RESOLUTION TO SB - 35
WHEREAS, Lawrence L. Williams and Karen S. Williams have
petitioned the Board of County Commissioners of Garfield County,
Colorado, for an exemption under C.R.S. 1973, 30-28-101(d) for
the division of two subdivided lots containing a total of 0.41 acres
into two tracts, one containing approximately .17 acres, more or
less, and the other containing approximately 0.24 acres, more or
less, and more particularly described as follows:
Retained Tract:
The Easterly 87.31 ft. of Lots 1 and 2, Block 3,
Elk Creek Development, Garfield County, Colorado.
Portion to be Sold:
That part of Lots 1 and 2, Elk Creek Development,
Garfield County, Colorado, more particularly
described as follows:
Commencing at a point on the Southerly Line of
said Lot 1, which point is 87.31 ft. West of the
Southeast corner of said Lot, thence North 0°05'
00" West 120 ft., more or less, to the North line
of said Lot 2, thence South 89°55'00" West 80.07
ft., more or less, to the Northwest Corner of said
Lot 2, thence South 42°15' West along the Westerly
line of said Lot 2, a distance of 29.78 ft., thence
South 00°02'00" East along the Westerly line of
said Lots 2 and 1, a distance of 96.54 ft. to the
Southwest Corner of said Lot 1, thence north 39°55'
00" East on the South line of said Lot, a distance of
60 ft., more or less, to the point of beginning.
WHEREAS, Petitioners have demonstrated to the satisfaction
of the Board that there is a water system providing domestic water
on each of said .17 acre and .24 acre tracts, that there is ade-
quate ingress and egress to said tracts, that the requested divi-
sion is in accordance with the general purposes and intent of the
subdivision regulations of the State of Colorado and the County
of Garfield and that said division will actually restrict the den-
sity of housing within said area and should therefore be exempted
from the definition of the terms "subdivision" and "subdivided
land" as set forth in C.R.S. 1973, 30-28-101(d);

said 0.41 acre tract is exempted from such definition and transfer
of said tract may be made by division into two tracts of .24 acres
and .17 acres, more or less, all as is more fully described in the
Petition pertaining hereto.* A copy of the instrument or instruments
of conveyance when recorded shall be filed with this Resolution.
