Bowman Garfield County Planning Department 20L4 Blake Avenue Glenwood Springs, CO 81601 Re: Williams Exenption Dear Ms. Bowman: We have received the above referenced proposal to separate 24.9 acres into two 1ots. A house and existing well are on one of the tracts and the applicants intend to share the existing well. A review of our records has failed to establish that the well in question is registered with this office. However, we also do not find any indication that this well would be prohibited from the proposed use. While we have no authority to authorize expanded use of an unregistered well, we would not believe the use of the well to serve one additional house would constitute material injury to vested water rights. We, therefore, have no objection to approval of this proposal. While we realize the smaller parcel is intended to stay in the family, we must require an assurance of permanent water supply to both parcels should one be sold in the future. Specifically, we require that joint ownership of the well, ease- ments, and ownership and maintenance responsibilities be reflected in deeds, plat notes, covenants, or any other agreements as may be necessary.
