EXEI,lPTION
APPLICABILITY
The Board of CounEy Commissioners has the discreEionary power to exempt a
oivision of lancl from the definition of subdivision and thereblr from Ehe
.orocedure in these Regulations, provided Ehe Board determines thaE such
exenption will not impair or defeaL the staEed PurPose of the Subdivision
Regulations nor be Oetrimental to Lhe general public welfare' The Board
shall make exenption decisions in accordance rviEh bhe reguirements ot
these regulation=. Following a review of the individual facEs of each
appljcation in lighb of th; requirements of these Regulations, the Board
nay approve, conditionally apProve or deny an exemption' An application
for exemption must sati!fV; at a mininum, all of the review cr iteria
i i sted below. compliance uith Ehe review criteria, however, does not
ensure exemption. The Board also nay consider additonal factors listed in
Section 8:60 of Ehe Subdivision RegulaLions'
A. No more than a total of four (4) tots, PdrceJs, interests or d'welling
units will be creaLed from any parcel, aL thab parcel r.ras described in
the records of the GarfiefO County Clerk and Recorder's office on
January l; i973, and is not a part of a recorded subdivision; however,
any parcel to be divided Uy exemption thab is spl iE bY a public
rignt-of-way (StaEe or federal highway, County road or railroad) or
natural feaLure, prevent.ing joint use of the proposed tracts, and Ehe
Civision occurs along the pufrfic righE-of-way or natural feature, such
parcels thereby created *ly, ar [t,e discretion of the Board, not be
considered to have been creited by exempt,ion rviLh regard to the four
(4) 1ot, parcel, inLerest or dwelling unit limitation otherwise
applicable;
B. Aii Garfield County zoning requiremenLs wiIl be met.; and
c. All tots creaLecj wiff hive i.gal access to a Public right-of-way and
any necessary access easements have been obtained or are in the
process of being obtained; and
D. Provision has been made for an adequate source of water in terms of
both the legal and Physi caI qualiti, quantit.y and dependabiliLy, and a
suitable type of sewage disposal to serve each proposed lot; and
E. A1l state and local environmental health and safety reguirements have
been met or are in the Process of being met; and
I. Provi sion has been made for any required road ol storm drainage
improv.ements; and
G. fiie protection has been approved by the aPPropriate fire dist,rict.
H. Any necessary drainage, - irrigation or utility easements have been
oblained or aie in the process of being obtained; and
I. School fees, taxes and special assessments have been paid--
(The SchooI ImpacE Fee i; S200.00 for each new lob creaLed).
?ROCEDURES
A. A r equest for exernpti on sha]l be submitted to the Board on forms
provided by the Cariield CounEy Department of DevelopmenU/planning
Division. Two l2) copies of the application, maps and supplemental
i nfor mat i on sha1l be submi tted.
B. The planning Division sha1l review bhe exemption reguesE for
con.oleteness within eight (8) days of submitt.al. If ii'rcomplete, the
appj ication shall be 'iitf,arawn f rom consideration and Lhe aPplicant
notlfied of the additional information needed. If the aPPlication is
complete, the applicant shall be notified in wriEing of the time and
ptate of the - board of County Commissioners meeting at which the
iequest shall be considered. In eibher caser Dotification shaIl occur
within fifteen (15) days of submittal.

West of the 6th Principal Meridian. Said parcel of land being
more particularly desrcribed as f ollows ! -
Beginning at a point on the west boundary of said SwL/4
NEl/4 of Section 35 also being a point on the north boundary of
the County Road; thence on the west boundary of said SWI/4NEI/4
of Section 35, 290.00 feet; thence due East, 295.00 feet;
thence southerly to a point on the north boundary of the County
