Eric, I've looked into it. From what we can tell, when the previous homes were permitted everything that was submitted
indicated that the buildings were contained within the building envelopes on the subject lot. Nothing (and this is
evidenced by what you sent over) shows any part of the structure overhanging the adjoining lot. According to Andy, in
about 2005 or so we started requiring surveys for any homes that were closer than 50' to the property line, so now we
catch those encroachments. There is nothing that I can find in the PUD documents that provide for roofs to overhang
others properties and a maintenance easement, unless it has language about a roof overhang being part of the
easement,doesnot addresstheissue(andeveniftherewereroofoverhangeasementsthestructurebeingoutsideof
the building envelope is still an issue). Unfortunately, until the issue is resolved we cannot issue permits for zero lot line
homes that have roofs that overhang someone else's property. We brainstormed a few potential fixes that you could
look into: adding a note to the plat, amending the language of the PUD guide, or condominiumizing the development to
get rid of the lot lines as potential solutions.

Sheryl - Hope you are well. Please find the attached letter and support documents for a building issue we seem to be
having in The Fairways in Battlement Mesa. A local builder, Mitch Teaney, as copied on this email, brought the issue to
my attention. After his second meeting with the County, he was asked to research and come back with additional
information relating to his application for building permit. Not sure if I have additional information, but I certainly have
interest in the resolut¡on to the issue which is why I am involved now.
