held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs

when the following proceedings, among others were had and done, to.wit:
RESOLUTION NO. C ` - r 5
A RESOI.U1TO_N CONCERNED WITH THE APPROVAL OF A SPECIAL USE PF1t.MD
FOR STORAGE, PROCESSING, AND MATERIAL HANDLING OF A NATURAL
RESOURCE — NATURAL GAS COMPRESSOR FACILITY, ON A 6 ACR)~, ROPERTY
LOCATED NEAR COUNTY ROAD 300 IN THE ORCIPARD MESA AREA, GARFIELD
COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of'Garfield County, Colorado ("Board"),
has received an application fora Special Use Permit (`SUPS`) for Storage, Processing, and Material
Handling of a Natural Resource for a Natural Gas Compressor Facility from William R. Patterson,
Rodney C. Power, Ronald E. Tipping, and Marie E. Tipping, for a property located in the Orchard
Mesa area near County Road 300 within the A/ItRII) zone district; and
WI ;RREAS, the Hoard held a public hearing on the 15th day of August_ 2005 A.D., upon the
question of whether the above described SUP should be gamed or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions concerning the
approval of said special use permit, and
WHEREAS, the Board on the basis of substantial c npctenl evidence produced at the
aforementioned hearing, has made the following determination of tact as listed below:
That proper public notice was provided as required for the herring before the Board
of County Commissioners and proof thereof submitted in the record;

2_ That the hearing before the Board of Comity Commissioners was extensive and
complete, that sufficient pertinent facts, mailers and issues. were submitted and that
all interested parties wen: heard at Hail meeting;
3. That for the above stated and other n.. ria, the proposed special use permit is in the
best interest of the health, safety, morals, convenience, order, prosperity and welfare
of the citizens of Garfield County.
4. That the application is in conformance with §3.02,03, *5.03.07 and *5.03,0 attic
(iarfieid County lcnuia>g Resolution of 1978, as amended;
NOW THEREFORE, I1I IT RESOLVED by the Board of County. Commissioners of Garfield
County, Cole do. that SUP is hereby approved subject to Cernplianci: with all of tile following
specific conditions:
1. That all representations of the Applicant, either within the application or stated at the
hearing before the Board of County Commissiorcczs, shall he considered conditions of
approval unless explicitly altered by the Board.
2. That the operation of the facility be done in accordance with all applicable Wesal, sem, and
local regulations governing the operation. of this type of facility'_
3, The County rescrves the right to retain outside expertise, at the expense of the applicant /
operator of the facility, in order to conduct test or analyses of the physical nature, water
chemistry or groundwater properties can or away from the site
4, That this facility is for the sole use of the applicant. If any other entities are to be added as
users, then they would be subject to an additional SUP as well as rules and regulations as
administered by the COGCC.
5. 'llic applicant shall submit a weed inventory and control plan of the subject. property.
6. The applicant shall comply with all standards as set forth in §5_03.08 ''Industrial
Performaroce Standards" of the Garfield County Zoning Resolution of 1978 as amended..
7. The applicant shall identify all wildfilt and possible impacts the compressor station will
have and proposc a mitigation plan_
8. The applicant shall, as soon as electric bower is available, convert the coutpressur units to
electrical power.
