DESCRIPTION OF' THE PROPOSAL A. Site .DePcription: The site is located in a rural- area witn Ianduses rncluding ranching and agriculture, srngJ-e family residencesand open space. Two single family resid".,c.s and severalaccessory ouil-dings are located on the site and within the twoacre parcel proposed to be created. The County road separatesareas to the north with steeper slopes and native vegetation fromareas to the south with moderate slopes and agricultural usage.Both irrigation ditches and access roads cross [ne srte. B.Project Description:The applicants propose to create atwo acre parcer adjacent to the county ioad out of a rargerresurting in a 45.66 acre parcer and I two acre parcer. ITI.MAJOR TSSUES AND CONCERNS Adequate utiliLies are in place for the existing dwel-lings on thetwo.acre parcel. current colorado Division 5r water Resourcespolicies wiII allow for the approval of a new well permit on the40+ acre parcel. The existing houses on the site wiII both be located on the 2acre parcel oeing created and therefore considered one lot withimprovements. Of the 20 parcels created bythese exemptions, approximately L/3 were 5 acres in srze or less. According to Garfield County records, oo Iots have been createdby exempLion out of of Ehe proposed parcel since January l, 1973.Therefore, the proposal is in compliance with the subdivisionregulations limitation on the number of exempttons allowed on aparcel. The applicant will need to suomrt proof of separate legalexistence of the 47.66 acre parcel out of larger adjacent landholdings by the applicant. rV. SUGGESTED FINDIT'IGS I. That p"oper posting and public notice was provided as requiredfor the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissioners was extensive and complete, that aII pertinent facts, matters andissues were suomitted and that alt interested parties were hearoat that meeting. That for the above stated and other reasons, the proposedexemption is in the best rnterest of the health, safety, morals, convenj-ence, order, prosperity and welfare of tne citizens ofGarfield County. V.RECOMMENDATION APPROVAL, with the following conditions: 1. That the following Pl-at NoLes be included on the recorded Exemption PIat: A. That the creation of separate interests on the 2 acre parcelby selling one dwelling separate from the other is notauthorized by this exemption. 2. That access and maintenance easements be shown on tlre plat foraII irrigation ditches or access roads that cross the parcel. 3. That adequate proof of separate legal existence of the 47.66 acreparcel be submitted to the Planning Department. That all proposals of the applicant be considered conditions ofapproval unless stated otherwise by the Board of County Commissioners.
