I. DESCRIPTION OF THE PROPOSAL
The Applicant has submitted an Administrative Review application for a Minor
Subdivision with a request to subdivide a 16.66-acre parcel into a 7.91-acre and an
B.75-acre parcel. The property was known as the Sewage Treatment Area of the 2nd
Amended Þlat of Sunlþht Parkway. Formerly, there was sewage treatment plant and
building with decommissioned wastewater infiltration lagoons for wastewater treatment.
Both parcels are vacant but have access via County Road 117, either shared or on each
separate lot.
II. DESCRIPTION OF THE SITE
The property is within an area of moderate soil hazard, mudflow, some level areas and
some steep slopes. These will be mitigated as part of the building permit process once
a location i'ras been established, soil tests have been completed and foundations have
been designed for the residences.
Due to the former use of the property, there has been testing on the area by SGM-lnc.
Engineering (included in the application) confirming removal of the effected soils to a
locál landf¡ll.

this process of removal to be thorough and complete. An additional report of the site
was included, from ESI Environmental Services, Inc. to add that their observations and
photos of the decommissioned wastewater infiltration lagoons and the remaining soils
iincluded in the application). Additional inquiries into the Sunlight View Water and
Wastewater resufteà in satisfactory termination of the sewage treatment facility and lift
station.

There are no waiver requests from standards included in the application
IV. AUTHORITY - APPLICABLE REGULATIONS
A. Section 5-301 of the Land Use and Development Code (LUDC), designates the
division of land that creates no more than 3 parcels, is served by a private well or water
supply entity and does not require the extension, construction, or improvement of a
County right-of-way, as requiring Administrative Review.
B. Section 4-103 of the LUDC sets forth the Administrative Review Procedures by
which the current Application is being considered.
C. Article 7 of the LUDC sets forth General approval standards in Division 1 -
General Resource Protection Standards, Division 2 - Site Planning and Development
Standards, Division 3 - Subdivision Standards and Division 4 - Design Specifications.
Minor Subdivisions are also subject to Section 5-301(C) and 5-402(F). The standards
are addressed in the Application submittals and in the Staff Analysis section of the Staff
Report.

V. PUBLIC AND REFERRAL COMMENTS
The Applicant has provided documentation that all required notice mailings have been
completed in accordance with the LUDC. One public comment was received as a result
of the public notice and is in favor of the proposal. Referral Comments received on the
Application are attached as Exhibits and summarized below:
Agency Gomments
A. Garfield County Road and Bridge (Exhibit 7): ldentified that a driveway permit
was issued for the area known as Lot 1. This access will require building a
more perpendicular approach to County Road 117 for it to meet County
standards. Since only one access is allowed per lot per Road & Bridge
comments, Lot 2 will have to either share an access with Lot 1 along with the
appropriate access easements show on the plat or move the lot line to allow
the historical access to be used for Lot 2 which was not permitted and obtain
an approved access permit. (Exhibit 22)
B. Glenwood Springs Fire Department (Exhibit 8): Had no comments on the
application.
C. Garfield'County Building Department (Exhibit 9): lndicated no comments
D. Colorado Geological Survey (Exhibit 10): Has no objection to approval of the
two-lot minor subdivision application as submitted, however they did note
potential issues with potential rock fall and debris flows. Also, the area may
be subject to collapse due to evaporite-related sinkholes. But with a geologic
hazards report and proper evaluation, additional analysis can be available.
E. Colorado Department of Public Health and Environment, Solid Waste and
Materials Management Division (Exhibit 11):
"The facility appears to be the authority of Water Quality Control Division to
approve final closure. Solid waste has no further comments or issues."
F. Garfield County Surveyor (Exhibit 12): Had no comments or corrections
G. Garfield County Vegetation Management (Exhibit 13): lndicated that the
Applicant should supply a weed map and/or inventory for the parcel, as well
as a management plan for any noxious weeds.
H. Garfield County Environmental Health (Exhibit 14): The referral comments
included concerns about stormwater, soils and radon and recommended
testing and mitigation for these issues. The decommissioning of the Sunlight
View Wastewater Treatment Facility and associated lift station was
mentioned and indicated compliance with local, federal and state regulations.

lndicated concern for the construction of the access driveway, soils concerns
because of the steep slope and would like more information on drainage and
erosion. Landscaping is recommended for disturbed areas.
P. Driveway permit (Exhibit 22): A copy of the driveway permit that was issued
in November, 1 , 2018 that will serve Lot 1 but will need to meet County
standards . Lot2 will be using a historical access but will require an easement
through Lot 1. (Exhibit 7 Garfield County Road and Bridge)
Q. Emailfrom Tricia Parish to Jason Neuman (Exhibit 23): An inquire into "Final
Closure" of the Sewage Treatment Facility. There was a determination, as
you will see in subsequent emails, that "Final Closure" status with the State
Water Quality Division is filing a Termination Permit Application for both the
Lift Station and the Sewage Treatment Facility
R. Emails forwarded from John Reed to Tricia Parish (Exhibit 24): These emails
layout the process for decommissioning the Sewage Treatment Facility from
the State's point of view.
S. Colorado Parks & Wildlife (Exhibit 26): This agency had no comments at this
time but would like to be included in the development process.

support of the minor subdivision.
Comments have not been received from the following agencies and departments: RE-
1 School District, City of Glenwood Springs, Black Hills Energy and Holy Cross
Energy.
VI. STAFF ANALYSIS
Article 7, Division l: General Standards
1. Section 7-101: Compliance with Zone District Use Regulations
The proposed subdivision is in general conformance with the dimensional standards of
the Ruralzone district. The minimum lot size in that zone district is 2 acres. The smallest
Iot in the proposed subdivision is 7.91 acres.
2. Section 7-102: Conformance with Comprehensive Plan and Compliance with
lGAs
The property is designated as Resrdential Medium in the Comprehensive Plan. This
means that the suggesfed density is 6-10 acres per dwelling unit. The proposed
subdivision achieves approximately 8.33 acres per dwelling unit. The proposal is in
general conformance with the comprehensive plan.

The proposed use is surrounded by rural residential parcels and is zoned Rural. The
proposed size of the subdivision tots are compatible with surrounding parcels. Most of
the surrounding parcels are already developed with existing single-family residences

8. Section 7-108 Natural Hazards
Gartie{ county hazard mapping does indicate moderate soil hazards on the site' The
parcel has areas of stope iiat ãre steep and 'o9fy' The apptication was reviewed by
the Cotorado Oeãiogi;at Survey ¡exniøit 10). They indicated that while they had no
objections to the-apþrovat of tie subdivision as súbmitted' However, the review also
indicated, "Mapped colluvium and debris ftow deposifs. .-may be subiect to
corapse/hydrocompaction. ...The cos recommends that geotechnical and/or geologic
hazards investigattions for future deveropment at the parcel inctude (but not limited to)
evaluation of these anticipated hazards'"

9. Section 7-109 Fire Protection
The Apptication was referred to the Glenwood Spnngs Fire Department and indicated
no remarks at this time. They would tike to be included in the developmenf process.
Article 7, Division 2: General Resource Protection Standards
10. Section 7-20l Agricultural Lands
The proposed Subdivision should not impact existing agricultural lgnd|..The area does
not consist of targe agriculturat operations but rather rural residential-type uses and
small ranches and oPen sqace.
11. Section 7-zl2Wildlife Habitat Areas
The area has btack bear, elk and deer habitat but no significant migration rgytes
according to the Gartied County G/S. Residents should be encouraged to follow "bear
aware,' practices and keep dogs from roaming free. A condition of approval has been
inctuded that the Appticant isêncouraged to fottow "bear aware" practices and follow
teash laws. Cotora'do parks & Witdlife had no current comments. (See Exhibit 26)
12. Section 7-203 Protection of Waterbodies
No waterbodies exist on the property.
13. Section 7-204 Drainage and Erosion
Sfaffdoes not anticipate any drainage to impact adjacent properties. The application
was reviewed by the Gartieid County designated engineer and no known issues were
identified with Drainage or Erosion. (See Exhibit 21)
14. Sections 7-205 Environmental Quality
No water or air quatity rssues are anticipated from the proposed proiect. The County
Environmentat Heatti recommends foltowing stormwater management practices during
construction and the County Contract Engineer recommends a stormwater permit' (See
Exhibits 14 and 21)
15. Section 7-206 Wildfire Hazards
The subject property is designated as Moderate, in the Community Wildfire Protection
plan --Witdland É,re Susðeptibitity tndex. The application was reviewed by the
Gtenwood Spnngs Fire Depaiment who indicated no rssues with the application (See
Exhibit 8)

16. Section 7-207 Natural and Geologic Hazards
As identified by the Colorado Geotogical Suruey's Revigtttl, the potentiat for
cottapse/hydrocompaction does exist on the property- A ptat ryt9 is suggested,
requ'iring á So¿r Report for addressing hazaryfous so/s, contaminafed soi/s, s/opes,
ge'o-haiards and for foundation design. (See Exhibit 10)
17. Section 7-2}SReclamation
No disturbance that woutd require reclamation is anticipated as a result-of the creation
of the proposed subdivision. The apptication was reviewed by the Gartied County
Vegetation Manager who indicated that the Appticant should supply a weed inventory
and a management ptan for any noxious weeds on site. Ihrs has been included as a
suggested condition of approval. (See Exhibit 13)
Article 7, Division 3, Site Planning and Development Standards
18. Section T-SOI Compatible Design:
The proposed /ofs and use are generalty compatible with surrounding land uses.
19. Section 7-302 Off- street Parking and Loading standards:
The Appticant has demonstrated through the apptication, that parking standards will be
met.
20. Sections 7-303 Landscaping Standards:
Single-famity dweling units are specificatty exen_tpted from these provisions of the code.
No further devetoprient is proposed as pañ of the Minor Subdivision application. The
Appticant has indicated thai they witt be in compliance with all landscaping requirements
in 7-303 (C).
21. Section 7-304 Lighting:
Att exterior tighting wiil need to be downcast and compty with County standards. A
County stanıard ptat note "K" will be required to be added to the plat'

The proposed Minor Subdivision lots will have access off of County Road 117. A
driveway permit was rssued by Gaffield County Road and Bridge for Lot 1. Lot 2 will
access through an easement on Lot 1, from an historical access. If an additional
driveway permit is required for Lot 2, this must be obtained prior to issuance of building
permit. AII accesses musf adhere to County standards and be builUremedied prior to
issuance of building permit. (See Exhibit 15)

S. Section 5-301(C)(5): Any necessary easements including, but not limited to,
drainage, irrigation, utility, road, and water service have been obtained.
The Appticant needs to update the plat to show the access easernent for Lot 2, along
with any utility easements on both lots.
G. Section 5-301(C)(6): The proposed Subdivision has the ability to provide an
adequate sewage disposal sYstem.
The Appticant has presented satisfactory evidence of adequate wastewater facilities
through Sunlight View Water and Wastewater.
7. Section 5-301(C)(7): Hazards identified on the property such as, but not limited
to, fire, flood, steep slopes, rockfall and poor soils, shall be mitigated, to the extent
practicable.
See Secfions 5, I and 15, above.
8. Section 5-301(CXB): lnformation on the estimated probable construction costs
and proposed method of financing for roads, water distribution systems, collection
systems, storm drainage facilities and other such utilities have been provided.
AIt required infrastructure for utitities, water, wastewater is already in place. According
to the Applicant, no extension of roads or storm drainage facilities is planned. Extension
of utitities witt be accomplished at Building Permit phase. The Applicant submitted a
pretiminary cost estimate of approximately $10,000 to extend utilities to the proposed
tots. The Appticant shatt demonstrate extension of utilities fo serye both lots. Staff
suggesfs including fhrs as a condition of approval.
g. Section 5-301(CXg): All taxes applicable to the land have been paid, as certified
by the County Treasurer's Office.
The Appticant witt need to obtain the signature of the County Treasurer on the final plat
indicating that taxes have been paid. This must be accomplished prior to the BOCC

signing the plat.
10. Section 5-301(CX10): All fees, including road impact and school land dedication
fees, shall be paid.
AII road impact fees shall be collected at the time of building permit. School Land
Dedication fees are discussed in Section 27 of this staff repoñ.
11. Section 5-301(CX11): The Final Plat meets the requirements per section 5-
402.F., Final Plat.
Staff suggesfs that the following corrections be made to the plat as a condition of
approval.
- The Applicant shall update the Plat Certificates.- The Applicant shall include an access easement on the plat for Lot 2 to ensure
that both parcels have access to County Road 117 and the required driveway
permits.
- The Applicant shall include plat notes A, B, C, D, E, H and K from the Garfield
County Resource Guide.- The Applicant shall add a plat note abouf a So/s Report.
- The Applicant shall reference the amended plat history.- The Applicant shallobtain the required signatures.- The Applicant shall demonstrate utility easements and extension of lines.
- A recommendation of radon-resistant construction for future dwellings.
- "Bear Aware" and dog leash laws awareness are conditions.- Appraisal of property or fair market value to determine School Fee shall be
provided by the Applicant.- The Applicant shall provide a Weed Management PIan.
- A recent Title Commitment shall be provided by the Applicant.
- Lot names that aren't to be confused with previous recorded plats that include
this property shall be added to the plat.
- The Applicant shallsatisfy ceñain conditions of approval priorto BOCC signature
and provide recording fees.
VII. SUGGESTED FINDINGS AND RECOMMENDATION
Staff recommends a finding that, with the recommended conditions, the proposed Minor
Subdivision is in conformance with the Comprehensive Plan of 2030 as well as the Land
Use and Development Code. Staff, therefore, recommends approval with conditions of
Sunlight Parkway Minor Subdivision.
Suggested Findings
1. That proper public notice was provided as required for the Administrative Review
of the Minor SubdivisÍon.

2. That with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended'
3. That with the adoption of conditions, the application has adequately met the
requirements of the Garfield County Land Use and Development Code, as
amended as well as Section 5-301(C) Minor Subdivision approval criteria.
Suggested Conditions of APProval
Conditions P rior to Sionature the Plat
1. That all representations of the Applicant contained in the Application submittals
shall be conditions of approval unless specifically amended or modified by the
conditions contained herein or unless othenruise modified by the Community
Development Director or the Board of County Commissioners'
2. Final review by the County Community Development Staff and the County
Surveyor's Office shall be required and all edits and corrections based on that review
shall be completed prior to submittal of the plat for signature by the Board of County
Commissioners.
3. The following edits shall be made to the Plat prior to submittal to the County for
final review (additional changes or updates may be required as part of the final review):

We only allow L access per parcel. Each access off a County road must have a permit and meet current County
standards. They will either need to share an access, or each lot will need to get a driveway permit from us. Does that

My comments for the Sunlight Parkway Minor Subdivision application are as follows:
1. Water and wastewater: The Will-Serve letters provided by the Sunlight View Water and
Wastewatercompany are sufficient to show that the two subdivided properties will have
adequate water and sewer utilities from the City of Glenwood Springs.
2. Decommissionino of Sunlioht View Wastewater Treatment Facilitv: Reports from SGM,
El1r/ironmental Services lnc., and the Colorado Department of Public Health and
Environment all indicate that the plant has been decommissioned according to local,
federal, and state regulations. Public Health recommends a soils test before construction
of buildings on the property that includes constituents related to the sludge ponds
previously located on the property.
O. Storm-water manaqement: Given the property's proximity to 4-Mile Creek, proper storm-
water management practices should be used to prevent sediment and other pollutants
from entering the creek during construction and use of the two properties'
4. Radon: lt is recommended that any dwellings built on the properties utilize radon-
resistant new construction (RRNC) practices to prevent radon gas exposure, which is
the 2nd leading cause of lung cancer in Colorado. After construction a radon test should
be conducted, and a fan installed on the system if necessary. Free radon test kits are
available at Garfield County Public Health offices.

As we have díscussed the sunlight Water and Wastewater Company has in the past operated a
sewer treatment plant near Glenwood springs. A few years ägo we entered into an agreement
with the Cíty of Glenwood Springs to handle the treatment of our sewage' Our engineer
subm¡tted plans to CDPHE for an extension of a sewer line and pump station to take our raw
sewãge to a nearby sewer line owned by the City. On March 15, 2016 we received a letter
(endJsed) indicating the plans had been approved, ES Project No. CWPDR02349.
This past fall we completed construction of the improvements and began sending our sewage to
the city for treatment. I have enclosed a letter from our engineer certifyíng the construction
was completed according to the approved plans and specifications'
The remaining sludge in the plant was pumped to the City for treatment' The treatment plant
was demolished and materials disposed of at the local landfill. We tested the soils from two
exfiltration ponds that received treated water from our plant to ensure they met the
requirements of the landfill. The materíal was then transported to the landfill'
we are no longer treat¡n8 any sewage nor is there any discharge at our location, During this
project we discovered that there never were permits issued for our operations. Applications
na j been submitted but permits had not been issued. So I am submitting two Withdrawal of
Permit ApPlication forms.

AT }VASTEWATER TREATMENT FACILITIES
When a domestic wastewater treatrnent works (including all domestic wastewater trcatment facilities
(WWTF) and appurtenances as defined in Regulationzz - ffeatment plants, lift stations, etc.) is
àecommissioned, the decommissioning efforti must be completed in a way that ensures protection of
waters of the staie (e.g., surface water, groundwater) and the surrounding environment in accordance with
appropriate environmãntal regulations.
- This document is intended to provide information regarding the
relevant Colorado Department of Public Health and Environment (Department) regulations to assist
entities in the development of plans to decommission all or portions of a domestic wastewater treatment
works. There may be other Federal, State, and local regulations and requirements regarding
decommissioningor other activities at the facility; this document does not address these' It is the
responsibility of the facility ownef to comply with the individual regulatiuns.

with Federal Requirements in 40 CFR 5 03 and the Colorado Biosolids Regulotion 5 CCR 1A02-64

reviewed the land use application of cappo Properties, LLC for the proposed sunlight Parkway
Minor subdivision pro¡eci. The proposed subdivision would split the existing 16.66-acre parcel
located at 2808 Cn itZ, Glenwood Springs into a 7'91-acre and an 8'75-acre parcels' The
zoning allows for a single family dwelling and ADU on each parcel' The submittal is titled
,,sunlight parkway tt¡inoi Subdivision Application" prepared by D.M' Neuman Construction Co'
RESOURCE,s review includes applicable technical criteria and standards in Article 4-104,4-
201, 4-203, and Article 7 of the GARCO Land use and Development code (LUDC)'
RESOURCE's comments are presented below'

and on a steep slope. The suitability of this existing access for a residential driveway is
questionable. The driveway plan should be evaluated at building permit and appropriate
modifications (such as creating a perpendicular access) made when the property is developed'
The south parcel driveway requires an easement through the North parcel' such easement
should be shown on the Final Plat'
Section 7-108 Natural Hazards
There was no technical analysis of natural hazards provided in the submittal' The property
appears to have the potentialfor unstable slopes for areas with slopes greater than 30 percent'
Development of the site requires site specific geotechnical evaluation prior to construction to
ensure that that the development is away from steep slopes, that cuts and fills don't create
slope movement issues, and for finar design of foundations and retaining walls' The property
formerly included wastewater lagoons and soft soils/organic soils may be an issue'
7-2Og Protection of Water Bodies
The proposed project is more than 200 feet from the Fourmile creek. There are no identified
wetlands in the project area in the submittal'
7-204 Drainage and Erosion
There is an existing drainage that traverses through the property. There is no supporting
analysis and documentation iegarding drainage and erosion control for the property'
7 -205 Environmental QualitY
The proposed project does not have any anticipated environmental impacts from anticipated
construction activities, provided that an appropriate drainage and erosion control plan is
developed. lssues related to the former wastewater lagoons appear to have been addressed
with CDPHE.
7-207 Natural and Geologic Hazards
As discussed above, the site appears to have a potential hazard fronr steep slopes gleater
than 30 percent. A site specific geotechnical analysis and investigation is required for siting of
the dwelling units and final design of the project'

Do you have anything showing "Final closure" compliance for the sewage Treatment Plant? Apparently, the water
Quality control Division is the entity that can do this designation; just like they certified the construction of the
treatment facility and lift station back in 201-6'
I know that sunlight View eluded to it in their comments and you did provide a study done by ESI and a letter from the
CDPHE in2o'J,6, but the actual "Final closure" language isn't in any of those documents'
Also, there will requirements for control of grounà water during construction/disturbance on the site' That may end up
being a note on the Plat.

the decommissioning of waste water treatment facilities. I had spoken to him on August 16th when he informed me
there was no "official process" forthis task. The attachment shows the steps required but again does not indicate there
is any inspection or approval provided by the state. I will also forward you an email from Margo Griffin regarding the
processing of the forms requesting withdrawal of the Sunlight waste water treatment plant permit applications.

What a terribte formt -- Under Part A, I recommend checking "Termination" and then tisting the
pending permit number. I think you shoutd use one, separate form for each permit because the
forms witt be electronicatty fited with the corresponding permit information.
Under Part D, check "Other Disposal Option Taken".. and write something líke "Sewage is now sent
to the City of Gtenwood Springs treatment ptant, and ls no tonger treated and discharged at the
Suntight Water site."
