Considering the construction materials to be used, the minimal amount of people who would be on the premise in the event of fire, and the 1500 gallons of water which would be available for fire department use in the event of a fire, the District has approved your request. .As was discussed with you, the District understands that you have additional plans for this property in the future. Prior to approval of these future improvements you will need to contact the District to discuss additional Fire Protection requirements. Box 1368 Carbondale, CO 81623 RE: Weaver Exemption Dear J.W.: On November 15, 1993 the Board of County Commissioners conditionally approved your request for a subdivision exemption. The approval was subject to the filing of an exemption plat and completion of the following conditions: 1. All representations of the applicant shall be considered conditions of approval unless otherwise stated by the applicant. 2. A Final Exemption Plat shall be submitted, indicating the legal description of the property, dimension and area of all proposed lots or separate interests to be created, access to a public right-of-way, and any proposed easements for drainage, irrigation, access or utilities. 3. The applicant shall have 120 days to complete the required conditions of approval. Extensions of 120 days may be granted by the Board for a period of up to one (1) year. 4. The applicant shall submit $200 in School Impact Fees for the creation of each new lot. 5. The following plat note shall appear on the final plat: "Negative health impacts may be experienced due to electro -magnetic radiation form high voltage power lines." 8. Prior to the signing of a final Exemption Plat, a favorable response from the Rifle Fire District shall be received by the Planning Departrnent. Simpson State Engineer Thank you for referral for a subdivision exemption located south of the Garfield County Airport off CR 352 for J.W. Weaver and Larry Amaya. The applicants are requesting to split a 25.90 acre parcel into two parcels of 12.0 and 13.90 acres. The proposed source of water is assumed to be on-site wells. Pursuant to Section 30-28-136(h)(I), C.R.S. 1973, the State Engineer's office offers the following opinion for your consideration regarding material injury to decreed water rights and the adequacy of the proposed water supply. We could issue household use only permits for the two sites. The availability of well permits is subject to the following conditions: 1. The 25.90 acre parcel has not been previously subdivided or exempted since 1972. A copy of a deed showing the 25.90 acre parcel was created prior to 1972 must accompany each well permit application. We consider this a one-time exemption and will not make additional permits available for future splits of either tract. 2. Each well permit will be limited to use inside one single family dwelling only. Outside use for lawn and garden irrigation or livestock will be prohibited. Plat notes and covenants should reflect this limitation. 3. The applicants should provide proof that an evaporative wastewater system will not be required. We could not issue a well permit if any evaporative system is required. 4. Prospective lot purchasers should be made aware of the limitations on water use. Each well permit application must be accompanied by documentation that Garfield County approved the subdivision exemption. We cannot recommend approval of a permit without this documentation. Box 1368 Carbondale, CO 81623 RE: Zone District Amendment - A/R/RD (Agricultural / Residential / Rural Density) to C/L (Commercial / Limited) Dear Mr. Weaver: I have had the opportunity to review your application for rezoning, and have the following comments: • Section 10.01.02 allow a property owner to the change the zone district designation of a specific lot or lots to any other single district designation. The definition of a lot, per Section 2.02.32, is a parcel of land in separate ownership from contiguous lands or defined as an individual lot on a subdivision plat filed of record in the Office of the Clerk and Recorder of Garfield County, Colorado. Your application indicates that you are requesting the rezoning for a 12+acre portion of your lot. According to County records, your parcel is approximately 25.90 acres in size. Based on the above referenced codes, the only option would be to rezone the entire 25+ parcel. • If you did not want to rezone the entire parcel, you would have to create a separate parcel, either through the exemption process or full subdivision. I have included an application for an exemption for your reference. Please contact this office regarding either rezoning the entire parcel, or creating a separate parcel on your property. I wish to rezone approximately 12 acres from agricultural to commercial. This acreage is explained in detail on the enclosed map. If this property is zoned commercial, I plan to build a self - storage facility with indoor and outdoor storage.
