Dear Ms. Bowman:
We have received the above referenced proposal for exemption. This pro-
posal would divide 0.75 acre into tracts of 0.44 acre and 0.31 acre. The
proposed source of water is an existing well, permit number 6054. The pro-
perty has one house and the new lot which would be created would be zoned
commercial limited. The 1ot size raises questions about the suitability of asepLic-leachfield system.
It is possible that we could al1ow a limited expanded use of an existing
well or, alternaEively, thaE we could make an additional well available for
the 0.3l-acre tracE. In either case, our approval and the availability of the
new well would be subject to the following conditions:
This will be a one-Eime exemption. We understand that there has not
been a previous exemption involving the 0.75-acre tract since L972.
The use of water from either of the possible exempt well sources
which may serve Lhe new tract will be limited Eo in-house use only if
the tract is used for a residence. We understand another source of
irrigation water may be available. we ask that a plat note reflecL
tl're in-house use only limitation for Ehe new tract (tfre 0.31 acre) .
rf the new tract is to be used for commercial purposes, the water use
from any exempt well serving the ne\^r tracE will be limited to 300
gallons per day for drinking and sanitary purposes only. We ask that
a plat noLe reflect, this and that high waEer use operaEions, such as
restaurants, be expressly prohibited without a subsequent \^rater
supply review. We hope the building permit process can be utilized
to enforce this.

Only one sEructure requiring water supply will be allowed on Ehe new
tract.
5. A standard septic tank-leachfield will be allowed on either tract, or
any engineered system which is allowed must not cause any additional
consumptive use over that which would occur with the septic tank-
leachfield system.
IrIe could only recommend approval of the proposal Eo share the well if
Ehe use of both lots is restricred to residential for one single-
family dwelling. In that case, we would require joint ownership,
easements, and an operation and maint.enance agreement.
If the proposal would allow conrmercial use of the new lot, we would
only recommend approval if the additional well option were chosen.
Colorado Statutes 1973, 37-92-602, provides lirnitations for exempt
wells and would a1low Ehe applicant to use an exempt well for boeh
domesEic and commercial purposes. A1so, from an enforcement stand-
point, if water use on Ehe cortrnercial tract exceeded perrnit condi-
tions, we woutd prefer not to have to shut down a well which was also
used for domestic use.
In summary, the applicant may share the existing well only if Lhe new
tract. is restricted to residential use. A new well woutd be possible foreither residential or limited commercial use. We must ask that the applicant
be contacted to determine which waEer supply option is preferred. If the new
well is chosen, it would not require a decision between commercial and resi-
dential use at this time, however, potential buyers should be made aware of
the water use limitations. We expect the county to notify us of the appli-
canErs final wat.er use p1an. Subject Eo all the conditions of this leEter, we
can recommend approval.
