A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTYSUBDIVISION REGULATIONS E'OR THE TRUST OF H. P. WILLIAMS
WHEREAS, The Trust of H. P. williams has petitione<i the Board ofCount,y Commissioners of Garfield County, CoIorad6, for an exemption fromthe definition of the terms 'subdivisiono and isubdivided landn underC.R.S. 1973, 30-28-I0I (10 ) (a)-(d), as amended, and the SubdivisionRegulations of Garfield County, CoIorado, adopted April 23, 19g4, Section8:00 through 8:60 and for the division of a q.A6 aire tract as describedin Book 502t Page 511, as filed in the office of the C1erk and Recorder ofGarfield County, Colorado into three tracts of approximately l0 acres, 5acres, and two acres, more or less, which proposed -aivia"A tracts are morepractically described as follows:
TRACT A: see attached regar description for Tract A.
TRACT B: see attached legal description for Tract B.
TRACT c: see attached legar description for Tract c.
(in the state of colorado and the county of Garfierd); and
WHEREAS, the remainder of said 47.65 acre tract has been merged wiEhadjoining properties owned by the applicant so ;; not-t-o"'"iiut" anyadditional parcels, and
WHEREAS, the Petitioners have demonstrated to the satisfaction of theBoard of . county commissioners of Garfield county, Colorado, that theproposed division does not fal1 within bhe purposes'of part 1, Article 2g,Tit1e 30, colorado Revised Statutes 1973, i" lmended, for th; reason thatthe division does not warrant further subdivision review, and
WHEREAS, the Petitioners have demonstrated to the satisfaction of theBoard of county Commissioners of Garfield county, colorado, that there is? reasonable probability of locating domestii water on each of saidtracts, that there is existing ingresi and egress to said tracts, Ehat thelocation of septic tanks qirr b6 permitted by the colorado o"piriment, ofEealth, that !h. requested divisi-on is not plrt of an existing or rargerdevelopment and does not fall within the geniral purposes and intent ofthe subdivision regulations of the State oi Colora-clo and the County ofGarfield, anl should, therefore, be exempted from the definition of theterms 'subdivision' and "subdivided landi as set forth in C.R.S. Lg73,30-28-10f (10) (a)-(d), as amended;
