GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) 30-28-101 (10) (a)- (d)
as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September l, L972 and amended
April L4, 1975, Section L.O2.L7 (d) and 3.02.01 the under-
signed attorney for Petitioners respectfully petitions the
Board of County Commissioners of Garfield County, Colorado,
to exempt by resolution the conveyance of two tracts of land
based on the following facts:
I. Petitioners are each the owners of tracts of
land located in Garfield County, Colorado, more particularly
described in Exhibit A attached hereto and made a part
hereof.
2. The parcels of land are contiguous.
3. It would be to the mutual advantage of the
Petitioners to al1ow Petitioners Robert E. Hardy and Maureen B.
Hardy to convey to Petitioner David Waller Dangler a portion
of their tract of land containing 2.79 acres, more or 1ess,
(Parcel A depicted on Exhibit B, attached hereto and made a
part hereof) and for David Waller Dangler to convey to
Robert E. Hardy and Maureen B. Hardy a portion of his tract
of land containing 3.51 acres, more or less (Parcel B
depicted on Exhibit B).
4. The descriptons of the parcels requested to be
conveyed hereunder are set forth on Exhibits C and D at-
tached hereto and made a part hereof.
5. Subsequent to the conveyances herein requested
to be made, the same shall be merged into the titles of the
remaining tracts of the respective Petitioners herein and
shaII not thereafter be conveyed separate and apart there-
from without approval being first obtained as required by
State statutes and Garfield County Resolution.
6. The conveyances will allow each of the Petitio-
ners a greater use, utility and enjoyment of their respec-
tive properties.
7. No separate use will be made of the parcels
requested to be conveyed, therefore, no water or sewage
disposal will be necessary.
8. No drainage problems will be created by the
conveyances inasmuch as the use of the land will not change;
paper title only to the respective parcels will change.
9. Fee in the amount of $56.00 is enclosed.
WHEREFORE, it is requested that the above de-
scribed conveyances be exempted from the defintions of
"subdivision" and "subdivision Iand" as the terms are used
and defined i-n C.R.S, L973, 30-28-101 (a)- (d) and the
Garfield County Subdivision Regulations.
