROVAL OF AN EXEMPTION REQUEST BY EDWARD AND JUANITA WILLIAMS. WHEREAS, Edward and Juanita Williams have petitioned the Board of County Commissioners of Garfield County, Colorado, on December 19, 1983, for an exemption from the definition of the terms "subdivision" and "subdivided land" underC.R.S. 1973, 30-28-101 (10) (a) -(d), as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 10 acre tract described as follows: Book 514, Page 439 and 440 as found in the Garfield County Clerk and Recorder's office. into 2 tracts of approximately 5 acres each, more or less, which proposed divided tracts are more particularly described as follows: See attached Exhibit "A" (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part I, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that this does not warrant full subdivision review; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that there is a reasonable probability of locating domestic water on each of the said tracts, that there is adequate ingress and egress to said tracts, `3a�K 653 PAGE 72 that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is not part of an existing or larger development and does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the county of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended; NOW THEREFORE, BE IT RESOLVED that the division of the above described tracts "A" and "B" from the above described 10 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B" all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts without further compliance with the aforesaid subdivision statutes and regulations; provided, however, that this exemption is granted on the condition and with the express understanding and agreement of the Petitioners that no further exemptions be allowed on said tracts "A" and "B" and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. East 646.36 feet; thence S15?00'00"E 381.34 feet; thence N80° 41'27"W 826.33 feet to a point on said northwesterly line of Homestead ,Entry Survey #53; thence along said northwesterly line of Homestead Entry Survey #53 N16°41'41'E,—h 245.00 feet to the point of beginning. Said parcel of land contains 5.04 acres more or less. Also herewith: An 18 foot wide easement lying within this parcel for ingress and egress to the adjoining parcel northerly abutting and parallel with the northeasterly boundary. Parcel 2B A parcel of land situate in Section 35, and being part of Homestead Entry Survey #53, Township 4 South, Range 91 West of the 6th Principal Meridian being more particularly described as fol- lows: • Beginning at a point on the northwesterly line of said Homestead Entry Survey #53 whence Cor- ner #1 of said Homestead Entry Survey #53 a stone in place bears S16°41'41'W 677.63 feet; thence along said northwesterly line of Homestead Entry Survey #53 N16° 41'41'E 237.03 feet; thence leaving said northwesterly line of Homestead Entry Survey #53 N77°48'02"E 669.04 feet to a point. on the easterly line of said Homestead. Entry Survey #53; thence along said easterly line of Homestead Entry Survey #53 SO1°47'27"E 737.12 feet; thenceleaving said Homestead Entry Survey #53 boundary N15° 00'00"W 381.34 feet; thence West 646.36 feet to the point of beginning.
