BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. 79-27
WHEREAS, Robert E. Hardy, Maureen B. Hardy and David Wallen Dangler
have petitioned the Board of County Commissioners of Garfield County,
Colorado, for an exemption from the definition of the terms "subdivision"
and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a) -(d), as
amended, and the Subdivision Regulations of Garfield County, Colorado;
adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division
of a 6.30 acre tract described as follows: a parcel of land situated in
Sections 13 and 14, T.7S., R. 88W. of the 6th P.M. into 2 tracts of
approximately 2.79 and 3.51 acres each, more or less, which proposed
divided tracts are more particularly described as follows:
Tract A: Aparcel of land situated in the W,SW4 of Section13,
Township 7 South, Range 88 West of the Sixth Principal Meridian, said
parcel of land is described as follows:
Beginning at the West Quarter Corner of said Section 13, thence N. 890
29'59" E., 112.90 feet along the East-West Centerline of said Section to
a rebar and cap in place; thence South 751.43 feet to an old spike in place,
the True Point of Beginning; thence East 114.41 feet to a rebar and cap
in place; thence S. 01042'31 E., 697.18 feet whence a rebar and cap set
for a witnesscorner bears N. 01042'31" E., 60.00 feet; thence S. 14046'19
W. 530.24 feet to a rebar and cap in place; thence North 1209.59 feet to
the True Point of Beginning. The above parcel of land contains 2.79 acres
more or less.
Tract B: A parcel of land situated in the SE4NE4 and NE4SE4 of 'Section 14,
and in the NW4SW4 of Section 13, all in Township 7 South, Range 88 West of
the Sixth Principal Meridian, lying Easterly of a 60 foot road as con-
structed and in place, said parcel of land is described as follows:
Beginning at the Quarter Corner common to said Sections 13 and 14, thence
N. 89029'59"-E., 112.90 feet along the East-West centerline of said Section 13
to a rebar and cap in place; thence 'South 60.00 feet to a rebar and cap in
place; thence S. 89029'59" W., 110.30 feet to a point on the Section line
common to said Sections 13 and 14; thence N. 89°45'47"-W., 623.25 feet to a
rebar and cag`in place on the Easterly line of said 60 foot road easement;
thence N. 49 07'04" W. 92.06 feet along the easterly line of said 60 foot
road easement to a rebar and cap in place; thence North 384.83 feet to a
rebar in place; thence S. 55004'00" E., 676.06 feet to a pin on the East-
West centerline of. said Section 14; thence S. 89045'47" E. 136.00 feet
along the East-West centerline of said Section 14 to the Quarter Corner common
to said Sections 13 and 14, the point of beginning. The above described
parcel of land contains 3.51 acres more or less in the State of Colorado and
County of Garfield; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the
Board of County Commissioners of Garfield County,. Colorado, that the
proposed division does not fall within the purposes of'Part.1, Article 28,
Tital 30, Colorado Revised Statutes 1973, as amended,.for the reason that
the exemption is to straighten property line boundaries.
