(1973) secrion 30-2g-101 (10)(a)-(d) as amended, and Sections 2.02.01-(d) and 3.02.OL of the Subdivision Regulations of. Garfiel-d county, co1-orado, adopted January 2, Lg7g, as amended, the undersigned James D. tlaters and Veda K. Waters respectfully petition the Board of County Commissioners of Garfield County, Colorado to exempt by resolution the division of a 10 acre tract of land into 3 tracts of approximately 3.33 acres each, more or less, fron the definitions of "subdivisiontt and 'rsubdivided land" as the tems are used and defined in c.R.S. (1973) Section 30-28-101(a)-(d) and the Garfield County Subdivlsion Regulations, for the reasons stated below: 1. one of the newly created parcels will be conveyed to James D. waters, one of the parcels will- be conveyed to veda K. waters, and the thtrd newly created parcel wil-l be conveyed to a trust for the benefit of the children of the watersr, namely: Jason Lee waters, Jennifer Ann Waters, and Andrew Ty Waters. 2. The new parcels wil-1 meet a1-1 requirements of the appl-icabJ-e zone dLstrict. 3. The parcels proposed to be created will be consistent with all other tracts in the area, rn support of this Petitl-on, the petltloners also submit the f ol-lowing: OF COI]NTY 1981. Box 640 Glenwood Springs Courthouse , co 81602 Re: Waters' Petition for Subdivision Exemption Dear Art: I visited with you a few days ago about the possibility of exempting from subdivision the creation of three parcels from a ten acre tract in Spring Va1]ey. I have discussed your comments with the tr{aters, ov/ners of the subject property. Oue to their concern that giving only one child rights in one of the subdivided parcets might cause controversy among the siblings when they get o}der, they have elected to petition the commissioners on the basis that the third parcel will be conveyed to a trust for the benefit of all three children. I .ppt""i.te your concern regarding the potential for a judicial partition (thus subverting the subdivision process) but believe that this concern can be aleviated by an appropriate limitation in the trust agreement, combined with a deed restriction, which would prohibit partition and require that at such time as the beneficiaries are to receive distribution of the trust assetsr the parcel held in trust must be sold as a complete parcel and may not be subject to judicial or voluntary partition. I"Iy review of the 1aw applicable to partition suggests that this type of limitation in the trust instrument and in the deed has been universally enforced. I would appreciate your comments in this regard. The Waters have proceeded to file the petition in the form enclosed, but would be happy to consider any adjustments which you deem necessary to protect the County's concerns in this regard.
