Dear Mr. Witkowski:
Enclosed are duplicate copies of Messrs. Williams and
Grieve's Petition For Subdivision Exemption. Also enclosed
is a check in the sum of $61.00, payable to the Garfield County
Clerk to cover the exemption fee.
If, after reviewing the Petition, you need any additional
information or supporting documentation, please let this office
know and we will do our best to see that it is provided as soon
as possible.
If you find everything in order, please schedule the matter
for hearing and advise as to the hearing date scheduled. Messrs.
Williams and Grieve are residents of and are domiciled in
the State of California. Therefore, considerable expense
will be incurred if they are required to attend the hearing
before the Board of County Commissioners. If it is at all
possible for this firm to represent them without their presence
before such a hearing, please advise this office. Thank you
for your time and efforts in connection with this matter.

BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973), Section 30-28-101(10)(a) - (d)
as amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17(d) and 3.02.01, the undersigned WILLIAM H.
WILLIAMS and JOHN M. GRIEVE, respectfully petition the Board of
County Commissioners of Garfield County, Colorado, to exempt, by
resolution, the division of a certain 10.11 acre parcel of
land into two 5.055 acre parcels, all as more fully hereinafter
described, from the definitions of "subdivision" and "subdivision
land" as the terms are used and defined in C.R.S. (1973), Section
30-28-101(a) - (d) and the Garfield County Subdivision Regulations,
for the reasons stated below:
1. Petitioners are the owners of certain property located
in Garfield County, Colorado, situate in the NE4NW4 of Section
31, Township 5 South, Range 91 West of the Sixth Principal
Meridian, more particularly described as follows:
Beginning at the North Quarter Corner of said Section 31,
thence S. 88°26'00" W. 532.90 feet along the North
line of said Section 31; being also the center of
County Road as now constructed and in use; thence
S. 00°58'00" W. 837.90 feet; thence N. 85°13'00" E.
540.90 feet, more or less, to a point on the East line
of said NE4NW4; thence N. 00°31'18" E. along the Easterly
line of said NE4NW4, 807.28 feet, more or less, to the
North Quarter Corner of said Section 31, the point of
beginning.

2. Petitioners hold title to the subject property as
tenants in common.
3. The subject property contains 10.11 acres, more or
less, and exemption is sought to divide the subject property
into two equal parcels, each such parcel consisting of 5.055
acres, more or less. Good and proper legal descriptions of
said parcels are attached hereto as Exhibits "A" and "B", respec-
tively, and incorporated herein by this reference.
4. An economical and practical method of sewage disposal
is available to each such parcel inasmuch as soil conditions
of the property and the size of the respective parcels are
adequate to permit the installation of individual on -lot sewage
disposal facilities. A copy of an individual sewage disposal
permit dated July 26, 1976, issued by the Garfield County Depart-
ment of Environmental Health is attached hereto as Exhibit
5. A permit to construct a well on the subject property
has been granted by the Colorado Division of Water Resources
and a copy of the approved permit application form is attached
hereto as Exhibit "D" and incorporated herein by this reference.
The intended water supply for each parcel is subsurface ground
water to be utilized through individual wells.
6. Both parcels are bounded on the north by County Road
250, and one parcel is additionally bounded on the east by
County Road 228, thus providing said parcels the necessary
access to a public road.
7. That petitioners are desirous of dividing the subject
property between themselves and establishing in each petitioner,
title to an undivided interest in one-half of the subject property,
through the conveyance of one of the 5.055 acre parcels referenced
above, to each petitioner.

8. That petitioners have no plans to further subdivide
the subject property.

`CONDITIONS:
1. All installation must comply with all requirements of the County Individual Sewage Disposal Regulations, adopted pursuant to au-
thority granted in 66-44-4, CRS 1963, amended 66-3-14, CRS 1963.
2. This permit is valid only for connection to structures which have fully complied with County Zoning and building requirements.
Connection to or use with any dwelling or structures not approved by the building and Zoning office shall automatically be a viola-
tion of a requirement of the permit and cause for both legal action and revocation of the permit.
. 3. Section III, 3.24 requires any person who constructs, alters, or installs an individual sewage disposal system in a manner which in-
volves a knowing and material variation from the terms or specifications contained in the application of permit commits a Class I,
Petty Offense (S500.00 fine — 6 months in jail or both.
