HomeMy WebLinkAbout3.0 Correspondence• • GARFIELD COUNTY Building and Planning October 15, 1996 Mr. Wesley Kent 4289 County Road 215 Parachute, CO 81635 RE: Weldon Subdivision Exemption Approval Dear Wesley, On Monday, October 14, the Garfield County Board of Commissioners conditionally approved Mr. Weldon's petition for an exemption from the definition of subdivision. The conditions that must be met prior to final approval are as follow: 1. That all representations of the applicant, either within the application or stated at the meeting, before the Board of County Commissioners, shall be considered conditions of approval. 2. A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of the proposed lots, access to a public richt-of-way, and any proposed easements for setbacks, drainage, irrigation, access or utilities. 3. That the applicant shall have 120 days to present a plat to the Commissioners for signature, from the date of approval of the exemption. The Board may grant extensions of up to one (1) year from the original date of approval. That the applicant shall submit $200.00 in School Impact Fees, for the creation of the exemption parcel, prior to authorization of an exemption plat. 5. That the following plat notes be included: "The minimum defensible space distance shall be 30 feet on level terrain, plus appropriate modification to recognize the increased rate of fire spread at sloped sites. The methodology described in "Determining Safetv Zone Dimensions, Wildfire Safety Guidelines for Rural Homeowners," (Colorado State Forest Service) shall be used to determine defensible space requirements for the required defensible space within building envelopes in areas exceeding five (5) percent grade." "Upon adoption of road impact fees by the Board of County Commissioners, the lots created by this exemption shall be subject to paying the fees, paid at time of building permit application, paid by the building permit applicant." 109 8th Street, Suite 303 945-8212/285-7972 Glenwood Springs, Colorado 81601 • • "Soil conditions on the site may require engineered septic systems and building foundations. Site specific percolation tests at the time of building permit submittal shall determine specific ISDS needs on the site." "The individual lot owners shall be responsible for the control of noxious weeds." "The Department of Energy (DOE) monitors groundwater under this property and it is suggested that any lot owner contact the DOE to obtain this information." That the recording fees for the exemption plat and all associated documents be paid to the County Clerk and Recorder prior to the signing of an Exemption Plat by the Board of County Commissioners and a copy of the receipt be provided to the Planning Department. 8. That the exemption plat submittal include a copy of a computer disk of the plat data, formatted for use on the County Assessor's CAD system. That all proposed lots shall comply with the Garfield County Zoning Resolution of 1978, as amended, and any building shall comply with the 1994 Uniform Building Code, as adopted. 10. The applicant shall consult with Road and Bridge and receive any required driveway permits, prior to final approval. 11. The applicant shall adhere to all provisions of the letter submitted by the Grand Valley Fire Protection District, dated August 21, 1996. 12. Prior to final approval, the appropriate well permit shall be issued by the Division of Water Resources; the flow from the spring shall be gauged by a qualified individual: and a legal, well sharing declaration shall all be submitted to the Planning Department for review. 13. The Board finds that County Road 338 does create a sufficient impediment to joint use of the tract and the approval of this exemption petition is based on such finding. 14. That the following provisions be included in the protective covenants governing the exemption parcels: One (1) dog will be allowed for each residential unit within an exemption and the dog shall be required to be confined within the owner's property boundaries, with enforcement provisions allowing for the removal of a dog from the area as a final remedy in worst cases. No open hearth solid -fuel fireplaces will be allowed anywhere within an exemption. One (1) new solid -fuel burning stove as defined by C.R.S. 25-7-401, et. seq., and the regulations promulgated thereunder, will be allowed in any dwelling unit. All dwelling units will be allowed an unrestricted number of natural gas burning stoves and appliances. • • All exterior lighting shall be the minimum amount necessary and that all exterior lighting be directed inward, towards the interior of the subdivision, except that provisions may be made to allow for safety lighting that goes beyond the property boundaries. Its legal description is Lot 11, Section 25, Township 7 South, Range 95 West of the Sixth P.M. More commonly known as "Rulison Blast Site." A copy of my deed is enclosed. In 1993, I entered into an agreement with Forrest Service and Garfield County granting easement to same to be used for public access, officially making it a county road. By doing so, the road now divides my 40 acres parcel into two parcels. I have enclosed an area map for your review showing 073 as my 40 acre parcel. I hereby respectfully submit my Petition for Exemption from subdivision regulations granting me permission to sell the portion of my property which lies West of the public access road. Subject to Board approval, a detailed survey will be performed. At this time, my best guess would be at least 5 acres and no more than 15 acres would be involved. Attached is my well permit application form, a copy of my deed, plans and specifications of the well, a site schematic diagram, and the $60 filing fee. The well is hand dug and the resultant well head contains no big hole that will present a health and safety problem. An area around the wellhead, about 600 square feet, will be fenced off to prevent livestock and wildlife from fecally contaminating the domestic water supply. At the present, there is a cement spring box that protects immediate source. The current system precludes the potential for mixing of groundwater with surface water. In the course of doing the survey work for Mr. Weldon I have ran into bad weather and a surveying situation that is delaying the final subdivision exemption plat. Corners that should have been in place we have been unable to find. We are trying to resolve this situation by coming to Boundary Line Agreements with adjoining property owners so that we may complete this plat. I would like to request this extension on behalf of my clients' since this situation is out of their control and is directly related to our survey work. I do not have an exact time frame for completion but we are hoping to have all matters resolved by the end of October, 1997.
