HomeMy WebLinkAbout3.0 Director's Determination 03.08.19Gaffield Coúlnty March 8,2019 Jason Neuman Cappo Properties LLC 3101gth St. Glenwood Springs, CO 81601 DTRECTOR DETERMINATION - Sunlight Parkway Minor Subdivision (File No. MISA-01- 1eì8705) Dear Mr. Neuman: This letter is provided to you, as the applicant for Garfield County File No. MISA-O1-19- g70S, pertaining to Sunlight Parkway Minor Subdivision. This letter is notification that your r"qu"åt to creãte two lots, has been reviewed by the Community Development De'partment and the Director hereby issues a determination conditionally approving the request. The findings: 1. That proper public notice was provided as required for the Administrative Review of the Minor Subdivision. 2. That with the adoption of conditions, the application is in general conformance with the 2030 Comprehensive Plan, as amended. 3. That with the adoption of conditions, the application has adequately met the requirements of the Garfield County Land Use and Development Code, as amended as well as Section 5-301(C) Minor Subdivision approval criteria. The conditions of approval are as follows: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein or unless otherwise modified by the Community Development Director or the Board of County Commissioners. I 2. Final review by the County Community Development Staff and the County Surveyor's Office shall be required and all edits and corrections based on that review shall be completed prior to submittal of the plat for signature by the Board of County Commissioners. 3. The following edits shall be made to the Plat prior to submittal to the County for final review (additional changes or updates may be required as part of the final review): a. The Applicant shall update the following Plat Certificates to reflect the approved language in the Garfield County Resource Guide: Certificate of Dedication and Ownership, County Commissioners Certificate, Acceptance for Recording, and the Surveyor's Certificate. b. The Applicant shall include plat notes A, B, C, D, E, H and K from the Garfield County Resource Guide. c. An access easement shall be shown on Lot 1 for the use of Lot2. d. The Applicant shall include a plat note that states, "A Soils Report addressing hazardous soils, contaminated soils, slopes, geo-hazards and for recommendations for the foundation design shall be required prior to issuance of a building permit." e. Include the history of the previous plats in a plat note similar to: Previously described on the 2nd Amended Plat of Sunlight Parkway as the Sewage Treatment Area recorded as reception number 856617, the 2nd Amended Plat of the Sunlight View Subdivision recorded as reception number 309906, the 1st Amended Plat of Sunlight Parkway recorded as reception number 566968, the Final Plat of Sunlight Parkway recorded as reception number 477155 and the Second Amended Master Plat For the Preserve at Prehm Ranch recorded as reception number 628654, as well as any other previous plats that include this property. 4" The Applicant shall obtain a driveway permit from Garfield County Road and Bridge Department to ensure that both parcels have access to County Road 117 and are built to County standards prior to issuance of a building permit. 5. A plat mylar with signed Certificates that include Dedication and Ownership, Title, Taxes, Surveyor, and any lienholders that hold an interest in the property. 6. Prior to the BOCC signature on the plat, the Applicant shall demonstrate extension of the utilities and access to serve both lots acceptable to Garfield County. 7. lt is recommended that radon-resistant construction practices to prevent radon gas exposure are used in any future dwellings. 8. lt ís recommended that property owners follow "Bear Aware" practices as recommended by Colorado Parks and Wildlife and dog leash laws in Garfield County, 2 g. prior to the BOCC signature on the plat, the Applicant shall obtain an appraisal or other fair market valué by a qualified professional, and using the formula in Section T-404, pay applicable sc-hool land dedication fees for the two lots, as referenced in tnat seðtión of the Land Use and Development Code' 10. prior to the BOCC signature on the plat, the Applicant shall provide a weed management map añd/or inventoried noxious weeds for both parcels' A demonstration of compliance with this condition shall be provided by Garfield County Vegetation Management. 11.A new Tifle Commitment will be required prior to finalization of the plat, previous to recording the approved version, to verify if a certification of a lienholder is required' l2.TheApplicant has 90 days within which to satisfy conditions of approval and- providä the following doiumentation for BOCC signature and provide recording fees. Notice of this decision will be provided to the Board of County Commissioners who has the abil1y to ,call-up' the application for review at a public hearing. You will be notified of the Boaid decision once it'is received or upon expiration of the 10-day notice period.
