PETITION FOR EXEMPTION
Pursuant ro c.R.s. (1973) secrion 30-2g-101 (10)(a)-(d) as amended,
and Sections 2.02.01-(d) and 3.02.OL of the Subdivision Regulations of.
Garfiel-d county, co1-orado, adopted January 2, Lg7g, as amended, the
undersigned James D. tlaters and Veda K. Waters respectfully petition the
Board of County Commissioners of Garfield County, Colorado to exempt by
resolution the division of a 10 acre tract of land into 3 tracts of
approximately 3.33 acres each, more or less, fron the definitions of
"subdivisiontt and 'rsubdivided land" as the tems are used and defined in
c.R.S. (1973) Section 30-28-101(a)-(d) and the Garfield County Subdivlsion
Regulations, for the reasons stated below:
1. one of the newly created parcels will be conveyed to James D.
waters, one of the parcels will- be conveyed to veda K. waters, and the
thtrd newly created parcel wil-l be conveyed to a trust for the benefit
of the children of the watersr, namely: Jason Lee waters, Jennifer Ann
Waters, and Andrew Ty Waters.
2. The new parcels wil-1 meet a1-1 requirements of the appl-icabJ-e
zone dLstrict.
3. The parcels proposed to be created will be consistent with all
other tracts in the area,

(e) The sewage disposal needs of each parcel shal-l be served by an
individual septic system.
(f) No Live stream crosses or adjoins the subject property uaking
flood plain information unnecessary.
(g) SoiL conservation analysis of soil types and characteristics.
(h) Fee in the std of $60.00.

Re: Waters' Petition for Subdivision Exemption
Dear Art:
I visited with you a few days ago about the possibility
of exempting from subdivision the creation of three parcels
from a ten acre tract in Spring Va1]ey. I have discussed
your comments with the tr{aters, ov/ners of the subject property.
Oue to their concern that giving only one child rights in one
of the subdivided parcets might cause controversy among the
siblings when they get o}der, they have elected to petition
the commissioners on the basis that the third parcel will be
conveyed to a trust for the benefit of all three children. I
.ppt""i.te your concern regarding the potential for a judicial
partition (thus subverting the subdivision process) but
believe that this concern can be aleviated by an appropriate
limitation in the trust agreement, combined with a deed
restriction, which would prohibit partition and require that
at such time as the beneficiaries are to receive distribution
of the trust assetsr the parcel held in trust must be sold as
a complete parcel and may not be subject to judicial or
voluntary partition. I"Iy review of the 1aw applicable to
partition suggests that this type of limitation in the trust
instrument and in the deed has been universally enforced. I
would appreciate your comments in this regard.
The Waters have proceeded to file the petition in the
form enclosed, but would be happy to consider any adjustments
which you deem necessary to protect the County's concerns in
this regard.

PETITION FOR E)GMPTION
Pursuant to c.R.s. (1973) secrion 30-28-t-01 (10)(a)-(d) as amended,
and Sections 2.02.01-(d) and 3.02.01 of the Subdivision Regul-ations of.
Garfiel-d county, col-orado, adopted January 2, Lg7g, as amended, the
undersigned James D. I{aters and Veda K. I.Iaters respectfully petition the
Board of County Commissioners of Garfield County, Colorado to exempt by
resoLution the division of a 10 acre tract of l-and into 3 tracts of
approximately 3.33 acres each, more or 1ess, from the definitl-ons of
rrsubdivision" and 'rsubdivided land" as the terms are used and defined in
C.R.S. (1973) Section 30-28-L01(a)-(d) and the Garfield County SubdivisLon
Regulations, .for the reasons stated below:
1. One of the newly created parcels will be conveyed to James D.
waters, one of the parcels w111 be conveyed to Veda K. waters, and the
third newly created parceJ- will be conveyed to a trust for the benefl-t
of the children of the watersr, namely: Jason Lee waters, Jennifer Ann
Waters, and Andrew Ty Waters.
2. The new parcels will neet all requirements of the appllcable
zone district.
3. The parcel-s proposed to be created will be conslstent with all
other tracts in the area.
In support of this Petitlon, the petltioners al_so submit the
following:
(a) Map drawn to scale showing the proposed 1ot subdivLsioir and
access.
(b) Copy of deed to petitioners and proposed deeds frorn petitionersto the trust for thei-r children.
(c) VicinLty map.
(d) Domestic water for the three proposed parcels will be supplied
by a domestic wel-l- currently located on the subject property,
which weLl is adjudicated for .055 cubic foot of water per
second of time with appropriation date of December 3L, L976,
as rDore ful1y set forth in the Ruling of the Referee attached
hereto.
(e) The sewage disposal needs of each parcel- shall be served by an
individual- septic system.
(f) No live stream crosses or adjoins the subject property rnaking
flood plain Lnforrnation unnecessary.
