Simpson State Engineer MAR 0 1 1993 COUNTY T We have reviewed the above referenced proposal to divide a 40 acre parcel into four parcels of 3.0 acres, 17.0 acres, 10.0 acres, and 10.0 acres. The information submitted did not indicate the proposed configuration of the four parcels. The applicant proposes to serve the three acre parcel with an existing unregistered well located on the three acres. An application to register this existing well is currently pending with this office under receipt no. 349347. The availability of a domestic well for the 37 acre parcel (40 acres less the 3 acre parcel) will be the same as any tract over 35 acres. The applicants must obtain a domestic well permit for this parcel prior to the split of the 37 acres into three parcels. The domestic well permit will be limited to being the only well on the 37 acres, and will probably be limited to serving three single family dwellings (must specify that three dwellings are to be served on the well permit application), irrigation of not more than one acre of home lawns and gardens, and watering of the user's non- commercial domestic animals. In order to assure that a permanent water supply will be available on an equitable basis to all three lots, we recommend the following: 1. The well should be located on an outlot owned in common by all property owners using the well. Access to the well and the right to establish and maintain a pipeline shall be provided by easements where necessary. 2. The well should be jointly owned by the lot owners. 3. Covenants and/or other mechanisms should establish a lot owners association with powers to make decisions concerning management and operation of the well. A joint maintenance agreement is a required part of such an association. • • Dave Michaelson Page 2 February 25, 1993 We recommend approval of this proposal, based on a shared well serving three parcels on the 37 acres, if the above provisions are met, and contingent on the applicant obtaining a domestic well permit to serve three single family dwellings, and receiving a valid well permit to serve one single family dwelling for the existing unregistered well. A portion of the offsite drainage from the subject property enters Drainageways E2ala and E2alb (per our recent FEMA Drainageways study) which cross the existing Mesa Ridge Townhomes Phase II, and future Phase III subdivision. We have concerns that the subdivision of the subject property not result in increased offsite flows, either through increase of nonpermeable surfaces, or through realignment of existing irrigation ditches and wastewater ditches to serve the proposed four lots, which may adversely impact downstream facilities. It may be prudent for a Drainage Study and Ditch Plan to be prepared for the subject property. During the original platting of Jack's Pocket Village Filing 5, Battlement Mesa is required to install an alternate emergency access road from the Mesa Ridge subdivision onto County Road 308 adjacent to the subject property. We intend to construct such alternate access and extension of County Road 308 during the Mesa Ridge Phase III subdivision, which we are currently engineering and will be submitting to Garfield County within 30 days. Our sole concern is that any additional driveway access permits from the subject property onto County Road 308 be considered and issued in compliance with the engineered site plan for the Mesa Ridge Phase III subdivision, and such that it creates a harmonious driveway situation. The sanitary sewer collection system was not designed to be extended to the subject property and is not in the immediate vicinity, and the higher elevation of the subject property cannot be served by existing pressure zones of the central water system. Therefore, all considerations for the proposed subdivision exemption must be based upon adequacy of potable water wells, well permits and septic tank/leach fields. We are not opposed to the proposed Subdivision Exemption of Mr. Winter's property provided that the above -listed concerns are able to be adequately addressed by Mr. Winter and Garfield County in the exemption process. The approval was subject on completion of the following conditions: 1. All representations of the applicant shall be considered conditions of approval unless otherwise stated by the applicant. 2. The applicant shall have 120 days to complete the required conditions of approval. Extensions of 120 days may be granted by the Board for a period of up to one (1) year. 3. A Final Exemption Plat will be submitted indicating the legal description of the property, dimension and area of all proposed lots or separate interests to be created, access to a public right-of-way and any proposed easements for drainage, irrigation, access or utilities. 4. The applicant shall submit $200 in School Impact Fees for each lot created. 5. Prior to signing of a Final Exemption Plat, documentation must be submitted indicating the approval of the State Engineer's Office regarding additional wells or the sharing of the existing well. If addition, each parcel shall receive a deeded interest in the well(s). B) A well sharing agreement shall be provided prior the approval of the plat and shall be recorded in conjunction with each deed conveying ownership. 6. The following plat note shall appear on the exemption plat: a. No changes to the existing drainage ditches will be allowed without the approval of Garfield County Planning Staff. b. Control of noxious weeds are the responsibility of the property owner. 7. Driveway permits shall be required prior the signing of an Exemption Plat. Furthermore, the Garfield County Road and Bridge Department will review the driveway permit applications for consistency with the proposed geometries of adjacent Battlement Mesa projects. 8. The Final Exemption Plat will include the notarized signature of Mr. Alvin Winter. 9. If driveways are shared between parcels, appropriate easements will be appear on the Exemption Plat. The Fire Chief for GVFPD has also reviewed the proposal. If approval is only one additional home per parcel (four) of land, and not multi -building lots, and if native trees are cleared at least 80 feet from building site, the Fire District has no problem with the Petition for Exemption. Adequate water supply for fire protection is available from adjacent County road 308 for four parcels or tracts of land described in Mr. Winter's petition. The applicants are requesting the division of a 40.0 acre parcel into four (4) parcels of 3.0, 17.0, 10.0 and 10.0 acres each. The applicants are proposing to serve the parcels with an additional domestic well for the three (3) additional parcels. I have attached an Assessor's map indicating the location of the parcel, a portion of the appropriate U.S.G.S. quad and a copy of the registration of the existing well. It is suggested that you be present at the time of the meeting. Copies of the enclosed exemption public notice form need to be mailed by certified return - receipt to all property owners adjacent to or within 200 ft. of your property at least 15 days, but not more than 30 days, prior to the meeting. In addition, the notice needs to be mailed by certified return -receipt to owners of mineral rights, or lessees of mineral owners of record of the land proposed for exemption, at least 15 days, but not more than 30 days, prior to the meeting. The certificates of mailing and return -receipts from these mailings need to be presented at the time of the meeting or submitted to the Planning Department prior to the meeting. The exemption site must also be posted with the enclosed Notice poster, visible from a County Road, at least 15 days, but not more than 30 days, prior to the meeting.
