RESOLUTION
WHEREAS, JUANITA R. WILLIAMS, has petitioned the Board
of County Commissioners of Garfield County, Colorado, for an
exemption under C.R.S. (1973) Section 30-28-101 (10) (a) -
(d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September 1, 1972 and amended
Arpil 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the
division of a 27.21 acre tract of land into two tracts of
13.105 acres, more or less, which two tracts are described
as follows:
TRACT I
A parcel of land situated in Lot 6 and in the Meander Land
of Section 7, Township 6 South, Range 91 West of the Sixth
Principal Meridian, County of Garfield, State of Colorado,
(said Meander Land as mapped October 1886), said parcel of
land lying Southeasterly of the Centerline of the Colorado
River and Westerly of the North-South Centerline of said
Section 7, described as follows:
Beginning at a point on the North-South Centerline of said
Section 7 whence the reestablished Quarter Corner on the
Northerly line of said Section 7 bears: N. 00°38'30" W.
2004.49 feet; thence N. 50°54'13" W. 1126.61 feet to a point
in the center of said river; thence N. 51"56'31" E. along
the center of said river, 699.10 feet, to a point on the
Northerly line of said Meander Land; thence N. 89°15'00" E.
140.37 feet along said Meander Land; thence N. 58°30'00" E.
along said Meander Land, 198.86 feet, more or less to a
point on the North-South Centerline of said Section 7,
thence S. 00°38'30" E. along the North-South Centerline of
said Section 7, 1247.26 feet, more or less to the point of
beginning.
The above described parcel of land contains 13.105 acres,
more or less.
TRACT II
A parcel of land situated in Lot 6 and in the Meander Land
of Section 7, Township 6 South, Range 91 West of the Sixth
Principal Meridian, County of Garfield, State of Colorado,
(said Meander Land as mapped October 1886), said parcel of
land lying Southeasterly of the Centerline of the Colorado
River, described as follows:
Beginning at a point on the North-South Centerline of said
Section 7, whence the reestablished Quarter Corner on the
Northerly line of said Section 7 bears: N. 00°38'30" W.
2004.49 feet; thence S. 88°11'36" W. 1241.64 feet to a point
on the Southerly line of the Meander Land; thence S. 69°10'00"
W. 64.08 feet along said Meander Land; thence N. 0039'56"
W. 434.52 feet to a point on the center of said river;
thence N. 51°56'31" E. 548.16 feet along the center of said
river; thence S. 50°54'13" E. 1126.61 feet, more or less to
the point of beginning.
The above described parcel of land contains 13.105 acres,
more or less.
WHEREAS, the Petitioner has shown to the satisfaction
of the Board of County Commissioners of Garfield County,
Colorado, that she desires said exemption for the purpose of
re -sale into single-family residential acreage; and,
WHEREAS, the Petitioner has demonstrated to the satisfaction
of the Board that there is a reasonable probability of
locating domestic water on each of said tracts, that there
is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the Colorado
Department of Health, that the requested division is in
accordance with the general purposes and intent of the
Subdivision Regulations of the State of Colorado and the
County of Garfield and should, therefore, be exempted from

the definition of the terms "subdivision" and "subdivided
land" as set forth in C.R.S. (1973) Section 30-28-101 (10)
(a) - (d) as amended;
WHEREAS, this Resolution is adopted to fully describe
the two tracts of land referred to in Resolution #77-70, which
resolution was adopted and signed by the Board on August 8,
1977.
NOW, THEREFORE, upon motion of Larry Velasquez seconded
by Flaven Cerise and carried, said 27.21 acre tract of land
is hereby exempted from such definition and transfer of said
tract may be made by division into 2 tracts of 13.105 acres
each, more or less, all as is more fully described above,
and further that no additional exemptions be granted for the
portion of the two above lots which lie generally south and
east of County Road 335. A copy of the instrument or instruments
of conveyance when recorded shall be filed with this Resolution.
