WHEREAS, WILLIAM H. WILLIAMS and JOHN M. GRIEVE, have petitioned the
Board of County Commissioners of Garfield County, Colorado, for an
exemption under C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended,
and the Subdivision Renulations of Garfield County, Colorado, adopted
September 1, 1972 and amended April 14, 1975, Sections 1.02.17 (d) and
3.02.01, for the division of a 10.11 acre tract into two tracts of
approximately 5.055 acres each, more or less, and more particularly
described as follows: PARCEL "A"
A tract of land situated in the Northeast Quarter of the North-
west Quarter (NE14NW1/4) of Section Thirty -One (31), Township Five
(5) South, Range Ninety -One (91) West of the Sixth (6th)
Principal Meridian, rnore particularly described as follows:
Beginning at the North Quarter Corner of said Section Thirty -
One (31), thence S.88° 26' 00" W. along the Northerly line
of said Section Thirty -One (31), being also the Center of the
County Road as now constructed and in use, 269.20 feet to the
true point of beginning; thence S. 88° 26' 00" W. 263.70 feet
along the Northerly line of said Section Thirty -One (31),
being also the Center of the County Road as now constructed
and in use; thence S. 00° 58' 00" W. 837.90 feet; thence
N. 85° 13' 00" E. 267.69 feet; thence N. 00° 45' 53" E. 822.74
feet, more or less to a point on the Northerly line of said
Section Thirty -One (31), the true point of beginning.
The above described parcel of land contains 5.055 acres, more
or less.
PARCEL "B"
A tract of land situated in the Northeast Quarter of the North-
West Quarter (NE1/4NW14) of Section Thirty -One (31), Township Five
(5) South, Range Ninety -One (91) West of the Sixth (6th)
Principal Meridian, more particularly described as follows:
Beginning at the North Quarter Corner of said Section Thirty -
One (31), thence S. 88° 26' 00" W. 269.20 feet along the
North line of said Section; thence S. 00° 45' 53" W. 822.74
feet; thence N. 85° 13' 00" E. 273.21 feet more or less to a
point on the East Line of said Northeast Quarter of the
Northwest Quarter (NE NW1); thence N. 000 33' 18" E. along
the Easterly line of said NE14NW14, 807.28 feet, more or less
to the North Quarter Corner of said Section 31, the point
of beginning.
The above described parcel of land contains 5.055 acres, more
or less.
WHEREAS, the Petitioners have shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpose of re -sale into single-family residential acreage,
and;
WHEREAS, Petitioners have demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each
of said tracts, that there is adequate ingress and egress to said tracts,
that the location of septic tanks will be permitted by the Colorado
Department of Health, that the requested division is in accordance with the
general purposes and intent of the Subdivision Regulations of the State of
Colorado and the County of Garfield and that said division will actually
restrict the density of housing within said area and should therefore be
exempted from the definition of the terms "subdivision" and "subdivided land"
as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of , seconded by

hereby exempted from such definition and transfer of said tract may be made
by division into two (2) tracts of 5.055 acres each, more or less, all as
is more fully described above. A copy of the instrument or instruments
of conveyance when recorded shall be filed with this Resolution.
