BEFORE THE BOARD OF COUNTY COMMISSIONERS
OF GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. 1973, 30-28-101(d) the undersigned
J. Randy Wilson and Robert L. Howsam respectfully petition the
Board of County Commissioners of Garfield County, Colorado to
exempt by resolution three parcels of land, more fully described
herein, and for the reasons set forth herein.
1. Petitioners are the owners of a tract of land
in Garfield County, Colorado, which property is
located near New Castle, and is described as
follows:
All that part of the E2 of the SA of Section 32,
Tp. 5 S., R. 90 W., 6th P.M., County of Garfield
and State of Colorado, which lies northerly of the
right-of-way line of that certain parcel of land
conveyed to the Board of County Commissioners of
Garfield County in a deed recorded June 13, 1932,
in Book 159 at Page 378 as Reception No. 112868,
containing approximately fifty acres.
2. Petitioners wish to divide said property into four
parcels of 5.1 acres, 10.1 acres, approximately
10 acres, and approximatelyacres. Said par-
cels are described on Exhibits A, B, C, and D
attached hereto and incorporated herein.
3. In support of the petition, we respectfully state
the following:
a) If the petition were granted, the acre
parcel would have a county maintained road as
its southerly boundary which road would serve
as the northerly boundary of the other three
parcels and the other three parcels would each
abut upon a dedicated county road as their
southerly boundary, all as shown on the map
attached hereto as Exhibit E.

b) The 5 acre parcel is already improved with a
home and well and the petitioners are informed
and believe that water can be obtained by wells
on the other three parcels.
c) Electric utilities are available to the property.
4. If this petition is granted, petitioners hereby promise
they will survey the location of the road dividing the
),5 acre parcel from the other parcels, and provide
metes and bounds descriptions of the parcels described
on Exhibits C and D.
The metes and bounds description of the parcels de-
scribed on Exhibits C and D will be attached to the
Resolution and the Resolution will be recorded as
well as deeds of conveyance.

EXHIBIT "A"
A parcel of land situated in the E1/2SE4 of Section 32,
Township 5 South, Range 90 West of the 6th P.M., County of
Garfield, State of Colorado, and being more particularly de-
scribed as follows:
Commencing at a point on the northerly right-of-way line
of that certain parcel of land conveyed to the Board of County
Commissioners of Garfield County in a Deed recorded June 13,
1932, in Book 159 at Page 378 as Reception No. 112868, and the
intersection with the East line of the E1/2SE4 of said Section 32;
thence in a northerly direction and along said east line E1/2SE4
a distance of 600.00 feet to the true point of beginning; thence
on an angle to the left of 79°44'00" a distance of 430.00 feet;
thence on an angle to the right of 81°28'19" a distance of 396.81
feet, more or less, to a point on the southerly right-of-way line
of a county road as now constructed and in use; thence on an
angle to the right of 57°26'41" and along said right-of-way a
distance of 175.00 feet; thence on an angle to the right of
20°35'00" and along said southerly right-of-way a distance of
265 feet, more or less, to the point of intersection with the
east line of the E1/2SE4 of said Section 32; thence on an angle to
the right of 100°14'00" and along said east line of the E1/2SE4
said Section 32, a distance of 610.00 feet to the true point of
beginning, containing 5.00 acres, more or less.

EXHIBIT "B"
A parcel of land situated in the E1/2SE4 of Section 32,
Township 5 South, Range 90 West of the 6th P.M., County of
Garfield, State of Colorado, and being more particularly descri-
bed as follows;
Beginning at a point on the northerly right-of-way line
of that certain parcel of land conveyed to the Board of County
Commissioners of Garfield County in a Deed recorded June 13,
1932, in Book 159 at Page 378 as Reception No. 112868 and the
intersection with the east line of the E1/2SE4 of said Section 32;
thence in a westerly direction and along said northerly right-of-
way line a distance of 645.00 feet; thence on an angle to the
right of 81°47'46" and in a northerly direction a distance of
843.59 feet, more or less, to a point on the southerly right-of-
way line of a county road as now constructed and in use; thence
on an angle to the right of 57°07'14" and along said southerly
right-of-way line a distance of 225.00 feet; thence on an angle
to the right of 122°33'19" a distance of 396.81 feet; thence on
an angle to the left of 81°28'19" a distance of 430 feet, more or
less, to a point on the East line of the E1/2SE4 of said Section
32; thence on an angle to the right of 79°44'00" and along said
east line a distance of 600 feet, more or less, to the point of
beginning; containing 10.00 acres, more or less.

EXHIBIT "C"
All that part of the E 2 of the SW 4 of Section 32, Tp. 5
S., R. 90 W., 6th P.M., County of Garfield and State of Colorado
which lies northerly of the right-of-way line of that certain
parcel of land conveyed to the Board of County Commissioners of
Garfield County in a deed recorded June 13, 1932, in Book 159
at Page 378 as Reception No. 112868, containing approximately
50 acres, except for the following:
1. That part described on Exhibit "A."
2. That part described on Exhibit "B."
3. That part lying northerly of the road through
the property being the same road which crosses
the easterly boundary at a point which is
approximately feet south of the north-
east corner of said E2 of the SW4 and crosses
the westerly boundary at a point which is
approximately feet south of the north-
west corner of said E1/2 of the SA.

EXHIBIT "D"
All that part of the EZ of the SA of Section 32, Tp. 5
S., R. 90 W., 6th P.M., County of Garfield and State of Colorado,
which lies northerly of the right-of-way line of that certain
parcel of land conveyed to the Board of County Commissioners of
Garfield County in a deed recorded June 13, 1932, in Book 159
at Page 378 as Reception No. 112868, containing approximately
50 acres, except for the following:
1. All parcels described on Exhibits "A", "B" and "C"
hereto.
