I have a question in regards to Well Permit #75924-F, West Divide Contract #110421CB(b). We have two single family residences on this well. My husband, Tom, and I are looking to build a new house for us on this same property. The space we are currently living in will be turned into a garage with bedrooms and one bathroom above it. This space will be used for sleeping quarters for our adult children, as they need it. We would have the same amount of people using the well as we currently do. We will not have any third party renters. There will be no kitchen in this space. Garfield County considers this an ADU so we are going thru the ADU permit process. In talking with the County, we need to verify that we do not need to amend or modify the permit/contract on our well. I have spoken with Dwight, who is in the Glenwood Springs office of the Colorado Division of Water Resources. He seemed to think that based on Guideline 2016-1, we would not need to classify this ADU as a third single family residence using this well. This was considering not having a kitchen in the ADU and not having a third party renter. How does your department view this? Is our current well contract ok with this situation or would we need to amend it? Please give me a call if you have any questions! Thank you! By amending your contract to include an ADU you will be covered for future changes should you decide to rent, install a kitchen or sell to someone that would. Amending the contract is fairly simple and the cost to amend is $150. I'm attaching the form that you will need to fill out and return to me.
