I]XEMPTION
APPLICABILTTY
The Board oICotrnty Commissioners has the discret.ionary power to exempt a division of land
lrom the definition ol subdivision and thereby lronr l.lie procedure in these Regulations,
provided the Board determines that such exemption will not in'rpair ordeleat the stated purpose
of the Subdivision Regtrlations nor be detrimental to the general public welfare. The Board
sltttll mal<e exenrption clecisions in accordance with the recluirements of these regulations.
Following a review o['the individual Iircts of eac;h application in light ot the requirements o[
these Regttlations, the Iloard may approve, oonditionally approve or deny an exempl.ion. An
application lor exemption musl satisly, at a n-rininrum, all oIthe review criteria liste<J below.
Conrpliance with the review criteria, however, cloes not ensLrre exemption. The Board also may
consider adclitional lactors listed in Section tl:60 ol the Srrbdivision Regulations.
No more than a total of lour (4) lol"s, parcels, interests or dwelling units will be created
from any parcel, as that. parcel was describecl in the records of the Garhekl County
Clerk and Recorder's Olllce on January l, 1973, and is not a part of a recor<Jed
subdivision, ltowever, any parcel to be dividecl by exemption that is split by a public
right-of-way (State or Federal highway, County road or railroad) or natural feature,
preventing joint use o[ the proposecl tracts, and the <]ivision occurs along the public
right-of-way or naturitl l-eature, srrch parcels thereby createcl may, at the cliscretion of
the Boarcl, not be considered to have been createcl by exemption with regard to the four
(4) lot, parcel, interest or clwelling unit limitation otherwise applicable;

B.ThePlanning Division shall review theexemption request forcompleteness within eight
(tt) days of submittal. If incomplete, the application shall be withdrawn from
consideration and the applicant notified of the additional inlormation needed. Ilthe
application is conrplete, the applicant shall be notihed in writing of the time and place
of the Board of County Comnrissioners meeting at which the request shall be
considered. In either case, notil-rcation shall occur within I'rlteen (15) days of submittal.
Notice of the public nreeting shall be mailed by certi{ied nrail, return receipt requested,
to owners of record olland immediately adjoining and within 200 feet of the proposed
exemption, to mineral owners and lessees ol mineral owners of record of the land
proposed lor exemption, and to tenants of any structure proposed for conversion. the
exemption site shall be posted clearly and conspicuously visible lrom a public right-of-
way with notice signs provided by the Planning Division. All notices shall be mailed at
least filteen (l 5) and not more than thirty (30) days prior to the meeting. The applicant
shall be responsible lor mailing the notices and shall present proof ol mailing at the
meel"ing.
At or within filteen (15) days ol the meeting, the Board shall approve, conditionally
approve or deny the exemption recluest. The reasons for denial or any conditions of
approval shall be set lorth in the minutes of the meeting or in a written resolution. An
applicant denied exemption shall lollow the subdivision prooedure in these regulations.

Esteemed Commissioners:
Please find enclosed a Petition for Exemption of a land subdivision on upper No Name. It is
proposed that parcel 002 which consists of l7 acres be divided into four parcels of approximately
four acres each. The application is for three homesites. Lot 4 (see map) is not suitable for a
homesite in itself, but is thought to be of value to the landowner to the north (Pat and Archie
winter) and its designation as a separate parcel is therefore requested.

WHEREAS, the above-named decedent in her lifetime made and executed her Last Will
and Testament dated July 18, 1988, which Will was duly admitted to informal probate on July
17, L990, and admitted to formal probate on September 24, 1990, by the District Court in and

features are not favorable for the indicated use and special planning, design, or maintenance is needed to overcome or
minimize the Iimitations; and "severe" if soil properties or site features are so unfavorable or so difficult to overcome
that special design, significant increases in construction costs, and possibly increased maintenance are required.Ihis report also shorrs the suitability of the soils for use as daily cover for landfills. A rating of "Good'; indicates
that soil properties and site features are favorable for the use and good perfornance and lon maintenance can be
expected; "tair" indicates that soil properties and site features are moderately favorable for the use and one or
more soil properties or site features make the soil less desirable than the soils rated "Good"; and'poor" indicates
that one 0r IIr0re soil properties or site features are unfavorable for the use and overcoming the unfavorableproperties requires special design, extra maintenance,0r costly alteration.
SEPIIC IAi{I( ABS0RPTI0i{ FIELDS are areas in rhich effluent fron a septic tank is distributed into the soil through
subsurface tiles or perforated pipe. 0nly that part of the soil betteen depths of ?4 to 7? inches is evaluated. Ihe
ratings are base on soil properties, site features, and observed performance of the soils. permeability, a highrater table, depth to bedrock or to a cemented pan, and flooding affect absorption of the effluent. Large stones
and bedrock or a cemented pan interfere rith installation. Unsatisfactory performance of septic tank absorption fields,
including excessively slor absorption of effluent, surfacing of effluant, and hillside seepage, can affect public health.
Groundxater can be polluted if highly permeable sand and gravel or fractured bedrock is less than 4 feet belor the
base of the absorption field, if slope is excessive, or if the nater tabie is near the surface. Ihere must be
unsaturated soil material beneath the absorption field to filter the effluent effectiveiy. I'tany local ordinances
require that this material be of a certain t,hickness.
SEI{AGE LAGO0|{S are shallor ponds constructed to hold serage rhile aerobic bacteria decompose the solid and liquidl{astes, Lagoons should have a nearly level floor surrounded by cut slopes or embankments of compacted soil. Lagoonsgenerally are designed to hold the serage nithin a depth of 2 to 5 feet. Nearly impervious soil material for thi tagoonfloor and sides is required to minimize seepage and contamination of ground rater. Ihis report gives ratings for
the natural soil that makes up the lagoon floor. The surface layer and, generally, I or 2 feet of soil material
belon the surface layer are excavated to provide material for the embankments. Iire ratings are based on soilproperties, site features, and observed performance of the soils. Considered in the ratings are slope, permeability, a
high nater table, depth to bedrock or to a cemented pan, flooding, large stones, and content of organic matter.
Excessive seBpage due to rapid permeability of the soil or a tater table that is high enough to raise the level of setagein the lagoon causes a lagoon to function unsatisfactorily. Poilution results if seepage is excessive or if floodnater
overtops the lagoon. A high content of organic matter is detrimental to proper functioning of the lagoon because itinhibits aerobic activity. Slope, bedrock, and cemented pans can cause construction problems, and laige stones can
hinder compaction of the lagoon floor.
SAfIIIARY tAfIDFILLS are areas nhere soiid raste is disposed of by burying it in soil, There are tro types of landfill,
trench and area. In a trench Iandfilt, the naste is placed in a trench. It is spread, compacted, and covered dailyxith a thin layer of soil excavated at the site. In an area landfill, the naste is placed in successive layers on the
surface of the soil. The uaste is spread, compacted, and covered daily nith a thin iayer of soil form a source aray
from the site. Both types of landfill must be able to bear heavy vehicular traffic. -Both
types involve a risk ofgrounduater pollution. Ease of excavation and revegotation need to be considered. The ratings in this report are based

highly organic Iayers, soil reaction, and content of salts and sodium affect trench type landfills. Unless otherrise
stated, the ratings apply only to that part of the soil nithin a depth of about 6 feet. For deeper trenches, a
limitation rate "Slight" or "l{oderate" may not be valid. Onsite investigation is needed.
OAILY C0VER FOR LA}{DFILL is the soil rnaterial that is used to cover compacted solid xaste in an area type sanitary
landfill. The soil material is obtained offsite, transported to the landfill, and spread over the raste.
Soil texture, retness, coarse fragments, and slope affect the ease of removing and spreading the naterial during ret
and dry periods. Loamy or silty soils that are free of large stones 0r excess gravel are the best covar for a
landfill. Clayey soils nay be sticky or cloddy and are difficult to spread; sandy soils are subject to soil
bloring. After soil naterial has been removed, the soil material ramaining in the borron area must be thick enough
over bedrock, a cemented pan, or the nater table to permit revegetation. Ihe soil material used as final cover for a
landfill should be suitable for plants. Ihe surface layer generally has the best norkabilityn more organic rlatter than
the rest of the profile, and the best potential for plants. l,laterial frorr the surface layer should be stockpiled for uss
as the final cover.

This report gives estimates of various soil features. Ihe estimates are used in land use pianning that involves
engineering considerations.
Depth to bedrock is given if bedrock is nithin a depth of 5 feet. The depth is based on many soil borings and on
observations during soil mapping. Ihe rock is either "Soft" or "tlard". If the rock is "soft" or fractured, excavations
can be made nith trenching machines, backhoes, or small rippers. If the rock is "Hard" or massive, blasting or
special equipment generally is needed for excavation.
Cemented pans are cemented or indurated subsurface layers nithin a depth of 5 feet. Such pans cause difficulty in
excavation. Pans are classified as "Thin" or "Thick". A "Ihin" pan is Iess than 5 inches thick if continuously
indurated or less than l8 inches thick if discontinuous or fractured. Excavations can be made by trenching machines,
backhoes, or small rippers. A "Thick" pan is rnore than 3 inches thick if continuousiy indurated or trr0re than 18
inches thick if discontinuous or fractured. Such a pan is so thick or massive that blasting or special equipment is
needed in excavation.
Subsidence is the settlement of organic soils or of saturated mineral soils of very lott density. Subsidence
results from either desiccation and shrinkage or oxidation of organic material, or both, folloning drainage'
Subsidence takes place gradually, usually over a period of several years. This report shows the expected initial
subsidence, nhich usually is a result of drainage, and total subsidence, rhich usually is a result of oxidation' llot

an extensive area as a result of lorering the water table.

action occurs when moisture moves into the freezing zone of the soil. Iemperature, texture, density, permeability,
content of organic matter, and depth to the water tabie are lhe most important factors considered in evaluating the
potential for frost action. It is assumed that the soil is not insulated by vegetation or sno* and is not artificially
drained, Silty and highly structured clayey soils that have a high naler tabie in Hinter are the most susceptible to

strength during thaning cause damage mainly to pavements and other rigid structures.
Risk of corrosion pertains to potential soil-induced electrochemical or chemical action that dissoives or neakens
uncoaled steel or concrete. The rate of corrosion of uncoated steel is related to such factors as soil moisture,
particle-size distribution, acidity, and electrical conductivity of the soil. The rate of corrosion of conffete
is based mainly on the sulfate and sodiurn content, texture, moisture c0ntent, and acidity of the soil. Special
site examination and design may be needed if the combination of factors creates a severe corrosion environment. The steei
installations that intersect soil boundaries or soil Iayers is more susceptible to corrosion than steel in
installations that are entirely nithin one kind of soil or nithin one soil layer. For uncoated steel, the risk of
corrosion, expressed as "Lou", "floderate", or "High", is based on soil drainage class, total acidity, electrical
resistivity near field capacity, and electrical conductivity of the saturation extract.

Ascalon-Pena complex, 6 to 25 percent slopes
Ihese soils are on sides of valleys and alluvial fans.
Ihe soils formed in alluvium derived from sandstone and
shale, Ascalon soil makes up about 55 percent of the
complex, and Pena soil makes up about 25 percent. Ihe
Ascalon is on the less sloping, somerhat concave parts
of the iandscape, and the Pena soil is on the steeper,
convex parts.
The Ascalon soil is deep and rell drained. Ihe surface
Iayer is fine sandy loam about 5 inches thick, Ihe
subsoil is sandy clay loam about 30 inches thick, Ihe
substratum is sandy clay Ioan to a depth of 60 inches.
Permeability is moderate, and available rlater capacity
is moderate. Effective rooting depth is 60 inches.
Runoff is medium, and the erosion hazard is moderate.
Ihe Pena soil is deep and tell-drained. The surface
layer is about t2 inches thick. Ihe upper part is
stony loam, and the loter part is very stony loam, The
substratum is very stony sandy loarr to a depth of 60
inches. Permeability is moderate, and available later
capacity is lon. Effective rooting depth is 60 inches.
Runoff is slow, and the erosion hazard is moderate.
Iorriorthents-Rock 0utcrop complex, Steep
Ihis broadly defined unit consists of exposed sandstone
and shale bedrock and stony soils that are shallor to
moderately deep over sandstone and shale and stony
basallic alluvium, Torriorthents make up about 60
percent of this complex, and Rock outmop makes up
about 25 percent. Ihe Iorriorthents are on foothills
and mountainsides belor the Rock outcrop.
Torriorthents are very shallotl to moderately deep.
They are rell to somenhat excessively drained, They
generally are clayey to loamy and contain variable
amounts of pebbles, cobbles, and stones. Permeability
is slon to moderate, and nater holding capacity is very
lotr to lou. Effective rooting depth is l0 to 40
inches. Runoff is very rapid, and erosion hazard is
very high.

This reoort gives inforrration about the soils as a source of roadfill. sand, gravel, and topsoil. Ihe soils are rated
"Good", ''tair", or "Poor" as a s0urcB of roadfill and topsoil. They are rated as a "Probable" or "lnprobable"
source of sand and gravel, Ihe ratings are based on soil properties and site features that affect the renoval of the
soil and its use as construction material. l{ormal compaction, minor processing, and other standard construction
practices are assumed. Each soil is evaluated to a depth of 5 or 6 feet.
Roadfill is soil material that is excavated in one place and used in road embankments in another place. In this report,
the soils are rated as a source of roadfill for lotl embankments. generally Iess than 6 feet high and less
exacting in design than higher embankments. Ihe ratings are for the soil materiai belon the surface layer to a
depth of 5 or 5 feet. It is assumed that soil Iayers will be mixed during excavating and spreading. l'lany soils have
layers of contrasting suitabiiity rithin their profile. Ihe report entitled Engineering Index Properties is also available
and it provides detailed information about each soil layer. This information can help determine the suitability of each
Iayer for use as roadfiil. Ihe performance of soil after it is stabilized nith lime or cerRent is not considered in
the ratings.
Ihe ratings are based on soii properties. site features, and observed performance of the soils. The thickness of
suilable material is a major consideration. Ihe ease of excavation is affected by Iarge stones, a high water table,
and slope. llow ttell the soil performs in place after it has been compacled and drained is determined by its strength (as
inferred from the engineering classification of ihe soil) and shrink-srlell potentiai.
Soils rated "Good" contain significant amounts of sand or gravel or both. They have at least 5 feet of suitable
material, a 10n shrink-stell potential, fen cobbles and stones, and slopes of l5 percent or Iess. Depth to the
nater table is more than 3 feet
Soils rated "Fair" are more than 35 percent silt- and clay-sized particles and have a plasticity of less than 10.
They have a moderate shrink-snell potential, slopes of 15 to 25 percent, 0r many stones. Depth to the nater table is 1
to 3 feet.
Soils rated"Poor" have a plasticity index of more than 10, a high shrink-snell potential, tnany stones, or slopes of
more than 25 percent. Ihey are ret, and the depth to the rater table is less than I foot. These soils may have
Iayers of suitable material, but the material is less than 3 feet thick.
Sand and gravel are natural aggregates suilable for commercial use rtith a minimum of processing. Sand and
gravel are used in many kinds of construction. Specifications for each use vary widely. In this report only
the probability of finding material in suitable quantity is evaluated. Ihe suitabitiiy of the material for specific
purposes is not evaiuated, nor are factors that affect excavation of the material. The properties used to evaluate
the soil as a source of sand or gravel are gradation of grain sizes (as indicated by the engineering classification
of the soil), the thickness of suitable material, and the c0ntent of rock fragments. l(inds of rock. acidity, and
stratification are given in the soil series descriptions. Gradation of grain sizes is given in the Engineering Index
Properties report.
A soil rated as a "Probable" source has a layer of clean sand and gravel or a layer of sand or gravel that contains
up to i2 percent silty fines. This material must be at Ieast 3 feet thick and less than 50 percent, by weight, Iarge
stones. AII other soils are rated as an "lmprobable" s0urce. Coarse fragments of soft bedrock. such as shale and
siltstone, are not considered to be sand and gravel.

affected by toxic material and by such properties as soil reaction, available tater capacity, and fertility. Ihe ease
of excavating, Ioading, and spreading is affected by rock fragrnents, slope, a rater table, soil texture, and thickness
of suitable material. Reclamation of the borrott area is affected by slope, a tater tabie, rock fragnents, bedrock,
and toxic material.
Soils rate "Good" have friable loamy material to a depth of at leasi 10 inches, Ihey are free of stones and cobbles,
have little or no gravel, and have slopes of Iess than 8 percent. They are lor in content of soluble salts, are
naturally fertile or respond tlell to fertilizer, and are not so net that excavation is difficult.
Soils rated "Fair" are sandy soils, Ioamy soils that have a relatively high content of clay, soils that have only 20
to 40 inches of suitable material, soils that have an appreciable amount of gravel, stones, or soluble salts, or
soils that have slopes of 8 to 15 percent. The soils are not so net that excavation is difficult.
Soils rate "Poor" are very sandy or clayey, have less than 20 inches of suitable material, have a large amount of
gravel, stones, or soluble salts, have slopes of more than 15 percent, or have a seasonal nater table at or near the
surface. The surface layer of most soils is generally preferred for topsoil because of it organic matter content,
0rganic matter greatly increases the absorption and retention of moisture and nutrients for plant grotth.

Dear Mr. McCafferty:
This letter is to inform you that as of April 8, 1996 the land in question will no longer belong to
Jack Larsen. On that date my purchase of the land will be final and, therefore, the documents
should address the "Weaver Subdivision Exemption". I would appreciate it if you would send me
a revised subdivision notice.
I would, once again, like to clarify the subdivision proposal. The application is for division of the
land ( 1 7 acres) into four parcels of approxim ately 4 .25 acres each. Only three of these parcels ( I ,
2 and 3) are to be designated as lots. The more Northly parcel (parcel 4) is not suitable for a
building site but is of value to the landowner to the North (Daniel & Velda Flinn).
